Price listed covers ALL monthly utilities+ HOA fees! 1. TERMS: RESIDENT agrees to pay in full the amount of $1,800 per month on the 1st day of each month. This agreement shall commence on August 1st, 2022 and continue through July 31st, 2023, unless otherwise determined via written agreement between OWNER and RESIDENT. 2. PAYMENTS: Rent and/or other charges are to be paid at such place or method designated by OWNER as follows: Cash or check delivered to OWNER's residential address or directly by hand to OWNER, or electronic transfer of funds through the smart phone application "Venmo". OWNER acknowledges receipt of a security deposit of $1,800 upon signing of this lease. The First Month's rent payment of $1,800 is also due upon signing of this lease. All payments are to be made payable to OWNER. 3. SECURITY DEPOSITS: The total of the above deposits shall secure compliance with the terms and conditions of this agreement and shall be refunded to RESIDENT within thirty (30) days after the premises have been completely vacated less any amount necessary to pay OWNER a) any unpaid rent, b) cleaning costs, c) key replacement costs, d) costs for repair of damages to premises and/or common areas above ordinary wear and tear, and e) any other amount legally allowable under the terms of this agreement. A written accounting of said charges shall be presented to RESIDENT within 30 days of the premises being completely vacated by RESIDENT. 4. LATE CHARGE: An initial late fee of $50 shall be added to any payment of rent made after the 5th day(s) after the due date. RESIDENT shall incur and be charged additional late fees of $50 per 5 days thereafter. Late fees may be waived if OWNER agrees in writing. 5. UTILITIES: OWNER agrees to pay bills for all utilities, including trash, electric, gas, water, and other HOA fees. *Internet service can be included for an additional $60 per month. 6. PETS: A maximum of 2 pets are allowable at the premises and only upon the written consent of the owner. Consent by OWNER shall be for a specific dog(s) or cat(s) as identified in this agreement and is not transferrable to other dogs or cats. Dogs that bark, are aggressive, hostile or threatening to the owner, or neighbors or other animals are not permissible. Dogs or cats that damage the premises or furnishings are not permissible. A dog or cat that is initially approved by OWNER and identified on this Agreement, but that is, or becomes a nuisance to the neighbors or a danger to people or other animals is not permissible and shall be a breach of this Agreement. RESIDENT agrees to follow all HOA guidelines related to pets within the Powderhorn complex and shared community areas. 7. PARKING: RESIDENT may park in any open spot in the parking lot just outside the building, on the street immediately in front of the premises, anywhere on the opposite side of the street, or anywhere within the Powderhorn complex parking areas. No designated parking spot is provided and no documentation shall be required for parking on the premises. Parking on the premises is restricted to vehicles only and all vehicles must be parked within the parking boundary lines. Please review and follow all parking rules and guidelines outlined in section 4.5 of the Powderhorn HOA declarations. 8. SMOKING: Vaping of legal substances or smoking of cigarettes or tobacco products inside or outside of the unit and in the Powderhorn complex, including on Limited Common Elements such as balconies, porches and stairs, is prohibited within twenty (20) feet of any door or operable window located in a residential building. Smoking of marijuana outside the unit is prohibited. Smoking of marijuana inside the unit is permitted. RESIDENT, guests of resident and any persons visiting the residence are required to follow these guidelines. 9. TERMINATION: This agreement shall be automatically terminated on July 31st, 2023, unless otherwise determined via written agreement between OWNER and RESIDENT. The premises shall be considered vacated only after all areas including storage areas are clear of all RESIDENT'S belongings, and keys and other property furnished for RESIDENT'S use are returned to OWNER. Should the RESIDENT hold over beyond the termination date or fail to vacate all possessions on or before the termination date, RESIDENT shall be liable for additional rent and damages, which may include damages due to OWNER'S loss of prospective new tenants. Renewal of this rental agreement or an alternative rental agreement is possible following the termination date, if agreed upon and documented via writing by both OWNER and RESIDENT. 10. INSURANCE: RESIDENT acknowledges that OWNER's insurance does not cover personal property damage caused by theft, fire, rain, wind, temperature, other acts of nature or God, acts of others, and/or any other causes, nor shall OWNER be held liable for such losses. RESIDENT is hereby advised to obtain an insurance policy to cover any personal losses. 11. RIGHT OF ENTRY AND INSPECTION: OWNER may enter, inspect and/or repair the premises at any time in case of emergency or suspected abandonment. OWNER shall give 24 hours' advance notice and may enter for the purpose of showing the premises during normal business hours to prospective renters, buyers, lenders, for smoke alarm inspections, and/or for normal inspections and repairs. OWNER is permitted to make all alterations, repairs and maintenance that in OWNER'S judgement is necessary to perform. 12. ASSIGNMENT: RESIDENT agrees not to transfer, assign or sublet the condominium unit or any part thereof without the explicit permission of OWNER. This includes, but is not limited to renting, subletting or selling accommodations through AirBnB and VRBO. 13. RECEIPT OF POWDERHORN DECLARATIONS: RESIDENT acknowledges receipt and extensive review of the full documentation of the "AMENDED AND RESTATED CONDOMINIUM DECLARATION OF THE POWDERHORN CONDOMINIUM ASSOCIATION" and agrees to abide by all HOA rules and regulations.
