RENTAL AGREEMENT 82 Chestnut Street Albany NY 12210
THIS AGREEMENT dated July _______ 2025 between William Newman, a "Landlord," and ______ "Tenant," is for rental of Unit #1 Garden Apartment unit dwelling located at 84 Chestnut Street, Albany NY 12210 under the following terms:
FIXED TERM LEASE AGREEMENT: Tenant agreed to lease Unit 1 for the period August 15, 2025 through February, 2026.
DEPOSIT AND REFUND: The security deposit on this Unit is $1,250 and will be paid by check. Receipt and cashing of this check within four (4) days of the date of this Agreement will secure rental. At the end of the occupancy, deposit will be fully refunded within five (5) days after Tenant leaves the dwelling undamaged and broom-clean. Failure to leave apartment in this condition may result in deductions from Tenants' security deposit which will be returned with a written statement. All keys to the premises are to be returned to the Landlord when the tenants vacate. Security deposit CAN NOT be applied as rent.
RENT PAYMENT AND PROCEDURE: Tenant agrees to rent Unit for the sum of $1,250. The initial rental fee (prorated from the occupancy date) will be paid to ensure the acceptance of this Agreement. Once the combined sum (deposit plus prorated fee) is received the tenant will be given keys for entry to the unit. Tenants are encouraged to make future monthly payments via Zelle to credit landlord's Keybank account. The due date for the rents thereafter is the 1st day of every month. Rent is considered late if not received by the 5th day of the month. Should circumstances prevent prompt payment, Tenant agrees to pay a late fee equal to $50 per month while unpaid.
SMOKING BAN: For everyone's safety and health, the dwelling is STRICTLY NON-SMOKING. This specifically includes prohibiting smoking cannabis inside the unit. By signing this lease the Tenant agrees to comply without exception. Non-compliance is cause for eviction with 30 days notice.
UTILITIES/SERVICES: Landlord agrees to pay all utilities and services (heat, gas, electric, hot water, garbage pick up) with the exception of Internet and cable. Unit has Spectrum line installed which Tenant can easily activate by calling the provider.
OCCUPANTS: Only the following may live in this dwelling: ____________. No one else may occupy the premises without Landlord's prior written permission. Tenants may house any single guest for a maximum period of fourteen days every three months.
PETS: Cats are welcome. Other pets may be allowed, but only by prior written approval by landlord. Dogs are NOT allowed.
SNOW REMOVAL: Tenant will remove snow and ice from front steps and sidewalk out front.
SUBLETTING AND ASSIGNMENT: Tenant shall not sublet the entire premises or any part of the premises, nor shall they assign this Agreement to anyone else without first obtaining the Landlord's written permission. Landlord shall not withhold permission unreasonably.
AUTOMATED NOTIFICATION: Tenant agrees to receive automated phone or text messages to alert Tenant of various situations regarding their apartment, such as rent past due or the necessity of moving vehicles during "No parking snow removal" regulations.
YARD: Tenant and guests are welcome use the yard, on the understanding that they do so at their own risk. The yard will be shared with the Tenant occupying the first floor of the building.
TRASH: Tenant agrees to dispose of their ordinary household trash by enclosing it in an air-tight plastic bag and leaving it in the green trash can under the stoop at anytime during the week. Recyclable items such as tin, glass, newspapers and cardboard must be placed in the city's blue recycle bin. On Monday nights (after 7pm by city regulations), Tenant will take responsibility to place the respective receptacles on the curb for Tuesday morning pick up.
DAMAGE: Tenant agrees to pay for repairs any damages which they or their guests have caused.
PAINTING: Landlord reserves the right to determine when the dwelling rooms will be painted.
LIQUID-FILLED FURNITURE: Tenant agrees not to keep any liquid-filled furniture in this dwelling without first obtaining Landlord's written permission.
PORTABLE HEATERS: Tenant agrees not to use portable heating devices to heat the apartment unless prior inspected and approved by the landlord and are used away from flammables. Device must be turned "off" when the tenant is out of the unit. "Electric fireplace" heating units are strictly prohibited from building.
APPLIANCES: Tenant will not install and/or operate any other major appliances not originally supplied with the apartment without written permission from the Landlord. A window A/C unit is permissible in the rear of the building. Portable floor A/C units are banned in the building.
