Rental Terms and Conditions SkyRun Whitefish Vacation Rental Contract- By submitting this reservation, you are agreeing to the following terms and conditions. For purposes of this contract the following terms are defined as: "SkyRun Whitefish" means Pawprint Peaks Rentals, LLC d/b/a SkyRun Vacation Rentals-Whitefish, its successor and assigns employees, agents and representatives. "Owner" means the underlying property owner, its heirs, successors and assigns. "Guest", "You", and "Your" means each and every individual staying on the Premises and subject to this agreement including invitees, representatives and any other individuals associated with guests during their stay (without regard to whether such persons have authority under this Agreement to be upon the Premises). "Premises" means the property subject to Guest's stay including outdoor spaces and common areas included in the stay. CHECK-IN AND CHECK-OUT TIMES: Normal Check-in time is 4pm, Check-out is 11am. SkyRun Whitefish is authorized to charge you $50/hr and to remove your items to our check in center and charge you for an extra night if you stay past Check-out. CANCELLATION POLICY: See property listing and/or reservation confirmation for the specific cancellation policy. In the case of a SkyRun Whitefish cancellation, through no fault of the guest, the guest may be entitled to a refund of lodging for the unused nights less certain booking costs. SkyRun Whitefish's liability shall not exceed the total amount paid for the unused nights in the event of cancellation. PAYMENT: Your payment of 50% of the grand total was paid at the time of booking. The remainder of the balance was paid 60 days prior to arrival. If you booked through Airbnb or another 3rd party site, they have collected your payments according to their payment terms & conditions. TAXES & FEES: SkyRun Whitefish collects all state, county and local sales and lodging taxes required by the appropriate jurisdictions. In addition to required taxes, SkyRun Whitefish collects a damage waiver and service fee so we can provide a more secure booking experience coupled with 24/7 guest support during your trip. LONG-TERM RESERVATIONS: Reservations of 28 nights or more are considered long-term and have different requirements. Long-term reservations are subject to their own cancellation policies, payment policies and terms. All monies paid for long-term reservations are non-refundable at the time the payment is collected. No refunds will be offered for cancellations. 25% of the total booking cost will be taken at the time of booking. The remaining balance will be divided into equal monthly payments so that the reservation is paid in full 60 days prior to guest arrival. Long-term reservations are not subject to local sales and lodging taxes. SkyRun Whitefish reserves the right to cancel long-term reservations within 24 hours of booking. SPECIFIC PROPERTY BOOKED: You have booked a specific property (the "Premises"). However, on extremely rare occasions, the Premises you booked may not be available due to circumstances beyond our control such as maintenance problems with the Premises, or a change of ownership or management of the Premises since you booked. In the event that the Premises you booked are not available, SkyRun Whitefish will attempt to place you into a similar or better property at the same price or offer you another property at a lower rate. If the replacement property offered is not acceptable to you for any reason, SkyRun Whitefish will cancel your reservation and refund your total amount paid. SkyRun Whitefish does not guarantee that a suitable property will be able to be found. If the Premises you have rented become un-occupiable before or during your stay (heat or refrigerator breaks for example), SkyRun Whitefish will also make our best effort to find you a similar or better place to move to and if unable to do so, refund the portion of your rent unused. EARLY DEPARTURES: As reservations are carefully scheduled in advance, no refund will be given if a guest leaves prior to their reserved departure date, regardless of reason. HOUSEKEEPING: SkyRun Whitefish units are SELF CATERING at no extra charge. That means that the Premises will be clean when you arrive and will be cleaned after you leave and include fresh linens and towels when you arrive. During your stay, YOU are responsible for any cleaning including taking out the trash and washing the linens that SkyRun Whitefish provides if you choose to wash them. If you want additional towels or linens, Mid-stay cleans may be purchased for a separate charge. DAMAGE, TRASH, & CLEANING: Any damage, excessive cleaning, excessive trash, incidental charges such as added housekeeping may result in additional charges, at the sole discretion of SkyRun Whitefish. DAMAGE WAIVER: Your rental INCLUDES an accidental reported damage waiver fee up to a maximum of $1,500. Therefore, the cost to repair any ACCIDENTAL and REPORTED damage to the Premises including any missing or broken items up to a maximum of $1,500 will be covered at NO CHARGE to you AS LONG AS the damage is reported to a SkyRun Whitefish employee before you depart. Any damage we deem to be purposeful or negligent or damage not reported will be charged to your credit card. Please report any damage that you notice when you check-in to avoid getting charged for damage you didn't create. SMOKING: Smoking is prohibited on the Premises at all times. Removal of smoke detectors is illegal and will result in charges. Violators are subject to a $500 fine in addition to applicable cleaning charges at the sole discretion of SkyRun Whitefish. LOCK OUTS: After-hours lock-out service will incur a charge of $50 if the guest is at fault. After-hours is defined as after 6 pm Monday through