Showed home in 2023 in KS 67502.Local knowledgeProcess expertiseResponsivenessNegotiation skillsTommy rushed the process with each house we toured stating we needed to move now if interested. Then presented paperwork with no explanation that needed to be signed "ASAP". DO NOT recommend for first time buyers that may need help through the proces...Response from Tommy Rogers on 2/5/2024
The client opted to sign digitally online instead of in person. The client completed the signing of the entire offer packet including the contract and all other associated documents in just a coule of minutes. This indicates that the client never actually read the documents prior to signing. This is evident by the time and date that I sent the signing request and the timestamp of when the signing was complete only moments later. Without going over the paperwork with me in person or at least over the phone, it was the responsibility of the client to read each document carefuly and thouroughly before applying the client signature. The client was encouraged and advised to ask questions during the signing process and the client did not. I never suggested the client " move now " on any property because I had all of the time in the world. I informed the client that I could work with them for well over a year before they find " the right house ". The client was in a hurry due to loosing their home within 30 days and this was the reason for the rush. The client voluntarily opted out of signing in person where we could have gone through each document one by one so there was full understanding of what the client was signing and why. This is why I recommended that the client seek legal counsel to help explain the documents . The client had a 45 day closing so there was ample time to meet up with me or even have a phone conversation and gain a full understanding of all of the documents that he would be signing throughout the transaction. The client was advised that all documents could be reviewed by legal counsel prior to signing if we were not going over said documents together and the client did not take that option either. The client admits that he signed legal documents without understanding what the documents contained as a result of not meeting with me and going over the documents nor did the client opt to seek legal counsel over a span of five weeks. The client signed a Buyer's Agency Agreement through AuthetiSign without reading it first and I was accused of, " sneaking it in " without him knowing, and the client accused me of being " dishonest " because he did not read the document or have a third-party explain the document to him before signing. In short, the client had a bad experience because the client did not follow the advice I gave him on multiple occasions about reading documents thoroughly before signing the documents or having said documents explained to him by either myself or legal counsel despite my best effort to advise him multiple times to do so. A Realtor can only do so much, as should be evident by my other reviews being five-star. As a Realtor, your client has to be willing to work with you and not against you in order for you to represent their best interest on a professional and ethical level.
