Lease for Residence
Apartment located at: 733 Toledano St. New Orleans, La. 70115. Includes 1 refrigerator, 1 stove, 5 ceiling fans, 1 air conditioner, 7 mini blinds, 1 heater, 1 dishwasher.
No smoking allowed. This applies to visitors, relatives, etc. as well. Any smoking in apartment shall forfeit deposit and terminate lease.
Lessee to pay all utilities. Water is prorated as described in lease addenda. Lessee is obligated to keep gas and electricity turned on at all times.
This lease is for the term of 12 months
Water-(see addenda)-Lesee (733 Toledano St, New Orleans, La 70005 is to pay 100% of water/sewerage every month. Lessor will mail water bill copy or email bill to Lessee for their payment portion. This payment can be sent when rent is due or by a separate check.
Use of Premises:
The premises herein leased are to be used on for the following purpose. Private residence.
Lessee is obligated not to use any part of the premises for any private or commercial business, and is further obligated not to use the premises for any purpose that is unlawful or that tends to injure or depreciate the property.
Sublease
Lessee is not allowed to sub lease his/her apartment. Should anyone move in with Lessee, Lessors written consent must first be obtained. If Lessor is agreeable to permit the additional tenant. Lessee agrees to pay an additional pro-rata increase in the rent determined by the Lessor.
Condition and Maintenance
The within leased premises and appurtenances, including the locks, plumbing, air conditioning and heating system, and all other fixtures are accepted by the Lessee in their present condition, except for such repairs and improvements as are written into this lease. The Lessee agrees to keep them in the same order as received during the term of the lease, and no repairs shall be due Lessee except such as may be specifically noted herein. Lessee is obligated not to drive nails into the walls or woodwork, and is to hang pictures only from picture molding, and Lessee is responsible for any damage to walls or woodwork. Not stick on adhesives are to be used on walls, woodwork or appliances. No painting is allowed. No spray painting is allowed in your apartment or outside the building.
Delayed Possession:
Should Lessee be unable to obtain possession of the date of the beginning of the lease because of delays of tennants, or any delay in granting possession, not causes by personal fault of the Lessor, the lease shall not be affected thereby, and Lessee shall not be entitled to any damages beyond remission of rent for such term during which he is deprived of possession.
Improvements:
Lessee is obligated not to make any additions or alterations whatever to the premises without written permission. All additions, alterations or improvements made by Lessee with or without the consent of Lessor, no matter how attached must remain the property of Lessor, unless otherwise stipulated herein, Lessee waiving all rights to compensation therefore.
Lessor or his Agent or workmen shall have the right to enter the premises for the purpose of making necessary repairs, improvements, for the preservation of the property. Repairs will be made or scheduled with third parties for repairs as soon as possible during normal business hours 9:00 am to 5:00 pm.
Lessee is not authorized to make any repairs or hire third parties without written permission from Lessor.
Lessee will not be allowed any deductions in rent for any inconvenience caused by such repairs unless authorized by Lessor. Lessee assumes responsibility for the condition of the premises and Lessor will not be responsible for damage caused by leaks in the roof, by bursting of pipes by freezing or otherwise, or by any vises or defects of the lease property.
Should Lessee fail to promptly notify Lessor, in writing of any such defect, Lessee will be responsible for any damages resulting to Lessee or other parties.
Should Lessee loose or misplace any keys, Lessee is immediately obligated to notify Lessor, and Lessee is responsible for replacement of keys and locks should Lessor deem it necessary. If Lessor is locked out of his or her apartment, Lessor will deduct $40.00 to open apartment for re-entry from lost or misplaced keys.
Signs or Decorations
No signs or decorations, of any kind shall be displayed in any windows, porches, balconies of leased premises without the written permission of the Lessor. If necessary, Lessor may remove any signs or decorations. Lessor reserves the right to keep posted on the premises signs "For Sale" , "For Rent", at any time during the term of the lease , and Lessee must allow parties authorized by Lessor or Agent to visit the premises in view of buying or renting during the term of this lease from 9:00 am to 6:00 pm. If your apartment has a balcony, no towels, etc. shall be hung on railing, post. Nothing to placed on balcony that detracts from appearance of the building. Nothing to be left on porch but what Lessor has placed on porch.
