These terms provide an overview of a separate lease agreement between the property owner and the tenant. They outline the responsibilities and expectations of both parties, ensuring clarity and legal compliance throughout the duration of the rental. The tenant will sign a separate, formal agreement that will include these terms and any additional specifics related to the rental arrangement. 1. Lease Duration The Owner is open to offering either a Fixed-Term or Month-to-Month Lease. The terms for each are as follows: Fixed-Term Lease: The lease shall be for a fixed period, typically 12 months, but may be for any duration as agreed (e.g., 6 months, 18 months). Month-to-Month Lease: This lease will automatically renew each month unless either party provides written notice to terminate. Written notice must be given by the Tenant at least 30 days in advance, and by the Owner at least 60 days in advance if the Tenant has been in the unit for over one year. 2. Rent Payment Amount: The monthly rent is due on the 1st of each month. Late Fees: A late fee of 10% of the monthly rent amount will be applied if rent is not paid within 3 days after the due date, in accordance with California law. Security Deposit: Tenant shall pay a security deposit equal to two months' rent, due upon signing this Agreement. This deposit may be used to cover damages or unpaid rent as permitted by California law. The Owner agrees to return the security deposit within 21 days of the Tenant's move-out, minus any lawful deductions. 3. Utilities Owner's Responsibilities: The Owner will cover the cost of trash service and internet for the duration of the lease. Tenant's Responsibilities: Tenant will be responsible for all other utilities, including but not limited to water, electricity, and gas. 4. Occupancy Limits The Tenant agrees not to exceed the maximum occupancy limits for the Premises, as follows: four occupants. Any change in occupancy must be approved by the Owner in writing. 5. Pets Pets are [not allowed/allowed with an additional deposit or monthly charge]. If pets are allowed, a non-refundable pet deposit of $[Amount] or an additional monthly charge of $[Amount] may apply. All pets must comply with California pet regulations and local ordinances. 6. Maintenance and Repairs Tenant's Responsibilities: Tenant agrees to maintain the Premises in good condition and to promptly report any needed repairs. Tenant is responsible for damages caused by their own negligence or misuse. Owner's Responsibilities: The Owner agrees to ensure the Premises are habitable and to handle necessary repairs within a reasonable time frame in accordance with California law. 7. Notice of Termination Fixed-Term Lease: This lease will terminate on the end date specified in this Agreement. If either party wishes to terminate the lease early, they must negotiate and agree to an early termination arrangement in writing. Month-to-Month Lease: Either party may terminate this Agreement by giving written notice. The Tenant must provide 30 days' notice, and the Owner must provide 60 days' notice if the Tenant has been in the unit for more than one year. 8. Subletting and Assignment The Tenant agrees not to sublet the Premises or assign this lease to any other person or entity without the prior written consent of the Owner. Subletting or assignment without consent will be considered a breach of this Agreement. 9. Dispute Resolution In the event of a dispute between the parties related to this Agreement, the parties agree to attempt to resolve the dispute through mediation. If mediation is unsuccessful, the parties agree to resolve the dispute through binding arbitration under the laws of the State of California. The prevailing party in any dispute shall be entitled to recover their reasonable attorney's fees and costs. 10. Miscellaneous Terms Governing Law: This Agreement shall be governed by the laws of the State of California. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions and agreements, written or oral. Any amendments to this Agreement must be in writing and signed by both parties.
