Rent Tenants agrees to pay Landlord for the use and occupancy of the Premises in the amount of $4,200.00 per month which monthly rent is due and payable in advance on or before the fifth day of each month. Deposit $4,200.00 deposit with signing of this lease will be held until tenants move out of the house. Deposit will be given back to the tenants when they move out if the house is to be found in the condition it was left in besides normal wear and tear. Utilities Landlord agrees to pay all charges for the sewer, water, and trash pickup. Tenants agree to pay for the following utility charges: electricity, gas, and cable. Occupancy of Premises No person's other than those signing this lease are to occupy the Premises. Any violation of this provision shall constitute a material default under this lease. Tenants shall not sublet or assign this lease without permission of the Landlord. Pets Absolutely NO pets shall be permitted on the Premises without prior approval of the Landlord, which approval may be withheld at the Landlord's absolute discretion. *Please see Pet Agreement Addendum* Use of Leased Premises Tenant agrees that the Premises are to be used exclusively as living quarters of Tenant and shall not be used for any other purpose. Tenant shall not do or permit anything to be done on the leased premises that will in anyway interfere with the rights of the other tenants, occupants, or neighbors, or to injure or annoy such persons. Tenant shall not use, nor allow the Premises to be used, for any improper, unlawful, or objectionable purpose. Additionally, Tenant shall not cause, maintain, or permit any nuisance in, on, or about the Premises, or commit any waste in or on the Premises. Furthermore, Tenant shall not put the Premises to any use that violates any local zoning ordinance or any other law applicable to the Premises. Rules and Regulations Tenant and any guest of the Tenant shall obey all the laws of the State of Massachusetts, as well as all local laws, at all times while they are on the Premises. Condition of the Premises Both the Landlord and Tenant has rights and responsibilities with respect to the condition of the Premises. These rights include the following: The Landlord will, at the Landlord's expense, put and maintain the Premises in a safe, habitable and sanitary condition and shall comply with all laws, ordinances, and regulations pertaining to the condition of the Premises. Tenant shall remedy, at the Tenant's expense, any damage or deterioration to the Premises caused by the Tenant's acts, whether intentional or through lack of ordinary care. The Landlord will provide rubbish containers (2) for the Tenant to ensure that the Premises are kept in clean and sanitary condition. The Tenant is responsible for bringing the trash out weekly for city trash pick-up (and bringing barrels back into the fenced area) and keeping the trash area in a clean and orderly fashion. Basement Basement is to be kept in orderly fashion and clean. Tenant is responsible for upkeep of basement (as is the rest of the home). Washer and Dryer are provided to the tenant free of charge. Landlord will make updates/fix any issues with washer/dryer at the Landlord's discretion. *Tenants have been notified that the basement does get water from time to time (old home, home located on a slope). They have been advised to not keep anything on the floor of the basement but instead use the built-in shelves provided to avoid any water damage. Snow Removal Tenant is responsible for sidewalk snow removal in front of the home as well as front steps of Premises snow removal. The Tenant is also responsible for any snow removal in the yard of Premises if they wish (deck / side of the home walkway snow removal). Landlord provides Tenant with 1 shovel and a full bag of Ice Melt Rocks. Yard/Side Yard/Deck Tenant is responsible to keep the backyard, side yard, and deck in the condition it was left in (clean, well maintained and free of any debris). Landlord has provided a lawn mower for Tenant to maintain the yard. Landlord provides a yearly landscaping service each Spring and then the tenant is responsible to maintain the yard. Lead Paint Property has become compliant with Massachusetts Lead Laws as of December 2017. Lead compliance certificate following lease agreement. Tenants are responsible for notifying landlord of any peeling, chipping or flaking of paint in the home.