Vacating Premises
Should the premises be vacated or abandoned by Lessee because of ejectment for breach hereof, or otherwise, or should the Lessee begin to remove personal property of goods to the prejudice of the Lessor's lien, then the rent for the unexpired term, with attorney's fees, shall at once become due and eligible, and Lessor , at his option, has the right to cancel the lease, or reenter and rent the premises for such price and on such terms as may be immediately obtainable and apply the net realized to the payment of the rent. At the expiration of this lease, or its termination for other causes, Lessee is obligated to immediately surrender possession, and should Lessee fail to do so, he consents to pay any and all damages, and in addition no less than five times the daily rent per day, with Attorney's fees or Lessor's cost etc. Lessee also expressly waives any notice to vacate at the expiration or termination of this lease and all legal delays, and hereby confessed judgment with cost of placing Lessor in possession to be executed at once. Should Lessor allow or permit Lessee to remain in the leased premises after the expiration or termination of this lease, this shall not be construed as a reconstruction of this lease. Lessor hereby understands that Lessee may be judicially evicted for the premises for nonpayment of rent. Lessee hereby waives a five day notice and agrees that in the event of his default Lessor may immediately and without notice evict Lessee from the premises. . Waiver-upon termination of the right of occupancy for any reason, Lessee hereby expressly waives notice to vacate premises. Prior to institution of eviction proceedings in accordance with LA ccp article 4701 and LA article 2713.
Default:
Should the Lessee at any time violate any of the conditions of this lease, or discontinue the use of the premises for the purpose for which they are rented, or fail to pay the rent, (or other expenses assumed under this lease), punctually at maturity, as stipulated, or upon the adjudication of Lessee in bankruptcy, the appointment of a receiver for Lessee, or the filing of a bankruptcy, receivership or petition by the Lessee, or upon Lessee's suspension, failure or insolvency, and should such violation continue for a period of 3 days, the at the option of the Lessor, the rent for the whole unexpired term of this lease shall at once become due and eligible; and Lessor shall have the further option to at once demand the entire rent for the whole term, or to immediately cancel this lease, or to proceed for past due installments, all without putting Lessor in default, Lessee to remain responsible for all damages or losses suffered by Lessor, Lessee hereby assenting thereto and expressly waiving the legal notices to vacate the premises. Should an agent or attorney be employed to give special attention to the enforcement or protection of any claim of Lessor arising from this lease, Lessee shall pay as fees and compensation to such agent or attorney an additional sum of fifteen percent cost of the amount of such claim, the minimum fee, however, to be $400.00, or if the claim be not for money, then such sum will constitute a reasonable fee, together with all cost, charges and expenses. Lessee is obligated to pay $100.00 for any court appearances involving collection of rents or enforcement of lease.
Use of Premises:
Should Lessee at any time use the leased premises or any portion thereof for any illegal or unlawful purpose, or commit, or permit or tolerate the commission therein of any act made punishable by fine or imprisonment under the laws of the United States or the State of Louisiana, or any ordinance of the City or Parish, the remedies set forth in the preceding paragraph shall be available to Lessor immediately without necessity of giving any written notice or any other notice to lessee. Failure to strictly and promptly enforce these conditions shall not constitute a waiver of Lessor's rights. Lessor expressly reserving the right to always enforce prompt payment of rent or to cancel this lease, regardless of any indulgence or extensions previously granted. The receiving by Lessor, or Lessor's representative of any rent in arrears, or after notices of institutions of any suit for possession or for cancellation of this lease, will not be considered as a waiver of such notices or suit, or of any of the rights of Lessor.
Insurance:
Lessee's contents are not covered by Lessor's insurance. Lessor is not responsible for lessee's contents. Lessee may obtain renters insurance for his/her personal contents. If through no fault, neglect, or design of Lessee, the premises are destroyed by fire or other casualty, or damage to such an extent as to render them wholly or partially unfit for occupancy, then this lease shall be cancelled. If however, the premises can be repaired with 90 days from date of fire or casualty, then this lease shall not be cancelled and Lessor shall notify Lessee within 15 days from the date of fire or casualty the Lessor will repair the damage, and Lessee shall be entitled only to such a reduction of rent that shall be prorated. Determined by Lessor.
Wherever there is a confliction in this lease between the printed clauses and the specially written clauses of this lease, the specially written clause shall apply. All notices given to Lessee under the terms of the lease shall be in writing, or hand delivered or by mail or by email, addressed to Lessee at herein leased premises, and such delivery shall constitute full proof and compliance with the requirement of notice, regardless whether Lessee receives such notice or not.
