It is unfortunate when a prospect and a landlord come to a disagreement. In this case the prospect signed a rental application. They expressed such great interest in the property that they provided a non-refundable application deposit to hold the property for over a month until they were ready to move-in. The prospect cancelled the agreement after being approved and wants a full refund after the property had to sit vacant due to their hold. What is at dispute here is the difference between an "application deposit" versus a "security deposit". An application deposit holds property, but is not refundable after the applicant is approved. The applicant was offered a partial refund, but insists on going to court for a full refund of their non-refundable application deposit.
