    This tenant is disgruntled because they did not receive their security deposit in full. The tenants failed to receive their deposit in full because they failed to address tenant items such as cleaning, carpet cleaning and repairs considered above normal wear and tear. This tenant was provided with their final security deposit statement, which documented the charges that were applied against their deposit, which are deemed valid, per Idaho State Code. DJW cannot be found liable for this tenant failure to comply with the terms of the lease agreement, especially since they failed to return the property in a rent ready condition.     DJW Property Management has been in the industry for over 20 years, and we are very competent with understanding lease terms; otherwise, we wouldn’t be in business for as long as we have been. Furthermore, this tenant has been informed, on several different occasions that the Owner hired DJW as their representative and if they had any questions or concerns, then they would need to correspond directly with DJW; however, this tenant still tries to correspond directly with the owner regarding any issues they have. The owner understands DJW is their representative and contacts our office regarding any matters this tenant brings to their attention, which in turn the owner allows DJW to address on their behalf. DJW always honors pre-existing lease agreements; to be in compliance with Idaho State Law and we did not ignore the previous lease agreement that was in effect. The previous lease agreement stipulated rent was due on the 15th of the month, which means the tenant had until the 15th of the month to pay rent before late fees incurred on the account; however, when the previous lease agreement expired and the tenants agreed to the new terms of the new lease agreement, which stipulated rent was due on the 1st with a grace period until the 5th, meant the rental rate of $1850 was due no later than the 5th and the previous rent amount paid covered from the 1st day of the previous month to the 31st day of the previous month. Although we obtained owner approval to waive the unpaid rents, in an effort to rectify the issue amicably, we in no way “ignored” nor misunderstood the terms of this tenant’s previous lease agreement. Additionally, as was explained to this tenant, per policy, all communication regarding disputes is handled in writing. DJW responds to all emails within 24 business hours, which is standard in the industry; however, when a tenant consistently sends multiple emails at a time before allowing us to respond, this delays our response time, since we must read all emails before responding.     We do not show this reviewer was ever a tenant of DJW, but rather a family member of a previous tenant. Unfortunately, we are unable to discuss or disclose tenant information with those who are not a party to the lease agreement; therefore, this review is based on hearsay. The tenant was disgruntled because they did not receive a security deposit refund since the tenant failed to complete the necessary cleaning, carpet cleaning and repairs considered above normal wear and tear. Since the tenant failed to comply with the terms of the lease by returning the property to the same condition it was in at the inception of their tenancy, the security deposit was used to restore the property to rent ready condition, as stipulated in the lease agreement. DJW cannot be held liable for the tenant failing to comply with the terms of the lease agreement upon vacancy. Thank you. DJW PROPERTY MANAGEMENT

    Idaho State Law states the landlord may use the deposit for reasons designated in the lease, such as cleaning, carpet cleaning and repairs considered above normal wear and tear to return the property to the same condition it was in at inception of tenancy. The move out inspection report documented the tenants were not present for the duration of the move out inspection, which notates additional cleaning and carpet cleaning was needed; therefore, this tenant’s security deposit was charged for the carpet cleaning and additional cleaning needed that was considered above normal wear and tear and what was noted on the move out inspection report. All charges applied to the tenants account are in accordance with Idaho State Law and supported by photo evidence. Additionally, our agents make no determination of charges, and since they cannot assist with the determination of charges being applied to a tenants account, they are instructed to inform tenants to contact our office.     The tenant was present for the move out inspection and they signed and agreed to the items documented within the move out report. The move out report noted repairs and cleaning that were considered above normal wear and tear. Per the terms of the lease smoke alarm batteries are the tenant’s responsibility to replace and the move out report documented the existing batteries were in question. Since our office was not provided with receipts of the new batteries being installed, the batteries were replaced to be in compliance with Idaho Fire Code. The noted holes documented were screw holes, which are not considered normal wear and tear under the terms of the lease or Idaho State Code. Since the tenant failed to address the repairs and cleaning considered above normal wear and tear the charges applied to their account are in accordance to the term of the lease and Idaho State Code.
