Buyer beware. I am writing this in hopes that it may protect someone else from having as horrific an experience as I’ve had, choosing Keely as my agent. Keely was great in the beginning. She seemed attentive and was readily available for showings, ho...

Response from Keely Kirby on 5/29/2023

Hi there, Karin. Thank you for taking the time to write a review. I respect your point of view, acknowledge your time involved & the resulting emotional toll this experience had on you. Throughout the purchase process itself, we had conversations ( in length ) going over every detail, at every stage, to provide you the space to deduce, digest & decide how you would like to proceed / if you would like to proceed. When you expressed your interest each time to proceed; you eventually took ownership of this home. We had also executed a final walk through to acknowledge the repairs made, the condition of the home & if at that time there was anything that shifted your desire to commit to closing; you vocalized your satisfaction. The level of honesty, integrity & professionalism applied by the opposing party & their hired contractors demonstrated during / post transaction is absolutely out of my control. What you are referring to in regards to taking lead on was the orchestrating of multiple contractor appointments (3 for each repair), around your limited availability, to bid repair items that you were not satisfied with. We both agreed that was the most efficient way to accomplish the task at hand. Had you vocalized alternatively, another course of action would’ve been executed. I provided my best efforts, as your Realtor, to support you as best I could to land on a better ending for your experience - well after my duties as your buyer’s agent were satisfied. My seasoned principal broker (at the time) affirmed that my duties were fulfilled and to proceed with caution; providing any more involvement as the discussion amongst our party foresaw CCB & small claims as the next move. As a buyer’s agent, that is where my duties and jurisdiction end. I volunteered *hours* of my time, after the closing of this transaction, to create a binder for you of all the email exchanges, text messages, timeline, sale agreement; notating all items in question as a result of the selling party’s way of doing business. In addition to our meetings that we had both in person and over the phone (held after the closing of the sale), the abundance of phone calls made to connect with the businesses that were ‘hired’ to do the repairs & requesting that they provide us documentation for your case, taking on of the financial responsibility & hiring of contractors for repairs that were not mine to absorb contractually, researching resources for you to pursue if our attempts to hold the selling party accountable… I am sorry that I couldn’t provide more at the given time I was needed for additional drafted narratives for your / our experience or to be present in court (I was out of the Country & unable to meet your request in the time that was given). The selling party hired a general contractor to satisfy your list of repairs. When asking for all compromised doors to be replaced, expecting the stain to perfectly match the stains of those that were not compromised, was never vocalizing to me prior to / during the drafting of your repair addendum , that you had signed; only after closing did this become a vocalized concern of interest. When requesting the replacement of compromised boards in the deck, how the hired contractor of the selling party accomplishes that, is out of my control (and area of expertise) - that you signed off on. Hiring a contractor post transaction to review his work , of which was notated incorrect & not up to code, does not mean that your buyer’s agent failed you. Due to the contractor's board & small claims not being able to provide you the support & outcome you desired to acknowledge in regards to your unfair & undeserving experience, your buyer’s agent shall then absorb what the selling party wasn’t held to. I absolutely agree with you, Karin. I would not choose this ending for you or any of my clients. You deserved more respect as a person & for your financial investment into this home than what was demonstrated from start to finish. I apologize for failing you & I am grateful that you took a chance on me for this transaction.
