Tenant Responsibilities and Occupancy Terms
1. Utilities:
Tenant shall be solely responsible for the payment of all utilities and services supplied to the Premises, including but not limited to: electricity, gas, water, sewer, trash removal, internet, and cable TV. All utility accounts must be placed in the Tenant's name and maintained in good standing throughout the lease term.
2. Lawn and Yard Maintenance:
Tenant agrees to maintain the front and back yard, including regular mowing, watering, weeding, leaf/debris removal, and basic trimming of bushes. Tenant shall not remove or alter existing landscaping without written consent from the Landlord.
3. Maintenance Responsibilities:
Tenant shall:
Maintain the Premises in a clean, safe, and habitable condition.
Replace HVAC filters as recommended (every 1 3 months).
Replace light bulbs, batteries for smoke/carbon monoxide detectors.
Immediately report leaks, damage, or major maintenance issues to the Landlord in writing.
Be responsible for pest control if pests are due to lack of cleanliness or Tenant's negligence.
4. Damage Due to Negligence or Abuse:
Tenant shall bear the cost of repairs or replacements required due to misuse, abuse, or failure to report damage promptly. This includes, but is not limited to, broken fixtures, clogged plumbing due to improper use, or damage to floors, walls, or appliances.
5. Occupancy and Unauthorized Persons :
Only the Tenant(s) listed on the lease may occupy the Premises. Any individual residing in the Premises for more than 14 consecutive days or 30 total days in a 12-month period must be added to the lease with Landlord's written approval.
Guests staying longer than 14 days must be approved in writing by the Landlord.
Any unauthorized occupant may be deemed a trespasser and will not have tenant rights under Virginia law. Tenant shall be responsible for any legal and eviction-related costs arising from allowing an unauthorized person to remain on the Premises.
Tenant agrees not to sublease, assign, or rent any part of the Premises (including short-term rentals like Airbnb or similar platforms) without the Landlord's express written consent.
6. No Tenancy Without Written Agreement:
This lease agreement supersedes any oral agreements. At the end of the lease term, if a renewal is not executed in writing, the Tenant must vacate the Premises on or before the lease end date. Holding over without written consent may result in legal action and immediate eviction. No tenancy is created through continued occupancy alone.
7. Access for Inspections and Repairs:
Landlord shall have the right to enter the Premises with reasonable notice (24 hours) to perform inspections, maintenance, or repairs, or to show the property to prospective tenants or buyers. In the case of emergency, no prior notice is required.
