PREMISES Landlord leases to Tenant the single-family residence at 320 North Orange Street, Wallace, NC 28466, including driveway, front yard, and rear yard. A storage shed exists in the rear yard; Tenant is not permitted access without Landlord's written consent. 2. TERM The lease term is twelve (12) months, commencing December 1, 2025, and terminating November 30, 2026. No automatic renewal. Renewal requires a written agreement. 3. RENT Tenant shall pay one thousand one hundred seventy-five dollars ($1,175.00) monthly, due on or before the first day of each month, by check, cash, or electronic transfer to Landlord at 314 North Orange Street, Wallace, NC 28466. Returned checks incur a $25.00 fee, per N.C. Gen. Stat. 25-3-506. 4. LATE FEE If rent remains unpaid by the sixth calendar day of the month, Tenant shall pay a late fee of the greater of five percent of the monthly rent ($58.75) or fifteen dollars ($15.00), limited to one charge per late month, per N.C. Gen. Stat. 42-46. 5. SECURITY DEPOSIT Tenant shall pay one thousand one hundred seventy-five dollars ($1,175.00) upon execution, held in escrow at North Carolina State Employees Credit Union. Landlord shall return the deposit, plus any accrued interest, within thirty days of lease termination, less deductions for damage beyond normal wear, unpaid rent, or cleaning costs, with an itemized statement, per N.C. Gen. Stat. 42-50 et seq. 6. UTILITIES Tenant is responsible for all utilities and services, including water, sewer, electricity, gas, trash collection, and internet. 7. OCCUPANCY AND USE The premises shall be used solely as a private residence by the named Tenant(s). No additional occupants, subletting, or assignment are permitted without Landlord's written consent. No unlawful or nuisance activities allowed. 8. MAINTENANCE AND REPAIRS Tenant shall maintain the premises in a clean, sanitary condition, keeping the yard free of trash, litter, and debris. Tenant shall keep sinks, drains, toilets, and sewer lines clear of inappropriate items (e.g., toys, wipes, feminine products). Tenant is liable for plumbing repair costs due to neglect, reported within five days of move-in, or drains are deemed functional. Tenant shall notify Landlord in writing within twenty-four (24) hours of discovering any leaks (roof, plumbing, windows, etc.). Landlord shall maintain structural components (roof, foundation, exterior walls) and major systems (plumbing, heating, electrical). Landlord provides lawn mowing service on the first and third Tuesday of each month; Tenant shall ensure yard access is unobstructed. 9. PARKING Vehicles may be parked only in the driveway or on the street. No parking on grass. Landlord is not liable for towed vehicles. 10. TRASH MANAGEMENT Trash collection occurs Tuesday mornings. Tenant shall: Place cans at the curb no earlier than Monday. Return cans to the rear yard by 11:59 p.m. Tuesday, regardless of pickup time. Cans left at the curb beyond Tuesday evening constitute a lease violation. 11. MOVE-IN INSPECTION Within five (5) business days of move-in, Tenant shall submit a written list of defects or needed repairs to Landlord. Unreported defects are deemed accepted as-is. 12. MOVE-OUT INSPECTION AND CLEANING Upon vacating, Tenant shall clean the premises, remove all personal property, and prepare for Landlord's final inspection. Tenant remains responsible for rent until keys are returned to Landlord. 13. PETS AND ANIMALS No pets or animals of any kind are permitted on the premises, indoors or outdoors, without Landlord's prior written consent. Violation constitutes a breach of this Agreement. 14. MILITARY CLAUSE For military tenants: If Tenant receives Permanent Change of Station (PCS), Early Termination of Service (ETS), or deployment orders, Tenant may terminate early with thirty (30) days' written notice and a copy of orders. Unused rent, less the thirty-day notice period, will be refunded, provided all other lease conditions are met. 15. LANDLORD'S RIGHT OF ACCESS Landlord, or authorized agents, may enter the premises during reasonable hours to inspect, repair, or show to prospective tenants or buyers, with reasonable notice to Tenant, except in emergencies. Landlord may display "For Rent" or "For Sale" signs. 16. TERMINATION The lease terminates automatically on November 30, 2026. Early termination requires thirty (30) days' written notice by either party, permissible only for lease breaches (e.g., nonpayment) or as allowed by N.C. Gen. Stat. 42-38 et seq. If Tenant abandons the premises, fails to pay rent, allows utilities to be disconnected, or violates any lease term, Landlord may re-enter, re-rent, and place a "For Rent" sign without further notice. 17. GOVERNING LAW This Agreement is governed by North Carolina landlord-tenant law, including N.C. Gen. Stat. 42-38 et seq. Disputes shall be resolved in Duplin County courts. 18. ENTIRE AGREEMENT This document constitutes the entire agreement. No oral modifications are valid. Amendments must be in writing and signed by both parties. 19. COOKING GRILLS No cooking grills, including but not limited to gas, charcoal, or electric grills, are permitted on the front porch or in the front yard of the premises. Grills may be used and stored in the rear yard only, provided they are operated safely and in compliance with local fire codes. Violation of this provision constitutes a breach of this Agreement. 20. DISPOSAL OF COOKING OILS Tenant shall not pour cooking oils, grease, or similar substances down any drain, including but not limited to kitchen sinks, bathroom sinks, or toilets. Tenant is responsible for properly disposing of cooking oils in sealed containers via trash collection or other lawful means in accordance with local regulations. Tenant shall be liable for any plumbing repair costs resulting from improper disposal of cooking oils. Violation of this provision constitutes a breach of this Agreement. 21. RECREATIONAL VEHICLE PARKING No boats, trailers, ATVs, including but not limited to motorboats, dirt bikes, four-wheelers, sailboats, or personal watercraft, may be parked or stored on the lawn, including the front yard, rear yard, or any grassy areas of the premises. Boats may be parked in the driveway or on the street, subject to local ordinances and the restrictions in Section 9 (PARKING). Violation of this provision constitutes a breach of this Agreement. 22. ENTIRE AGREEMENT This document constitutes the entire agreement. No oral modifications are valid. Amendments must be in writing and signed by both parties.