ACCESS: Landlord recognizes that Tenant has the right to privacy and wishes to observe that right. At certain times, however, Landlord or his agents may need to gain access to the Tenant's dwelling for purposes of showing it to prospective Tenants, purchasers, purchaser's agents, lenders, or others, or for repairs, inspection, or maintenance. When seeking access under ordinary circumstances, Landlord will schedule entry between the hours of 9 AM and 6 PM Monday through Saturday, except holidays, and Landlord will provide Tenant reasonable advance notice by text. If less than twenty-four hours, then notice with Tenant's concurrence. In emergencies, there will be no advance notice.
PEACE AND QUIET: Tenants are entitled to the quiet enjoyment of their own dwelling, and their neighbors are entitled to the same. Tenant agrees that they will refrain from making loud noises and disturbances, that they will keep down the volume of their music and broadcast programs at all times so as not to disturb other people's peace and quiet.
PROLONGED ABSENCES: Tenant agrees that they will notify Landlord whenever they plan to be absent from their dwelling for more than ten days.
LAWFUL AND NON-BUSINESS USE: Tenant agrees to use this dwelling solely as their personal residence. They agree to conduct no business on the premises without first obtaining Landlord's written permission. Tenants agree that they will not themselves engage in any illegal activities on the premises nor will they allow others to engage in any illegal activities on the premises insofar as they have the power to stop such activities.
INSURANCE: Landlord's insurance if in effect does not cover Tenants' possessions or Tenants' negligence. LANDLORD WILL NOT COVER DAMAGE OR LOSS OF TENANTS' POSSESSIONS. Tenants are advised to obtain a Tenant Insurance policy to cover damage to or loss of their own possessions, as well as losses resulting from their negligence.
LOCKS: Tenant agrees that they will not change the locks on any door.
INSURANCE CONSIDERATIONS: Tenant agrees that they will do nothing to the premises nor keep anything on the premises which will result in an increase in the Landlord's insurance policy or an endangerment of the premises. Neither will they allow anyone else to do so.
FIRE OR CASUALTY DAMAGE: During any time when the dwelling cannot be used because of fire or casualty damages, Tenant is not responsible for payment of rent. Should a portion of the dwelling become unusable due to fire or casualty damage, Tenant is not responsible for payment of rent on that portion. In either case, Landlord reserves the right to decide whether the dwelling is usable and what portions are usable. Landlord is not responsible for repairing or replacing any improvements made by Tenant if those improvements are damaged. Should the fire or casualty damage have been caused by Tenant's own action or neglect, they shall not be relieved of the responsibility for payment of rent, and they shall also bear full responsibility for repair of the damage.
RULES AND REGULATIONS: Landlord's existing rules and regulations, if any made subsequent to this Agreement, shall be signed by Tenants, attached to this Agreement, and incorporated into it. Landlord may adopt other rules and regulations at a later time provided that they have a legitimate purpose, and become effective without further notice of at least two (2) weeks.
CHANGES IN TERMS OF TENANCY: Landlord shall advise Tenants of any changes in terms of tenancy with advance notice of at least 30 days. Changes may include lease termination with ninety day notice if the building is sold or other reasonable changes in the terms of this Agreement.
NOTICE OF INTENTION TO VACATE: In the event Tenant does not wish to renew this Agreement, they will give Landlord written notice of their intentions at least 45 days prior to the expiration of this Agreement, and they will give a date when they expect their possessions to be fully removed.
HOLDING OVER: If Tenant remains on the premises following the date of their termination of tenancy, they are "holding over" and become liable for charges equaling one/thirtieth (1/30) of the amount of their then current monthly rent for every day they hold over.
ENTIRE AGREEMENT: As written, this Agreement constitutes the entire agreement between Tenant and Landlord. They have made no further promises of any kind to one another, nor have they reached any other understandings, either verbal or written.
CONSEQUENCES: Violation of any part of this Agreement or nonpayment of rent when due shall be cause for eviction under appropriate section of the applicable code.
ATTORNEY'S FEES: If either party to this Agreement shall bring cause of action against the other party for enforcement of the Agreement, the prevailing party shall not recover attorney's fees.
ACKNOWLEDGMENT: Tenant hereby acknowledges that he has read this Agreement, understand it, agree to it, and have been given a copy.
