I have empathy for tkaftan he should not have had the extra expense; a few things must be mentioned here to get both sides of the story. The condo was bought for the agreed price the Home Owner Association fees which I verified with the Management Co’s owner who quoted me a HOA fee on a 2 bedrm not a 3 bedrm this was not known until after the closing. You would think it should have been in the contract, it wasn’t, why because the lawyer never verified it. Other fees & taxes were due also so in the purchase offer I put "Contingent on old previous HOA fees special assessment’s & taxes being discharged" this was put in the contract (verbatim) but not acted on at the closing by tkaftan lawyer resulting in the charges stated by him. The purchase offer is written for the lawyer to use & transfer into legal terms to his contract. It is the lawyer’s responsibility to verify the information he puts in his contract & to act on that information that's the purpose of a contract & hiring a lawyer