Friday and weekends. LOST & FOUND: It is the responsibility of the guest to ensure all personal items are gathered at departure time. Any item left behind in the property that a guest would like returned will be subject to a $35 handling fee plus packaging and shipping costs. We cannot guarantee an item left behind by a guest will be found. PARKING: SkyRun Whitefish will provide parking passes and/or parking guidelines including the maximum number of vehicles allowed. SkyRun Whitefish will NOT be held liable for ticketing and/or towing of guest vehicles. Guests exceeding the maximum number of cars will be asked to move additional vehicles or the additional vehicles may be towed. No refunds or compensation will be paid to guests that ignore the parking restrictions outlined in the ad when the property was booked. KEYS: All keys, keycards, remotes will be left in the unit on the kitchen counter prior to departure. Lost keys, keycards or remotes will incur a charge of $75. PETS: Pets are prohibited in the property at all times unless it's a designated pet-friendly property. Any evidence of pets discovered in or around the home will result in a $500 fine, plus charges for any damage sustained or extra cleaning required, at the sole discretion of SkyRun Whitefish. DESIGNATED PET-FRIENDLY PROPERTIES: There is a mandatory and non-refundable fee for bringing along your pet(s). The number of pets may not exceed the maximum listed for the pet-friendly home. If you bring a pet, you WILL be charged for ALL extra damage and cleaning required. You must comply with any applicable local regulations. Pets must be leashed at all times when outside and must not disturb the peace. Pets cannot be aggressive to other people (for example, it must not jump on or bite at neighbors). If there is a complaint of any type you will have to move your pet to a kennel at your expense immediately. You must pick up pet waste and remove it from the home and grounds before you depart (do not leave animal waste in trash containers). If you bring a pet to this property but have not indicated and paid for it on your reservation, you will be subject to immediate eviction of your party without refund, and a minimum fee of $500/pet. VEHICLES: Whitefish is located in a high-alpine environment subject to extreme weather including snow and ice that may make roads and driveways impassable and dangerous. All guests are encouraged to use all-wheel or 4-wheel drive vehicles. Roads can be difficult to navigate and driveways may be steep. SkyRun Whitefish will not provide refunds to guests unable to reach or get out of their property or to guests needing rescue or towing. HOT TUBS: Guest use of any hot tub or spa assumes all risks and liability. Guests are advised that there are potential dangers to children who are not carefully supervised, as well as any person using hot tub or spa too long or if a person has health risks, is intoxicated, using any kind of drugs or medication, or is pregnant. Guests are advised that the chemicals used in the servicing and maintenance of the hot tub can lead to skin and eye irritations, rashes, and other reactions especially in children. Guests agree to waive any claim whatsoever against SkyRun Whitefish, its owners, contractors, employees, principals, agents, and associated property owners accidents, illness, or injury arising from use of any hot tub or spa. Guest agrees that he/she is responsible and liable for any damage that occurs to the hot tub or spa through their or their guest's misuse or negligence. Should guest or their guests contaminate the water with any foreign substance by not abiding by the rules, Guest agrees to an additional charge of $125.00 to cover the cost to drain, clean and refill the hot tub and remediate the contamination to the filtering system. Each hot tub is serviced prior to arrival and the chemical levels are checked and recorded. UNFORESEEN ISSUES: Unforeseen and uncontrollable circumstances may occur during your stay including but not limited to: internet, TV, and utility outages, inclement weather, travel delays, limited availability of town services, the closing of common & home amenities (including hot tubs, pools, and fitness centers). Guests are not entitled to full or partial refunds for any unforeseen circumstances. SkyRun Whitefish and the reservations associated with a home are not part of or party to the sales contract for a home; in the event that a home is sold and future reservations are not accepted by the new homeowner, reservations are subject to cancellation or the reservation may be moved to another comparable SkyRun Whitefish property. VIOLATIONS: Any violations of this rental contract and/or SkyRun Whitefish policies may result in immediate removal from the property without refund. LIABILITY RELEASE: SkyRun Whitefish, its owners, employees, contractors, principals, agents, and associated property homeowners, will be released and held harmless from any and all liability, claims, costs and expenses whatsoever arising out of or related to any loss, damage or injury that may occur while on the premises. AGE & OCCUPANCY RESTRICTIONS: Guests must be at least 25 years old to reserve a property from SkyRun Whitefish. At any time SkyRun Whitefish may request that the guest who reserved the property provide a valid ID as proof of age. The person booking the property must be in the property for the entire duration of the guest stay. Maximum occupancy at any time is equal to the number of people the property sleeps in beds as advertised in the listing. No people beyond that number are allowed at any time. Exceeding this occupancy is grounds for immediate removal from the property without refund. PARTIES: No house parties, weddings, receptions or events are