You all put down $7,000 as a due diligence fee which we discussed was non-refundable should you back out of the contract. On Saturday you informed me that you wanted to terminate the contract, if the seller did not respond on Sunday about the repair request. I sent the termination of contract to you the following Monday and again informed you that if you terminated the contract that you would not get your due diligence fee back. We were still within our due diligence period when the contract was terminated; however, that had nothing to do with you all losing your due diligence fee as it was non-refundable because you backed out of the contract.

I left a voicemail message and sent a text message 2 hours before the proposed appointment time to let you know that appointments where booked and the next available appointment time was an hour later. You where working with another agent and did not disclose this to me until I met you at the property. I did show the property to you as a courtesy. There where multiple people waiting in line to tour the property. While touring the house, you opened the back door to go outside into the backyard. I ask you to wait to go outside until you walked through the house and go out the front door to tour the yard. The reason for this is that I wanted to lock the house back so that the next agent could show the property as there where several other agents there waiting to show their clients the property. I showed the property to you and after finishing the walk through you went outside to tour the backyard. Any questions you had about the property should have been directed to the agent you were working with.
