LEASED PROPERTY
1. The Landlord agrees to rent to the Tenant a private, fully furnished*, upstairs apartment at 37 Mountain View Avenue (the "Property"), for use as residential premises only.
*An inventory will be reviewed at the time of inspection.
2. Subject to the provisions of this Lease, apart from the Tenant, no other persons will live in the Property without the prior written permission of the Landlord.
3. The Tenant shall keep no animals in or about the Property without the revocable written permission of the Landlord and a written agreement between the Parties.
4. Subject to the provisions of this Lease, the Tenant is entitled to the use of parking on or about the Property for one standard-size vehicle.
5. The Tenant and members of Tenant's household will not smoke anywhere inside the apartment nor permit any guests or visitors to smoke inside the apartment.
TERM of LEASE
The term of the Lease commences at 12:00pm (noon) on February 1, 2025, and ends at 12:00pm (noon) on March 31, 2025 (potentially longer), or at an earlier date determined by the Tenant and Landlord.
RENT
1. Subject to the provisions of this Lease, the rent for the Property is $2,000 per month (the "Rent"), prorated.
2. The Tenant will pay the Rent on or before the 1st of each month of the term of this Lease to the Landlord. Payments can be collected by the Landlord's property manager.
3. The Tenant will be charged an additional amount of 5% of the Rent for each day that is received after the due date, but will not apply until the expiration of the 5-day grace period under the applicable legislation of the State of North Carolina (the "Act").
4. If any payment offered by the Tenant to Landlord for rent or any other amount due under this Agreement is returned for lack of sufficient funds, a "stop payment," or any other reason, Tenant will pay Landlord a penalty of $200 to cover charges.
UTILITIES AND OTHER CHARGES
1. The Landlord is responsible for the payment of the following utilities and other charges in relation to the Property: heating and cooling; wifi internet; electricity; garbage and recycling collection; and water/sewer.
2. The Tenant is responsible for the payment of the following utilities and other charges in relation to the Property: none.
MAINTENANCE AND CARE
1. The Tenant will, at their sole expense, keep and maintain the Property and appurtenances in good and sanitary condition and repair during the term of this Lease and any renewal of this Lease.
2. The Tenant will return the Property to the Landlord in a condition identical to or better than that which existed when Tenant took occupancy, except for ordinary wear and tear.
3. The Tenant will immediately notify the Landlord or Landlord's property manager of any defects or dangerous conditions in and about the Property of which Tenant becomes aware.
4. The Tenant will reimburse Landlord, on demand by the Landlord or Landlord's property manager, for the cost of any repairs to the premises damaged by Tenant or Tenant's guests through misuse or neglect.
5. The Tenant will take necessary measures to prevent damage via water/humidity or fire in the Property with the exception of fires in the woodstove, as long as the stove is properly maintained throughout and between each use.
6. The Tenant is not responsible for lawncare, leaf blowing, or snow/ice removal.
7. The Tenant and the Landlord's property manager shall both retain access to and rotate responsibility for taking the garbage and recycling down to the foot of the driveway every Monday morning by 8 AM. (Recycling is every 2 weeks.) Both are taken out to the garage when they fill up in the apartment.
8. The Parties will comply with standards of health, sanitation, fire, housing and safety as required by law.
9. Major maintenance and repair of the Property involving anticipated or actual costs in excess of $150.00 per incident not due to the Tenant's misuse, waste, or neglect or that of the Tenant's employee, family, agent, or visitor, will be the responsibility of the Landlord or the Landlord's property manager.
A full lease agreement (including but not limited to more details about the security deposit, tenant improvements or extended absences, restrictions on subletting, and other legalities and general provisions) will be provided and executed once the connection between Landlord and Tenant has been solidified.