allowed at any SkyRun Whitefish property. If there is a party on the Premises (as further evidenced by a noise complaint, security report, or by excessive amounts of trash or destruction) the guest will be charged for a complete clean, replacement of damaged items and property, HOA fines, and any additional charges necessary to return the Premises to its previous state. Such activities completely void the Damage Waiver. TV: Most Premises are equipped with standard cable service; this is a service paid by the homeowner and a benefit extended to the guest at no additional cost and provided by a local service provider. Guests are not entitled to nor should they expect access to Pay Per View, Netflix, HBO or any other premium channel. Guests may never call the 3rd party service to purchase or extend the provided service. Circumstances outside of SkyRun Whitefish control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. SkyRun Whitefish will not reimburse or refund any monies to the guest in the event of any of the above circumstances. INTERNET: Most Premises are WiFi enabled; this is a service paid by the homeowner and a benefit extended to the guest at no additional cost and provided by a local service provider. SkyRun Whitefish cannot guarantee reliable or consistent internet service. Circumstances outside of SkyRun Whitefish control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. SkyRun Whitefish will not reimburse or refund any monies to the guest in the event of any of the above circumstances. If a guest wants to ensure optimized and reliable service, SkyRun Whitefish recommends guests travel with their own air card. PHONE: Guests understand that phones (land line or VoIP) may not be present on the Premises and should not be expected. Guests are encouraged to have mobile phones charged for communication in an emergency. Some properties have poor cellular coverage which is beyond SkyRun Whitefish control. Refunds and credits will not be provided to guests for slow or non-existent service. WEATHER: SkyRun Whitefish will not refund guests for any weather-related issues including but not limited to road conditions, lack of snow, too much snow, or inability to get to the Premises due to weather or flight delays/cancellations; or issues resulting in weather conditions such as power outages, etc. ENVIRONMENT & SNOW: Whitefish is located in a mountain alpine environment. Hydration is important to minimize impacts of altitude change. There is typically 10-20% humidity year-round. Summer temperatures may average 60-100 F with a low in the 40-50s. Many properties in Whitefish DO NOT have Air Conditioning (AC) fans provided for guest comfort. Winter temperatures may vary widely from negative temperatures to 40-50 F. Most properties in Whitefish have baseboard heaters which may take several hours to register heat changes. SkyRun Whitefish, HOA and building managers make efforts to clear private drives, sidewalks, stairs and access points but in this environment ice and snow will always exist, take care while walking and moving about to avoid falls and slips. Some access points, stairs and decks may not be shoveled if it is not primary access to the Premises. Please note that sometimes the garage is the primary access point. Driveways will be plowed when there is more than 6 inches of snow overnight and there may be delays in equipment reaching properties as major roadways need to be cleared by the county first and foremost. Despite efforts, ice and snow will remain, and ice melt is provided at some but not all properties. Decks, stairs, entranceways, sidewalks, driveways, paths and patios may be slippery; use caution at all times. Be cautious of roof overhangs where snow and ice are likely to build up and may fall. ELECTRICITY: Power interruptions and outages may occur at any time. SkyRun Whitefish cannot guarantee power, heat or electricity in the event of a power outage or interruption. SkyRun Whitefish will not reimburse or refund any monies to the guest in the event of any of the above circumstances. COMMON-USE AREAS & HOAs: Condominiums and townhouses are managed by 3rd party Home Owners Associations (HOAs). These HOAs manage and control shared amenities which include but are not limited to outdoor grills, hot tubs, pool, fitness areas, parking structures and areas, picnic areas and landscaping. Be aware that during non-peak times amenities may be unavailable due to circumstances outside of SkyRun Whitefish control such as building and amenity maintenance or closures. During peak times HOAs may need to make buildings and amenities unavailable for emergency maintenance and other reasons outside of SkyRun Whitefish control SkyRun Whitefish will not provide a refund if amenities are unavailable. SkyRun Whitefish offers vacation rentals 365 days a year and has no control over the availability of amenities controlled by HOAs or complexes. SkyRun Whitefish does not have any obligation to disclose availability of such amenities to guests. TOWN & RESORT SERVICES: SkyRun Whitefish operates within and around the town of Whitefish, Montana which offers wonderful events, entertainment, restaurants, cultural activities and more. Whitefish Ski Resort offers recreational activities including the availability of skiing, lifts, and trails based on weather conditions and seasonal schedules. SkyRun Whitefish offers vacation rentals 365 days a year and has no control over the availability of resort, town or county services and activities; nor does SkyRun Whitefish have any obligation to disclose availability to guests. SkyRun Whitefish will not provide any refunds to guests for the unavailability of such services. ABUSIVE CONDUCT: SkyRun Whitefish does not tolerate abusive conduct towards any of our employees