Basic Terms - The Lease will automatically transition to a Month to Month lease after the initial 12 months. The terms of the lease may be renegotiated after 12 months by the landlord (i.e. Rent Price, Occupancy, Security Deposit, etc). Early termination of the lease (prior to the end of the initial 12 months) will result in a one time fee of two month's rent. After the initial 12 month lease period, the tenant shall notify the landlord in writing/email at least 60 days prior to their desired lease termination date. Rent Payment Date - Rent is due on the 1st day of each month, a 5 day grace period to pay will extend until the 5th day of each month. On the 6th day a 10% late fee will be assessed unless prior arrangement is made with the landlord. Security Deposit - The security deposit will be held by the landlord and utilized to cover the costs associated with violations of the terms of the lease, cleaning, and repair of the property. The Security Deposit will be returned in whole or in part upon the termination of the lease pending the landlord's inspection and assessment of any costs. The security deposit shall not be considered the last month's rent. Occupancy - The tenant shall disclose all occupants living on the property, to include the original occupants, and any additional occupants during the lease duration, excluding minor children of the tenant. Short term visitation is allowed and is defined as someone staying on the property for less than two weeks (14 days) total per year. The tenant may not sublet any or all of the property without approval of the landlord prior to occupancy of the sublet tenant. Violation of the Occupancy Terms may result in termination of the lease. Property Maintenance - The property is to be kept clean and sanitary, any damages (excluding normal wear and tear) will be paid by the tenant. The tenant shall adhere to all Home Owner's Association (HOA) standards, to include, but not limited to, lawn and landscape maintenance, street appearance, and parking guidelines. Defective or Dangerous Conditions - The tenant shall notify the landlord of any and all defective or dangerous conditions via a phone call or by email. Repairs and Alterations - Any repair the tenant wishes to make to the home shall be requested and approved in writing/email by the landlord before the repair may begin. Pets - Pets must be disclosed to the landlord and will include a $50/Month fee or one time non-refundable fee of $800.00. Pets must be kept indoors, in the fenced backyard, or on a leash. Pet waste must be cleaned from the interior and exterior of property and properly disposed of. Smoking (Including Vaping) - No Smoking Indoors, Smoking Restricted to Yards, Front Porch, and Back Porch. Illegal or Disruptive Activities - No illegal activities are permitted on the property, this includes, but is not limited to: Drug Use, Drug Dealing, Excessive Noise, Other Nuisance Activities. Landlord Entry - The landlord will give 24 hours advance notice before entering the property except for an emergency when access cannot wait 24 hours. Parking - Parking is allowed in designated parking locations. These locations are limited to: the two car attached garage and the driveway located in front of the garage door. Street parking will not be allowed. Parking on non-paved areas of the property will not be allowed with the exception of Boat or Recreational Vehicle parking behind the 6 foot privacy gate located on the side of the home. Boat or Recreational Vehicle parking must be approved in writing/email by the landlord and may only be parked in the garage or behind the 6 foot privacy gate located on the side of the home. Due to HOA rules, any work vehicle with commercial advertising or attached ladders or ladder racks must be approved by the HOA to be parked on the exterior of the garage. The tenant must notify the landlord if they have such a work vehicle. Utilities - Utilities (i.e. Power, Water & Sewer, Telephone, Cable, Internet Service Provider, etc.) shall not be provided as part of the lease agreement. All utilities will be obtained and maintained in the tenant's name and at their cost. Furnishings - The lease shall not include any furnishings in the home. Insurance - The landlord will only carry insurance on the structure of the property (often called a fire and wind only policy) and will not provide insurance on any items (Loss, Damage, Theft, etc.), automobiles (Loss, Damage, Theft, etc), or persons (Life, Health, Injury, Disability, Liability, Identity, etc.) on the property. The renter is encouraged to secure renter's insurance.
