Unique opportunity to live in a nature preserve, Scheier Natural Area (SNA), and serve as its caretaker. SNA is located in rural Fluvanna County approximately 15 minutes west of Palmyra and 30 minutes southeast of Charlottesville. Caretaking duties include mowing grass as needed and clearing woody growth (twice a year) from pond dams. The caretaker will also monitor the area for repairs needed and clear trash from public receptacles as needed. Other duties consistent with the upkeep of the property may arise. SNA includes an education pavilion, over three miles of trails, and nine farm ponds in various states of regression. The property is ideal for a nature lover and evironmentalist. No hunting is permitted at SNA and outdoor pets are not permitted. LEASE AGREEMENT 1. DATE. This lease agreement is entered into October 1, 2022 2. PARTIES. By and between Rivanna Conservation Alliance hereinafter referred to as the "Landlord" and ________________ hereinafter to be referred to as the "Tenant." 3. DESCRIPTION OF THE RENTAL COTTAGE. Witness that in consideration of the rental below specified and of the covenants hereinafter stipulated, the Landlord agrees to lease Scheier Cottage 917 Long Acre Road, Palmyra, VA 22963. 4. TERM. The lease term shall be 12 months. The lease shall start on October 1, 2022 and expire on September 30, 2023. The deposit for the rental cottage shall be (first month's rent and a security deposit of $300.00) 5. RENT. Tenant agrees to pay as rent (the "Rent") the total sum of 700.00 per month) due and payable in advance. Rent for each month thereafter shall be due on the first day of such month, commencing on October 1, 2023. The Landlord will pay the electric utility and the trash pickup. Rent shall be paid to: All rent checks to be made out to Rivanna Conservation Alliance. Mail check to Rivanna Conservation Alliance 1150 River Road, Suite One, Charlottesville, Va. 22901) If Rent is not received before the 5th day of a calendar month, Tenant shall pay as additional rent a late fee of $25.00 for each such month. All Rent payments shall be applied first to past due rent and other charges owing under this Lease. The remaining portion of such payments, if any, shall be applied to current Rent. If there are two or more persons constituting Tenant, Landlord shall have the option of requiring one check, cashier's check or money order for each monthly installment of Rent. Failure to pay the Rent pursuant to the terms of this Lease is a default under this Lease. SECURITY DEPOSIT. Tenant shall pay the sum of $300.00 as a security deposit. The Security Deposit will be held by Landlord to secure Tenant's full compliance with the terms of this Lease. During the Term, until 30 days prior to the termination or expiration of this Lease, if Landlord determines that any deduction is to be made from the Security Deposit for charges arising under this Lease or by law, Landlord will give written notice to Tenant of such deduction and the reason for such deduction within 30 days of the date on which Landlord makes such deduction. Tenant agrees to pay Landlord such sums as may be necessary to restore the Security Deposit to the amount set forth above. RENEWAL TERM. Upon the expiration of the Term, this Lease shall automatically renew for an additional one-year lease term unless the Tenant or the Landlord gives written notice to the other party prior to thirty (30) day of the termination of the Terms of the Lease. If the Lease is renewed, the Lease shall continue, upon the same terms and conditions set forth herein. 6. USE. The use of the premises shall be for a personal residence and to assist the Rivanna Conservation Alliance in maintaining the Scheier Natural Area property. The tenant shall use the property for no other purpose except with the written consent of the Landlord. 7. ASSIGNMENT. The Tenant may not assign or sublet any part of said Premises without the written consent of the Landlord. 8. TENANT'S MAINTENANCE RESPONSIBILITIES. The Tenant shall serve as the official caretaker for the Scheier Natural Area and agrees to maintain the interior and exterior portions of the Premises and keep everything in good repair at all times. Caretaker duties include the items below, with a detailed list to be negotiated between the Tenant and the Landlord; Mowing of the property on an as needed basis, Walking the property weekly and address any items of concern, Check the Education Center after each event to be sure that all is in good shape, Advise Landlord if problems with the trails are identified. Alterations, additions or structural improvements made to the Premises must have the written consent of the Lessor. Said alterations, additions or structural improvements shall remain a part of the Premises at the conclusion of the term of this lease. In order to plan for the tenant/caretakers personal schedule, RCA and its members will advise, in advance, of any event, workshop or other activity being held at the Natural Area and/or its Education Center. 