PROPERTY. Landlord leases to Tenant, in reliance on the Tenant's application therefore, and Tenant rents from Landlord for the term of this Lease Agreement, the living unit located at 1713 W. 34th Terrace, Kansas City, Missouri 64111 under the terms and conditions set forth herein. 2. TERM. The initial term of this Lease Agreement shall be 12 months, beginning _____ and ending on ____ 3. RENT. Rent is payable monthly in advance at a rate of $1,500.00 per month, due and payable on the 1st day of each month to the Landlord. . Tenant agrees to use the premises as a private residence for the occupant(s) and no other person(s) without the consent of the Landlord. EXPIRATION AND RENEWAL. Not later than the periodic rent-paying date 2 months prior to the expiration of this Agreement, Tenant shall notify Landlord of Tenant's intention to vacate the premises at the expiration of this Lease or Tenant's desire to lease the premises for an additional term. In the event an additional term is requested, a new Lease Agreement shall be agreed on and executed prior to 60 days before expiration of the term of this Agreement. In the absence of such new Agreement, Tenant agrees to deliver possession of the premises to Landlord on the expiration date of this Agreement without further notice from Landlord and, should Tenant fail to comply, Tenant shall be liable for damages as provided by law. If a new written Agreement has not been executed by the parties prior to expiration of this Agreement, the payment and acceptance of rent shall constitute a month-to-month tenancy and all applicable provisions of this Agreement shall apply to such tenancy. A month-to-month tenancy may be terminated by either party, without showing cause, by written notice given to the other party stating that the tenancy shall terminate at the end of the day preceding a periodic rent-paying date not less than 60 days after said notice is given. 11. TERMINATION. Upon termination of this Lease, Tenant shall vacate the premises, remove all personal property belonging to Tenant, and deliver the premises, any furnishing and appliances provided, to Landlord in as good condition, order and cleanliness as when received, except for normal wear and tear. Tenant shall deliver all keys for the premises to Landlord immediately upon vacating the premises. 12. ALTERATIONS AND IMPROVEMENTS. Tenant shall make no alterations or improvements to the premises without obtaining written consent of Landlord in advance including, without limitation, painting, wallpapering, permanent shelving and flooring, any structural changes, and the changing of locks. Tenant agrees to restore the premises to its prior condition upon vacating premises. 13. NOISE. Tenant agrees not to allow on the premises any excessive noise or any objectionable behavior which disturbs the peace and quiet of other occupants or neighbors. 14. INJURIES OR DAMAGE. Landlord shall not be liable to Tenant for any loss or damage to the Tenant's effects except where such is due to Landlord's negligence. It is agreed that it is the Tenant's responsibility to insure Tenant's property and safeguard against personal loss. 15. ABANDONMENT. Tenant's absence from the premises for 10 consecutive days while all or any portion of the rent is unpaid, shall be deemed abandonment of said premises, and this Lease may be immediately terminated by the Landlord at Landlord's sole option without further notice. In such case, Tenant's personal property may be inventoried, stored or disposed of, at the sole expense of the Tenant, and the premises may be re-rented by Landlord without any liability of Landlord to the Tenant whatsoever. 16. CLEANLINESS AND REASONABLE USE BY TENANT. Tenant agrees to keep the premises, including the living areas and yard, and any garage and basement, clean, sanitary and safe. Tenant agrees to replace all broken or cracked glass and all defective screens, to keep the premises from infestation by insects and pests other than termites, and to notify Landlord if evidence of termites is found. Tenant further agrees to keep in a clean and sanitary condition all equipment and fixtures in the premises including the furnace, water heater, all plumbing fixtures ceiling lights/fans, and any furnishings and appliances provided, to keep any garbage disposal free of obstruction and clogging from grease and to keep all drain lines within the premises free-running. Tenant further agrees not to attach decals to any surface other than glass and not to use tape to attach posters or other objects to any papered or painted surface. 17. SMOKING NOT PERMITTED. Tenant agrees not to smoke in the living unit and not to permit guests or other persons to smoke in the living unit at any time. Tenant shall be responsible for the cost of repainting the living unit and of replacing the carpet and pad therein upon termination of this Lease if, in the sole opinion of Landlord, the living unit contains therein the smell of smoke which has been caused by smoking in the unit during this tenancy. Tenant agrees that the living unit smells fresh and clean and does not smell of smoke therein at the beginning of this tenancy. 18. TRASH RECEPTACLES AND REMOVAL. Tenant shall provide and maintain appropriate receptacles for the storage and removal of all rubbish, garbage and other trash and waste and to remove said waste from the premises in a clean and safe manner. Trash bags must be kept in covered trash receptacles. 19. TRANSFERABILITY. This Lease is not transferable without prior written consent of Landlord, nor shall Tenant sublet all or any part of the premises without such prior written consent of Landlord. 20. RIGHT OF ENTRY. Landlord shall have the right to enter the premises: (a) in case of an emergency; (b) to make necessary agreed upon repairs, decorations or improvements, supply necessary or agreed upon services, exhibit the premises to prospective or actual buyers, mortgagees, appraisers, workmen, or contractors; (c) when Tenant has abandoned or surrendered the premises. During the final 60 days of the tenancy, Landlord shall have the right to show the premises to prospective tenants if Tenant has not executed a new Lease Agreement for an additional term. Except under (a) and (c), entry may be made only during normal business hours and with at least 24 hours prior notice to Tenant. 21. SIGNS. Landlord has the right to place a sign on the premises offering the premises for sale at any time. During the 60-day period prior to the expiration of any termination date of this Agreement, Landlord shall have the right to place a sign on the premises offering the premises for rent. 22. In the event of breach or default of any covenant, term or condition of this Lease which results in Landlord hiring legal counsel to enforce any covenant, term or condition, the Tenant shall and agrees to pay all legal fees and associated expenses incurred by Landlord, whether in litigation or otherwise. 23. DRAINS. Landlord will maintain drains and water lines. Tenant will be responsible for the cost of drain cleaning and clearing due to any blockage created by grease, tampons or foreign objects. 24. FURNACE FILTERS. Landlord will change furnace filter every 3-6 months or as needed. This will help minimize utility bills and keep air clean. 25. SMOKE DETECTOR(S). Tenant agrees to check the smoke detector(s) battery monthly. 26. INDEMNIFICATION: Landlord shall not be liable for any damage or injury to Tenant, or any other person, or to any property, occurring on the premises or any part thereof unless such damage is the proximate result of the negligence or unlawful act of Landlord, his/her agents or employees. Tenant agrees to hold Landlord harmless from any claims of damages, no matter how caused, except for injury or damages caused by willful act of negligence of Landlord, his/her agents or employees. It is agreed that the Landlord is not liable for personal injuries or property damages suffered by the Tenant or any family member, occupant, guest or invitee of the Tenant alleged to arise from contact, inhalation, ingestion, or other physical exposure to asbestos, lead, mold, mildew, fungus, mycotoxins, spores, scents, or byproducts produced or released by fungi or any other alleged toxic substance, carcinogen or pollutant.
