This lease, made and entered into __________________(date) by in between _______________________ hereinafter referred to as landlord or owner and _______________________ hereinafter referred to as the tenant. A 1 (one) year lease, with a 30 day notice of intent to vacate is required. Tenant agrees to pay $2000 per month to landlord, due on the first Saturday of each month. A grace period of no more than 5 (five) days will be allowed, with no more than 3 (three) grace periods within a yearly lease. If tenant is more than 3 (three) times late in a year, it may result in eviction proceedings. If rent is not paid by midnight of the fifth (5) day, a $50 fee will be assessed for the first 24 hour period and $15 for each day thereafter until all rent and fees are paid. Any monies received will be applied to back rent first the late fees then damages and then the current rent. A $50 service charge on any returned checks, digital fees or incurred late fees or over drafts monies received will be applied to the first back rent, the late fees, then damages and then current rent. All fees are to be paid with the monthly rent. There will be no sub-leasing by the tenant, to include family, friends, roommates or significant partners without prior written approval. This means no visitors are to stay at this location who is paying or not paying in part or whole for food, utilities, haven or parts therefore. All persons residing on premises must be listed on the lease. Any violations this clause, eviction proceedings may commence. The noted premise will be occupied and used solely as a SINGLE family residential dwelling by named and listed tenants and no others, for a total of two (2) adults and listed minor children. If this clause is violated, evictions proceedings may commence. NO SMOKING ALLOWED INSIDE HOME. ZERO EXCEPTIONS. Failure to adhere to the no smoking clause will result in a complete loss of deposit. In reference to trash and garbage, it will not be allowed to accumulate inside or outside the premises. No derelict personal items to be stored on the outside of the property at any time. A trash removal contract will be established by the tenant with the city of Panama City for weekly removal of household trash. A copy of the contract will be provided by the tenant to be included with the lease within the first 30 days of the lease. In reference to vehicles, all vehicles as defined by Florida state statute will be listed in the lease. All vehicles on property will be registered and not in a derelict condition. No vehicles that are in derelict condition will be stored kept or otherwise secured on the premises. Any changes in vehicle status, shall be updated to the landlord by the tenant accordingly. Lawn maintenance is tenant's responsibility. If the tenant fails to meet city code and the landlord is forced to intervene, the tenant will be responsible for the service fee and any fines assessed by the city if warranted. A lawn mower is provided. Non-ethanol gas should be used. Pest control will be included. No pets or animals at the time of signing lease. If an exception is granted, a separate agreement will be added to the lease. If in the event the owner does give special permission allowing a pet, tenants will agree to have carpets professionally cleaned and deodorize prior to vacating. A copy of the receipt will be provided by the tenant to the landlord prior to the return of any deposits. The tenant is fully liable for any damage to doors, walls, windows coverings, screens windows, flooring, or other property damaged by said animal. The tenant will be furnished with a key and/or digital code to access the premise. The tenant is not allowed to change or alter the key or door mechanisms or electronic door codes in any manner without explicit written permission from the landlord. If the tenant alters or changes the key or door mechanisms or electronic doors they will incur a $250 service charge for each violation. Any material keys must be turned in at the conclusion of the rental lease. Failure to do so will result in a $50 charge. A garage door opener will also be provided and shall meet the same requirements as keys. Any cleaning maintenance repairs necessary after the owner or owner's agent inspect the premises shall be itemized and present it to the tenant in writing at the conclusion of the yearly lease. The total cost together with any unpaid sums, fees, or monies due under the rental agreement shall be deducted from the security deposit and the balance will be refunded to the tenant at the provided forwarding address in a timely manner by the landlord. In the event that a tenant does not uphold this agreement concerning rent or in any other clauses explicitly stated within this lease, it is understood that the premises will be vacated within (3) three days after being notified in writing by the landlord or landlord's agent. Failure to vacate may result in eviction proceedings. Furthermore, all fees the landlord incurred for legal eviction shall be paid for by tenant. Landlord or landlord's agent shall not be liable to the tenant or tenant's guest for any personal injury, property damage or other losses to such persons or their property due to any cause, except owner's negligence. Tenant agrees to indemnify and hold owner, owner's agent, and property of the owner, including the premises, free and harmless from/and all liability for injury to/or for death of any person, including tenant or from damage to property arising from the use of the premises by the tenant. It is understood and agreed that the owner/landlord, or owner's agent shall have the right to enter and inspect the premises every (6) six months if deemed necessary and/or warranted. Landlord, owner, or owner's agent shall have the right to enter and inspect the premises and show the house to a prospective tenant after notification to vacate has been received. A 24 hour notice shall be given to tenant prior to inspection or showing. Tenant agrees that they, nor any persons that the tenant allows upon the premises, shall not create or allow to persist any nuisance, private or public, or temporary or permanent, nor shall the tenant do or permit any unlawful acts. Personal items will be kept on the porch storage rooms in or outside the unit; this includes any toys, chairs, tables, or other personal items. This is not to include standard outdoor seating arrangements. In reference to house maintenance, the tenant is to replace the AC filter every 60 days. Tenant's are responsible for changing lightbulbs throughout the home to include the exterior. If any damage is seen by tenant, it is the tenant's responsibility to notify the landlord of the problem in a timely manner. In reference to the security deposit, a deposit of $1000 will be held by the owner or the owner's agent in a non-interest bearing account. No part of the security deposit shall be refunded unless and until the following conditions have been fulfilled by the tenant; (1) all rent and late fees must be paid note the security deposit is not considered for rent unless a written agreement is supplied by the landlord, there will be zero exceptions for this clause, (2) property is to be left clean and in good condition so it is ready for renting. Any deviation from this will result in cleaning fees or service charges stated above, (3) all keys are to be turned in prior to the return of the deposit, (4) there will be no deduction for reasonable wear or tear within the premises.
