Greg, if you had a problem with the contractor you should have contacted him and told him you were not satisficed with his work and then he would go out there and make it right. I have used him for multiple years and he would have done that. Since the home was vacant showings and inspections were approved to go in and see/inspect the home. You texted, "Dang, it is not ready." That was an hour before their inspection happened and I didn't get your text until later. You asked out of the contract when we already had an accepted offer. I was protecting you because the buyer wouldn't just walk away without taking potential legal action. I did an estimate of proceeds right away based on the mortgage payoff you provided. That amount was $10,000 off. The paperwork you saw was a mistake by the attorney when the prepared the deed. I never said I didn't make mistakes but all the problems that happened in this transaction don't all fall on me.

Once a buyer and seller execute an offer it is a legal binding contract. The earnest money is released upon closing, a release, or judge's order. A real estate company can't just release even if the company feels it should go one way or another. The seller did end up releasing the money and returned to the buyer.