or contractors. Abusive conduct means the intentional conduct that a reasonable person would find hostile or offensive. Abusive conduct may include the infliction of verbal abuse, such as the use of derogatory remarks, insults, and epithets; verbal or physical conduct that a reasonable person would find threatening, intimidating, or humiliating; bullying; or the gratuitous sabotage or undermining of a person's dignity. Every SkyRun Whitefish employee deserves respect and to work in an environment free of abusive conduct by guests. As a guest, we expect that you will treat our employees and contractors with respect and understanding and not engage in abusive behavior. SkyRun Whitefish reserves the right to immediately stop all contact with any guest who is engaging in abusive contact and to remove any guest that is abusive from any SkyRun Whitefish managed property. Refusal of any guest to vacate the property once properly notified as a result of abusive behavior will be considered trespassing and we will notify local authorities. OWNERSHIP of PROPERTY: The guest acknowledges that they do not own nor have any ownership rights to the property. The guest may never alter the appearance or function of any part or contents of the property at any time (this includes but is not limited to paint, window coverings, furniture, appliances). Additionally, the guest may never employ directly or on behalf of SkyRun Whitefish or the homeowner a 3rd party contractor or vendor to perform any work or services within or to the property (this includes but is not limited to hiring housekeepers, handymen, contacting utility providers directly). The guest may not move any furniture or electronics at any time. FOR SALE: SkyRun Whitefish provides short-term rental services to properties that may be For Sale. If a property is For Sale, and a potential buyer would like to view or tour the property during a guest stay SkyRun Whitefish will notify the guest prior to the showing. If a property is sold, reservations may be canceled and refunded, or the guest may be moved to another comparable SkyRun Whitefish property. LIMITATION OF LIABILITY: SkyRun Whitefish assumes no liability for your stay in Montana or the activities that you take part in during your stay. INDEMNIFICATION AND HOLD HARMLESS: Guests agree to indemnify and hold harmless the Owner and SkyRun Whitefish for any liabilities, theft, damage, cost or expense whatsoever (including but not limited to attorneys' fees) arising from or related to any claim or litigation which may arise out of or in connection with Guest use and occupancy of Premises including but not limited to any claim or liability for personal injury, damage or theft of property or infringement of intellectual property rights (e.g., illegally downloading video, audio or text files via any internet service located at Premises) which is caused, made, incurred or sustained by Guest as a result of any cause, unless caused by the grossly negligent or willful act of SkyRun Whitefish or Owner. Neither SkyRun Whitefish or Owner are providing any other warranty of any kind, except as otherwise expressly provided herein, whether written or oral, statutory or contractual, express or implied, including, without limitation, THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE, which are hereby expressly excluded. CAMERAS: To protect the Premises and preserve the owner's ability to continue renting their home, please note that some homes are equipped with outdoor security cameras. These cameras are in place solely to monitor compliance with Town and HOA short-term rental rules (such as parking, noise, and trash). Violations of these rules may result in guest fines, ticketing, or eviction. Guests are strictly prohibited from tampering with or removing cameras. AUTHORIZATION FOR CHARGES: Guest hereby authorizes SkyRun Whitefish to charge Guest's credit card for any and all amounts owed in connection with Guest's rental, including but not limited to Premises damage, excessive cleaning or trash removal, unpaid fees, and any other charges applicable to the rental. In the event Guest books through a third-party platform (including, without limitation, Airbnb, Vrbo, or similar booking services), Guest agrees that SkyRun Whitefish may pursue collection of any monies due through such third party and that Guest shall comply with the policies, procedures, and determinations of such third party regarding reimbursement of costs. Guest expressly agrees not to dispute, reverse, or charge back any charges made by SkyRun Whitefish pursuant to this Agreement. In the event Guest disputes any charge, Guest shall promptly notify SkyRun Whitefish in writing with documentation supporting the dispute, after which SkyRun Whitefish may provide supporting documentation, including inspection reports, photographs, invoices, or other records; if the booking was made through a third-party platform, the dispute shall be resolved through such platform's resolution process, and if the booking was made directly with SkyRun Whitefish, SkyRun's determination shall be final and binding. Guest acknowledges and agrees that this process shall be the sole and exclusive means of resolving disputes related to charges under this Agreement and that the determinations of SkyRun Whitefish (for direct bookings) or the applicable third-party platform (for third-party bookings) shall be final, binding, and enforceable. ACKNOWLEDGEMENT: You have 48 to cancel your reservation if you do not agree, otherwise you hereby accept the reservation. By accepting this reservation you acknowledge that you have read, and do hereby accept and will abide by the terms & conditions contained herein. This rental agreement may be changed at any time and without notice.
