If the "Resident" intends to leave at the end of the expiration of the term of the lease, the "resident" agrees to give notice in writing at least Sixty (60) days before the expiration of the lease as either intent to stay or vacate the premise. Failure to give proper sixty (60) day notice and continued occupancy after the expiration of the term of the lease will be regarded as automatically renewing the lease for a period of one (1) calendar year from the expiration date contained within this lease. The lease will be renewed with all other terms of this agreement remaining in effect (unless explicitly stated otherwise) including the above stated sixty (60) day notice to end tenancy. The total lease amount is $2550 Payments of $ 2550. 00 per month is to be paid, in advance, on or before the first day of each month by check, money order,cash, certified funds or direct deposit. If payments are not received by the 5th day of the month, a late penalty shall apply. The late penalty shall be in the amount of $ 100.00 and shall be assessed on the 5th day of the month. Resident" realizes, understands and appreciates that if payment is not tendered on the 1st day of the month, the "Owner/Manager" may send a 7-day notice to make a demand on the rental amount due. If payment is not received within the seven (7) day period, the "Owner/Manager" may move for possession of the premise through a forcible detainer action instituted in Jefferson District Court. If it becomes necessary to institute a forcible detainer action, "Resident" shall be responsible for the payment of an additional $300 processing charge. This processing charge shall be assessed on the 8th day of the month or at such time that the "Owner/Manager" moves for possession of the premise through a forcible detainer action filed in Jefferson District Court. Furthermore, as stated by Kentucky law, "Resident" shall be responsible for all court costs and fees. Pursuant to KRS 383.660 "Resident" may also be responsible for Attorney Fees. "Resident" shall pay for all other utilities, which are, or shall become necessary for occupancy of the premises. It shall be "Residents" responsibility to exercise care in the usage of the utilities. (Water / Sewer / Trash / Electricity/ Gas / Other). Landlord shall not be liable for the interruption or failure of any utility or service if due to any cause beyond Landlord's control. "Resident understands and appreciates that the premises are to be used exclusively as a residential residence only. Pets Allowed - $50 / pet Appliances, including but not limited to Ranges, Refrigerators, Portable Heaters, Window Air Conditioners, and Evaporative Coolers are not included in the rental price. The "Owner/Manager" may at their sole discretion elect to provide any or all appliances at an additional rental sum. The additional rental sum shall be reflected in the total and monthly rental amounts included section II above. Maintenance of the above referenced appliances for the duration of the leased term will be provided by "Owner/manager" at a fee of $35 for every service via Select Home warranty. For the duration of "Residents" occupancy of this property, the resident shall be responsible for maintaining the property. This includes but is not necessary limited to the following elements: Comply with all obligations primarily imposed upon residents by applicable provisions of building and housing codes material affecting health and safety; keep the premise clean and safe The Resident shall be specifically responsible for the mowing of all grass on the property and the removal of all leaves Dispose of all ashes, garbage, rubbish, and all other waste in a clean and safe manner. Keep the plumbing fixtures in the dwelling unit or used by the tenant as clean as possible and notify the "Owner/Manager or repair any issues that may arise. Use in a reasonable manner and maintain all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances within and outside of the premise, when/if making repairs that require a professional technician, the "Resident" shall be responsible for hiring a qualified individual to take care of all minor maintenance issues. "Resident" shall also be responsible for maintaining the landscaping on the lot. The grass and landscaping shall be properly cut, watered and maintained. Do not deliberately or negligently destroy, deface, damage, cause to be damaged, impair or remove any part of the premise or permit any other person to do so. In both the (3) month and (9") month of every calendar year from the execution of this lease, the "Owner/Manager shall arrange a time that is mutually convenient for both the "Resident" and the "Owner/Manager" whereby the "Owner/Manager" will make an inspection of the property. Failure to arrange this meeting on the 3" and 9" month of every calendar year does not constitute a waiver of future inspections. If, as a result of any inspection, it is found that repairs are necessary to maintain the condition of the property, as it was originally conveyed, then the landlord shall submit