1. Lease Duration
Minimum lease term: 12 months
2. Monthly Rent and Payment Terms
Rent is due on the 1st calendar day of each month, payable via [Zelle / Venmo / online transfer / check no cash accepted].
Late Fee: A late charge of $150 will be assessed for any rent not received by 11:59 PM on the 3rd calendar day of the month
Tenant agrees that late payments will not be excused for any reason, including but not limited to: job loss, delayed paychecks, banking issues, or personal matters.
Habitual Late Payment (more than 2 times in a 12-month period) will be considered a violation of the lease and grounds for non-renewal or termination
3. Security Deposit
A refundable security deposit equal to one month rent is required at lease signing
The deposit will be returned in accordance with California Civil Code 1950.5, less any deductions for repairs beyond normal wear and tear or unpaid obligations
4.Early Termination by Tenant
Tenant may terminate the lease early by providing 60 days' written notice and paying a lease-break fee of $5,000. Tenant's rent obligation ends when a qualified replacement tenant begins occupancy or the lease ends, whichever is sooner.
5. Utilities and Services
Tenant shall be responsible for payment of all utilities, including but not limited to:
Electricity, Gas, Water, Trash collection, Internet, cable, and any optional services
6. Maintenance and Tenant Responsibilities
Tenant shall maintain the premises in a clean, orderly, and sanitary condition
Tenant is responsible for basic upkeep, including:
Changing air filters and light bulbs
Cleaning drains and appliances
Basic backyard upkeeping.
Tenant shall promptly report any maintenance issues to the landlord to prevent further damage
Damage caused by misuse, negligence, or failure to notify will be the tenant's financial responsibility
7. Pest Control
Tenants are responsible for pest prevention and any infestations that result from tenant behavior, such as unclean conditions or improper food/trash storage
If any pest issue arises due to tenant behavior, tenant agrees to cover full pest control costs.
8.Pets
No pets are permitted on the premises without prior written consent from the landlord
Service animals and emotional support animals are permitted as required by applicable laws
If an exception is made, a monthly pet rent and a one-time pet fee may apply
9. Smoking Policy
Smoking and vaping of any substance are strictly prohibited inside the property, in the garage, and within all common or outdoor areas
10. Move-Out and Notice Requirements
Tenant must provide a minimum of 30 days' written notice prior to vacating the premises
Failure to provide timely notice may result in continued rent liability or deposit deductions
11. Occupancy and Subleasing
Occupancy is limited to individuals named on the lease agreement
Subletting or short-term rentals are strictly prohibited without written authorization from the landlord
12. Modifications and Alterations
Tenants may not paint, drill, install fixtures, or make any alterations to the property without prior written consent from the landlord
13. Renters Insurance
Tenant is required to maintain renters insurance to cover personal property loss and liability,
The Landlord is not responsible for loss, damage, or theft of Tenant's personal property, regardless of the cause, including but not limited to fire, flood, water leaks, burglary, or acts of nature.
Tenant is strongly encouraged to obtain renters insurance to protect personal belongings and to cover liability for unintentional damage caused to the property or to third parties.
If Tenant does not maintain renters insurance, they assume full responsibility for any loss or damage to personal property.
14. Compliance with HOA and Local Regulations
Tenant agrees to comply with all applicable HOA rules, local ordinances, and lease provisions throughout the duration of tenancy