The parties to this lease understand and agree that the provisions herein shall between them, have the effect of law, but in references to matters not provided herein, this lease shall be governed by the ordinances of the City of New Orleans and laws of the State of Louisiana.
Deposit
This is a security deposit to ensure all of Lessee's obligations under the lease including by not limited to the cost of repairs, damages, cleaning and unpaid rents or other charges. In the event that the Lessee has not cleaned the premises and repairs any damages to the property by the last day of the lease or when he vacates, Lessor may, at his option, employ anyone to perform these duties at Lessee's expense. At Lessor's option Lessee shall continue to pay rent until all cleaning or repairs are complete. Rent continues until all keys are returned. If keys are not returned Lessee may be responsible for cost or replacing the locks. Non-returned key $25.00 each. At last month of tenancy, Lessee's security deposit will not be used for payment of last month's rent.
If Lessor is required to clean the apartment before it is vacated ie. Clean, bathroom, kitchen and all appliances, removed dust from baseboards, picture molding, ceiling fans, broom sweep apartment. Lessee will be required to pay the following minimum charges for cleaning: Broom clean apartment $75.00 , shampoo carpets $100.00, cleaning stove and oven $150.00, removal of trash $75.00, cleaning refrigerator $150.00 , cleaning air conditioner $100.00 , cleaning bathroom , $150.00 Repairs- as appropriate.
Termination :
At the end of this lease if no notifications are made by either party, this lease will continue on a month to month basis. Monthly renewal periods only (1st to 31st), unless 30 day notice is required by either party to terminate this lease. Lessee or Lessor shall have the option of canceling this lease upon 30 day written notice to the Lessor and upon payment of a penalty equivalent to two months' rent, which payment shall accompany the notice of cancellation. It is understood that this penalty is in addition to the rents following the 30-day notice. Lessee is to be completely vacated and surrender the premises by 12:00 noon on the last day of tenancy. Apartment should be cleaned as per the Apartment Maintenance Instructions. Lessor acknowledges receipt and will comply with Lease Addenda and Apartment Maintenance instructions, attached to this lease. Lessor may from time to time add additional instructions.
In the event that a NSF check is used for payment. Lessee agrees to pay NSF fee (minimum $25.00) , plus whatever rental penalty is applicable up to the date when cash payment is received. Lessor may require all future payments to be made by certified check or money order. Rents are due and payable on the first day of each month. Any rent check postmarked after the 3rd day of the month which is due shall incur a $30.00 late fee.

Lease Addenda and apartment maintenance instructions
Move in:
Inspect your apartment, any damages to apartment, appliances etc. should be noted and given to Lessor in writing.
Refrigerator-empty for hurricane- In the event of a hurricane or evacuation. You are to put all perishable items in your refrigerator into a ice chest for storage and unplug your refrigerator before evacuating. (If you should not return for several days, the ice chest can be discarded without damage to the refrigerator). Items will keep for several days in an ice chest. Failure to do so may result in replacement of comparable refrigerator.
Your portion of the Sewerage and Water bill from the City of New Orleans is based on your usage per month times the current rate from the Sewerage and Water board of New Orleans. Your portion of the Sanitation charge is based on the standard fee charged at time of bill (standard amount per unit). The Water Bill will be emailed by Lessor to Lessee one a month for payment.
Any water leaks, or running toilets , dripping faucets should be reported immediately. You are responsible for any water usage due to leaks, dripping faucets or running toilets. There is a shut off valve under toilet or sink. Turn it off if there is a leak and report it to me immediately.
Do not remove aerator filters from faucets.
End of lease: At the expiration of your lease, your lease will continue on a month to month basis, until Lessor send new lease for upcoming year. If you should decide to end your tenancy, you must notify the lessor, in writing, 30 days prior to the next month. (i.e. If you are vacating May 1st, you should give written notice by April 1st.) Your tenancy is on a month to month basis and not prorated if you should decide to vacate before the end of the month. Your apartment should be cleaned and ready for the next tenant. If it is not cleaned and /or there are any damages, you will be charged for cleaning and any lost rents required for the cleaning and or repairs. Lessee is to be completely vacated and surrender the premises by 12:00 noon on the last day of tenancy.
Quiet enjoyment: the lessee is not to disturb other tenants in the building with loud music, noises, etc. Lessee shall be responsible for any cleanup up from parties within 24 hours.
Use furniture pads under heavy items, sofas, beds etc., to prevent damage to wood floors.
