The condition of the property at close of escrow is the responsibility of the seller. Real estate agents are not a party to the contract or any contractual obligations of the seller or the buyer. Our company policy does not allow the real estate agent to perform a verification of condition inspection on behalf of the client. The client must elect to attend the optional verification of condition inspection or sign a waiver to forgo the inspection. You cancelled the verification of condition walk through inspection at the last minute that was scheduled on Wednesday, July 3 at 9am. Then you signed the waiver for the verification of condition walk through inspection. You then requested to close prior to the contract COE date of Monday, July 8. The seller agreed to do so and escrow funded and closed on Friday, July 5. Keys were provided to you via lockbox access on July 5. You contacted me at 6 am on Monday, July 8 with a claim that the water heater was leaking. I informed you that there is a home warranty policy in place that should cover the repair or replacement. Furthermore, I stated that the warranty requires a claim to be filed and then a qualified contractor that is within the warranty company network must inspect the defective water heater to determine the scope of coverage. You made a statement that you are not going to file a claim and that you have scheduled a contractor to replace the tank water heater with a new tankless water heater at a cost of $3,200 on July 8. On Tuesday, July 9, I received a text message from you at 6 am stating the seller left the washer, dryer, ladders and debris on the premises. You demanded to speak with the listing agent, Adam Golden and I gave you his contact information. You called Adam and had a conversation filled with expletives. Adam responded by contacting his clients and then arranging for the items to be removed at no cost to you on Thursday, July 11. I reached out to another hauling company and hired them to remove the items on the afternoon of Tuesday, July 9 at no cost to you. On Tuesday, July 9, you contacted the home warranty company representative, Jennifer Britton, to file a claim with the home warranty company for a defective water heater after you had it removed and replaced even though I had informed you that the home warranty policy only covers repairs if the claim is filed before repairs are completed and that the warranty company requires that one of their approved contractors performs and inspection for the warranty coverage compliance. Jennifer Britton informed you that she contacted the customer service department to review the situation for an approval to remedy the repair claim. At the end of the day sent one of the most vile and twisted email messages to the home warranty representative after she informed you that the warranty customer service department must review and approve a claim made after repairs were completed and using a contractor outside of the warranty company approved contractor network. Additionally, you ignored the protocol and legal remedies available to you through the purchase contract to pursue a claim for the condition of the property with the seller. You chose instead to place the blame on me and post negative reviews on social media even though I provided you a home protection policy at no cost to you, provided a coupon for house cleaning and to re-key the locks at no cost to you and I arranged to have the items hauled away that were left behind by the seller at no cost to you.
