Lease Terms and Property Use Guidelines
This document outlines the key lease terms and property rules for the rental of the residence. All tenants must agree to and abide by the following conditions:
Security Deposit & Payments
Security Deposit: Equal to one month's rent.
Rent Due Date: Rent is due on the 1st of each month.
Grace Period: Rent is considered late if not received by the 4th of the month.
Late Fee: 10% of the monthly rent applies to late payments.
Payment Method: Rent must be paid via the Avail platform or ACH bank transfer.
Move-In / Move-Out Terms
Condition Checklist: Tenant must complete and return a move-in condition checklist within 3 days of occupancy.
Cleaning Requirement: Tenant must leave the home in the same clean condition it was in at move-in. Professional cleaning is recommended but not required; cleanliness will be assessed against the move-in condition.
Maintenance & Repairs
Minor Repairs: Tenant is responsible for minor repairs under $100, unless due to structural issues or normal wear and tear.
Repair Notification:
Emergencies: Must be reported immediately.
All other issues: Must be reported within 48 hours.
Alterations: No alterations (including painting, drilling, mounting, or installing equipment) may be made without prior written landlord approval.
Animals & Livestock
Livestock & Animals: Allowed case-by-case with written landlord approval.
Horses: Permitted with prior approval; tenant must provide all shelters, fencing, and support infrastructure. No existing horse facilities on site.
Animal Maintenance: Tenant must ensure animals are contained, and must manage manure, odors, and waste per local laws and good-neighbor standards.
Household Pets: Not permitted by default due to risk of damage to turf and landscaping. Exceptions may be considered only with landlord approval and negotiation.
Safety & Insurance
Renter's Insurance: Required. Tenant must provide proof of insurance prior to move-in and list landlord as an interested party.
Hazardous Materials: No flammable or hazardous materials may be stored on site except for common household quantities such as propane tanks or small fuel containers used for equipment or grilling.
Workshop & Outbuildings Use
Workshop Use: Tenant may use the 1,800 sq ft insulated workshop and 450 sq ft office for personal use, storage, or business with prior written landlord approval.
Restrictions: No storefronts, manufacturing, or automotive work involving customer traffic or loud operation. Quiet enjoyment of neighbors must be respected at all times.
Vehicle/Equipment Storage: RVs, boats, trailers, and other equipment may be parked inside or outside the shop if kept clean, organized, and not visually disruptive.
Occupancy & Guests
Occupancy Limit: Maximum of 6 full-time residents unless otherwise approved in writing.
Long-Term Guests: Guests staying more than 14 cumulative days in any 30-day period require landlord's prior written approval.
Legal & Termination
Right of Entry: Landlord may enter the property with 48 hours' notice or immediately in emergencies.
Early Termination: Lease breakage may result in an early termination fee (e.g., one month's rent; specified in the lease).
Lease Violations: Lease may be terminated for nonpayment, illegal activity, or violation of any lease terms.
Subletting/Assignment: Subletting or assignment of the lease is not permitted without written landlord approval.
Solar System & Utility Disclaimer
The home is equipped with a landlord-owned Tesla solar system. It typically provides significant electricity savings, especially in summer months.
If the solar system experiences a malfunction, the landlord will make reasonable and prompt efforts to arrange repairs, but the tenant remains responsible for full utility costs during any period of reduced solar performance.
This policy also applies to water, air conditioning, and electric systems: the landlord is not responsible for utility overages, outages, or fluctuations, even in the event of repair delays beyond the landlord's control.