Change or clean your Air Conditioner filters monthly. If a service call is required for your air conditioner and dirty filter is the cause of the problem, you will be responsible for the charges for the service call.
Toilets and drains: Do Not put anything in the toilet except toilet paper. It will clog the toilet bowl or drains. Paper towels, Q-tips, etc., personal items. Do not pour grease down the drains. I will clog the drains over time too. Use a can to store the grease till it cools, then dispose in the trash. You are responsible for any blockage in the drains or sewer lines.
Smoke alarms should be kept in working order. Do Not remove batteries for your personal use.
Your apartment is pre-wired for cox cable. No outside cable companies may install other cable equipment. (direct tv, dish tv etc). If lessor allows any other tv equipment to be installed, lessee will be required to pay and additional deposit for the removal of that equipment.
Any problems with any appliances in the apartment will be repaired as soon as possible. If service men are required they will be called and scheduled to repair any item in your apartment, usually Monday-Friday (excluding holidays). Lessor is not responsible for any inconvenience or expense incurred by lessee. Lessor is not responsible for any loss of food in refrigerator/freezer.
Apartment is pre-wired for cable television and telephone. No outside installation is permitted of cable/phone/direct tv/etc. without written permission of lessor. If lessor permits such installation, lessee may be required to post and additional deposit for removal of equipment.
Use of candles or multiple candles may produce excessive soot over time and your
Apartment may require painting. Be sure candles are in a protective tray so that the wax does not drip on floors, carpet etc.
Gas and Electricity are to remain turn on at all times ( for the duration of your lease). If
Utilities ie Gas and /or electric is turned off. Lessor will have them turned on and lessee will pay $100.00 penalty. Lessee will be responsible for any inspections and fees from electrical, plumber, City of New Orleans for reconnect fees. (usually $350-$450)
Have ample help moving in/out of your apartment with large items, sofas, beds, dressers
To prevent damage to stairs area, walls and floors.
All personal items should be stored in your apartment, not halls, yards, laundry room etc.
All light bulbs should be in working order. Most light fixture use 60-Watt light bulbs. Do Not put bulbs in fixture rated more than 60 Watts. It will damage the fixture and possibly overheat the wiring and cause fire.
Do not use stick on adhesives etc on wall, woodwork, appliances (especially refrigerators). They will cause extensive damage. Use magnetic holders on refrigerator if you chose to do so.
Do not put holes in walls, woodwork. Use the picture molding to hang pictures.
Damages to walls, floors etc.: Use picture hangers and picture molding in your apartment to hang pictures. Lessee will be responsible for any damages to walls etc. from nails, adhesives, etc. Do not use adhesive stick on hooks etc. on any surfaces in your apartment. Any holes, torn plaster or sheetrock will be repaired at the expense of the lessee, and lessee will be responsible for any loss of rents if repairs and painting are required.
Appliances in good condition-Lessee is responsible for broken handles, dents, or adhesives on refrigerator doors. Use magnets if you like.

Deposit Refund:
Apartment should be in same condition was when you moved in. Kitchen appliances, stove, refrigerator, cabinets should be cleaned. Bath room sink, tub, toilet etc. should be cleaned. Ceiling fans/ mini blinds, baseboards, molding should be cleaned on a regular basis. Remove all dust from baseboards, fans, etc. Stove, Refrigerator shall be cleaned. Lessee will be charged for any damages and loss of rents if damages take large amounts of time to repair. Lessee will be required to give Lessor forwarding address and keys at the end of the lease. Deposit will be mailed to forwarding address.
At the end of your lease, lessee should remove all items from the apartment and have them bagged in contractor bags, purchased at hardware or home depot etc. Put all items on the street. Have all large furniture, sofas, etc hauled away. Do not leave in front of the building on the street. They will not be picked up. At the end of your lease, your last month's rent is due on the first of the month. You may not use your security deposit for your last month's rent. Your deposit will be mailed to you at the forwarding address you leave me when you vacate your apartment.
No Smoking in your apartment, this applies to visitors as well.
Balcony: Do not hang clothes, towels on balcony railing. Do not nail rugs, carpet to balcony floor. Do not place anything on balcony that can fall or injure people below. Do not put anything that detracts from building appearance.
Trash is picked up on Tuesdays and Friday mornings. Put your trash out the day before in the trash can area. Do not put it out Tuesday or Friday morning. Trash collections is early in the morning, they will have passed already.
You have a gas water heater located on the side of the building. If pilot light goes out you should follow the instructions on the heater to relight the pilot.