9. INSURANCE AND INDEMNIFICATION. Insurance to be Maintained by Tenant: Tenant shall maintain insurance for all his/her personal property located in the cottage occupied by the Lessee. Any theft or damage to personal property (theft, water leak, natural disaster, etc.) is tenant's responsibility. 2) Waiver of Subrogation: If either party is paid any proceeds under any policy of insurance naming such party as an insured, on account of any loss, damage or liability, then such party, hereby releases the other party hereto, to and only to the extent of the amount of such proceeds, from any and all liability for such loss, damage or liability, notwithstanding that such loss, damage or liability may arise out of the negligent or unintentionally tortious act or omission of the other party, provided, that such release shall be effective only with respect to loss or damage occurring during such time as the appropriate policy of insurance of the releasing party provides that such release shall not impair the effectiveness of such policy or the insured's ability, to recover thereunder. Each party shall use reasonable efforts to have a clause to such effect included in its said policies, and shall promptly notify the other in writing if such clause cannot be included in any such policy. 3) Liability of Parties: Except if and to the extent that such party, is released from liability to the other party hereto pursuant to the above provision, a. The Tenant shall be responsible for, and shall indemnify and hold harmless the Landlord against and from any and all liability arising out of, any injury to or death of any person or damage to any property, occurring anywhere upon the Leased Premises, if, and only if and to the extent that such injury, death or damage is proximately caused by the negligent or intentionally tortious act or omission of the Landlord (or its agents), but shall not be responsible for or be obligated to indemnify or hold harmless the Tenant against or from any liability for any such injury, death or damage occurring anywhere upon the Leased Premises or because of fire, windstorm, act of God or other cause unless proximately caused by such negligent of intentionally tortious act or omission, as aforesaid; and b. Subject to the operation and effect of the foregoing provisions of this subsection, the Tenant shall be responsible for and shall indemnify and hold harmless the Landlord against and from, any and all liability arising out of any injury to or death of any person or damage to any property, occurring within the Leased Premises. 10. DEFAULT REMEDIES. The Tenant hereby agrees that if a default shall be made in the payment of rent or if the Tenant shall violate any of the covenants of this lease, then said Tenant shall become a tenant at sufferance, hereby waiving all fight of notice, and the Landlord shall be entitled immediately to re-enter and retake possession of the demised Premises. 11. TERMINATION. The Tenant agrees to quit and deliver up said Premises at the end of said term in good condition as they are now, ordinary wear and tear excepted. Tenant has the option to renew the lease for a term of one year. 12. QUIET ENJOYMENT. As long as the Tenant performs all of the covenants and conditions of this lease and abides by the rules and regulations he shall have peaceful and quiet enjoyment of the premises for the term of this lease. 13. UTILITIES: Landlord will pay for garbage collection. The tenant will pay for electric and water and is responsible for personal cable and/or internet fees. 14. COMMON AREA MAINTENANCE. The Tenant shall keep common areas in a neat, clean and orderly condition, and may be asked to assist with maintenance of the Scheier Education Center and surrounding areas. 15. RULES AND REGULATIONS. Tenant shall comply with the rules and regulations that Landlord shall from time to time promulgate and/or modify. The rules and regulations shall be binding upon the tenant upon delivery of a copy of them to Tenant. These rules include 1) no pets, 2) no smoking inside the building (s) and acceptance that the Landlord may inspect the premises with a 24-hour notice. 16. IMPROVEMENTS. Tenant agrees to take the space in "as is" condition. The tenant is responsible for maintaining the condition of the cottage upon termination of this lease. 17. SIGNATURES AND WITNESSES.
