311 New Street is only the residence of the tenant(s) who sign the lease. Rent Due Date: Rent is due on the 1st of every month. Jointly and Severally Liable: If there is more than one tenant signing the lease, all tenants who sign the lease are jointly and severally liable for the property, rent, damage etc. Extended Guest Clause: Temporary visitors will be considered long-term guests after 7 days. The tenant is required to notify the landlord of any guests that will be staying in the home more than 7 days. After 14 days they will be required to be added to the lease agreement. Renters Insurance: Tenant must provide proof of renters insurance and make the Landlord of the home the insurance policy holder prior to signing the lease and moving into the home. Renters Insurance must include 100,000.00 of Liability insurance. Utilities are the responsibility of the tenant: PPL, UGI, ADT, American Water, Cable and Internet. Access to the property: The owner has the right to enter the property given 24 hour notice to the tenant for following reasons: emergencies, inspection, renovation, maintenance. Home Maintenance: Scott one ply toilet paper only, nothing but toilet paper to be thrown down the toilet bowl. In the kitchen, no grease to be thrown down the drain it must be discarded into a trash bag. Drain traps are to always be used in the kitchen. Cabinets under the kitchen sink must be wiped down with a dry towel to ensure no damage is done to the cabinets. Washing machine door must be kept open when not in use to prevent mold. Dryer lint trap must be changed with each use. Tenant is responsible for snow removal of the front and back porch, steps and sidewalk. Thermostat should never be off during the winter months to prevent pipe freezing. Temperature should be left no less than 60 degrees during winter months. Pet Clause: No pets of any kind are permitted there will be a $1000.00 fine imposed and inspection fee of $500.00 if there are any unauthorized pets. Smoking Clause: No Smoking of any kind (Smoking, Vaping, Marijuana etc.) is permitted in the home, if an inspection is done and there is smoke damage or furniture and walls are found with smoke of any kind there will be a fine of $1000.00 imposed on the tenant. Waiver of Subrogation: Premises shall be and remain at Tenant's sole risk. Landlord, its agents, employees and contractors, shall not be liable for, and Tenant hereby releases Landlord from, any and all liability for theft thereof or any damage thereto occasioned by any act of God or by any acts, omissions or negligence of any third party. Tenant expressly agrees to indemnify and save Landlord, its agents, employees and contractors, harmless, in all such cases. Tenant further agrees to indemnify and reimburse Landlord for any costs or expenses, including, without limitation, reasonable attorneys' fees, that Landlord reasonably may incur in investigating, handling or litigating any such claim against Landlord by a third person.The provisions of this section shall survive the expiration or earlier termination of this Lease with respect to any damage, injury or death occurring before such expiration or termination. Decorating: Tenant must have any type of decorating such as painting a room a different color outside of what is currently in the home, or making holes in the walls approved by the Landlord. This will be a case by case basis. Mold: It is the tenants responsibility to ensure that the property remains mold free. Bed Bugs: Landlord will ensure tenant has education to maintain a bedbug free home.Resident acknowledges that they have received and read the pamphlet "Don't Let the Bed Bugs Bite" which outlines how to detect bed bugs, how they spread, how to prevent bed bugs, pest management, preparation for pest management and responsibilities of resident, landlord and the pest management professional. Resident acknowledges the Owner/Agent has inspected the unit and is not aware of any bed bug infestation. Resident agrees that all furnishings and personal properties that will be moved into the premises will be free of bed bugs. Lease Renew: Once the one year lease ends, the tenant must either choose to renew for another year or choose to rent month to month. If tenant chooses to rent month to month the lease amount will increase by 25%. This is a year long lease, however, the owner has permission to break the lease at any point if deemed necessary due to violation of the lease agreement.