to the "Resident" by written notice that the "Resident" is in breach of their maintenance obligations under the lease. This notice shall also outline and describe the nature of maintenance issues and the repairs that are necessary to remedy the violation. The "Resident shall have 14 days to make the necessary repairs described by the "Owner/Manager." If within that time period the "Resident" fails to make the necessary repairs or makes repairs of poor quality, the "Owner/Manager" or his agent shall have the right to enter the premise and have the repairs made in a workmanlike manner. The "Owner/Manager" shall then submit an itemized bill to the "Resident" for the value of the repairs. If the "Resident" does not wish to make the repairs within the 14 day period, the "Resident" may waive their right under the terms of this lease and under KRS 383.665 by submitting a written waiver form to the "Owner/Manager;" requesting repairs that the resident shall be responsible paying for. (i) In compliance with KRS 383.665 if the "Residents" failure to maintain the property results in material issues that could affect the health and safety of residing within the property and these issues could have been remedied by repair, replacement of a damaged items or cleaning and the "Resident" failed to perform the necessary maintenance or notify the "Owner/Manager" of ther necessity of immediate repairs, then the "Owner/Manager" may enter the property immediately, make the necessary repairs and submit an itemized bill for the value of the work. (k) If during the occupancy of the premise by the resident, the premise requires major repairs such as the replacement of an HVAC system or the repair/replacement of a roof, the "Resident" shall be responsible for notifying the "Owner/Manager of the necessity of these repairs in writing and allow the "Owner/Manager" reasonable access to the property to make the repairs. (1) Any fines, penalties of fees assessed against the Owner/Manager as a result of the Residents failure to property "Resident" agrees not to paint or alter the premise in any way, nor change locks without owner's prior written consent. Any request for proposed changes must be made in writing with a detailed description of the work to be performed and the materials to be used. The "Resident, shall use the premises in such a manner as to comply with all local, county, state and federal laws, rules, ordinances, regulations and codes, and shall not use the premises or permit it to be used for any unlawful purpose or in any manner determined by "Owner/Manager to be offensive to any of the neighbors. Should the property have a shed located on it, the "Resident(s)" shall not have the right to use such shed. The shed is reserved for the use of the "Owner/Manager". The "Resident" shall not post, display or otherwise have signs or advertisements vIsIble to the outside of the premise without the express written consent of the "Owner/Manager". This includes but is not limited business/commercial advertisements and personal, retail or political signs. This residence is rented "AS-IS" condition, understanding that no additional improvements will be made at the time of move-in, based on the present rental rate. The "Resident" shall be responsible for completing/repairing/remodeling. "Resident" may park only in assigned spaces where parking is so dictated. If no such designation is made parking shall be made in a reasonable manner either in the driveway or in front of the house on the street. Vehicles shall not be left on any other portion of the property. No repairs shall be made to any vehicle on the property unless made in an enclosed garage; these repairs may take no longer than one day. The "Resident" shall not let or sublet all or any part of the premises nor assign this agreement or any interest in it without the prior written consent of the "Owner/Manager." The "Owner/Manager" shall not unreasonably withhold consent, however the "Owner/Manager reserves the right to have any Subletee or Assignee fill out an application and submit to a background and screening check. Failure to comply with this requirement is grounds for the denial of any assignment or sublet request. Owner requires that the "Resident obtain personal lability insurance or renters insurance. "Owner/Manager" has no insurable interest in the "Resident's" personal property. The "Owner/Manager" shall not be liable for any damage caused to the "Residents" personal property under any circumstances. Nor will the "Owner/Manager" be liable for any injury sustained by the "Resident" or their guests. invitees, licensees etc while on the premise. The "Resident" understands that the property is being leased as is, the "Resident has had the opportunity to make an inspection of the property and made aware as to the condition and age the property is currently in. The "Owner/Manager shall not be held liable for anv inturies sustained by the "Resident or their guests. invitees. licensees etc. for the negligent maintenance, use or neglect of the premise or otherwise.
