HOUSING RENTAL AGREEMENT
Fixed Term Residential Rental Agreement
1. Identification of Landlord and Tenant
This Agreement is entered into: between _______________________ ("Tenant"), and ("Landlord"). Each Tenant is jointly and severally liable for the payment of rent and performance of all other terms of this Agreement. This Agreement covers the named responsible Tenant(s) and the following children/residents:

Subject to the terms and conditions in this Agreement, Landlord rents to Tenant, and Tenant rents from Landlord, for residential purposes only, the premises located at: 263 Mystic Lane, Magnolia, DE, 19962.
3. Limits on Use and Occupancy
These premises are to be used on as a private residence for Tenant listed in Clause 1 of this Agreement. Occupancy by guests for more than thirty (30) days is prohibited without Landlord's written consent and will be immediately considered as a breach of this Agreement. Property is to be utilized as residential only. Any use for commercial purposes such as day care, pet care or any other additional usage for this residence is a violation of the lease Agreement and cause for immediate termination of this Agreement.
4. Term of the Tenancy
The term of the rental will begin on February 1, 2025, and end on January 31, 2025. If Tenant vacates before the term ends, Tenant will be liable for the balance of the rent for the remainder of the term or the cost incurred to re-rent the property, including lost rent as allowed by the Delaware Landlord Tenant Code.
5. Payment Rent and Move In Payment Schedule:
Monthly Rent Payment: $2300/month
Tenant is also responsible for any gas, electric, WiFi and cable services at the above-mentioned property during the term of the rental agreement.
Payment Due Date and Late Charges: To be received on or before the 1st day of each month and no later than the 5th day of each month (grace period). Any payment made after the 5th of the month will be considered late and will be assessed a 5% penalty of the monthly rental amount. In the event that rent remains unpaid for 15 days after the due date, Tenant agrees that Landlord may initiate legal action for eviction. 6. Returned Check and Other Bank Charges
If any check offered by the Tenant to the Landlord in payment of rent or another amount due under this Agreement is returned for lack of sufficient funds, a "stop payment" or any other reason, Tenant will pay Landlord a returned check charge of $35.
7. Security Deposit
Tenant will pay to Landlord the sum of $ 2,300 as a security deposit. Tenant may not, without Landlord's prior written consent, apply their security deposit to the last month's rent or to any other sum due under this Agreement.
Within twenty (20) days after Tenant's lease end and tenant has vacated the premises and provided Landlord with a forwarding address, Landlord will give Tenant an itemized written statement of the reasons for and the dollar amount of any of the security deposit retained by the Landlord, along with a check for the deposit balance.
8. Tenant Repair and Maintenance Responsibilities Agreement and Repairs and Alterations by Tenant
Tenant will not make any repairs or alterations to the premises except as provided by law or as authorized by the prior written consent of Landlord. Tenant will not, without Landlord's prior written consent, alter, re-key or install any locks to the premises or install or alter any security system. Tenant will provide Landlord with a key or keys capable of unlocking all such pre-approved re-keyed or new lock environments as well as instructions on how to disarm any pre-approved new security systems or alterations to existing systems. The above indicated appliances, systems and fixtures have been inspected and are in good working order.
The heating system, stove and refrigerator are to be serviced & repaired by the Landlord.
Tenant abuse would be the only reason a Tenant would incur expense for these necessary appliances.
Per the Delaware Landlord Tenant Code, the washer, dryer, & microwave are considered courtesy items. If upon failure, and deemed normal wear & tear, not abuse by the tenant, tenant may be responsible to cover the cost for any repair or replacement if the Landlord does not agree to repair/replace a courtesy item(s).
Landlord accepts responsibility and will pay for all major repairs to the building and its surrounding areas including structural and major outside repairs unless caused by tenant abuse.
Tenant agrees to take responsibility and pay for general interior cleaning such as window, appliance, rug cleaning, etc. grounds maintenance such as lawn mowing, weeding of landscaping, and all consumable items. Consumable items such as light bulbs, batteries, water filters, etc., are to be replaced by tenant at tenants' expense.
Lawn care and weeding is the responsibility of the Tenant. Fines do occur from municipalities for lawn & weeding negligence. When such a fine is incurred due to the negligence of the Tenant, the fine will be passed on to the Tenant and due immediately upon receipt along with any cost incurred paid to a professional lawn service as necessary for compliance.
Tenant agrees to take full responsibility for prompt snow and ice removal from all paved areas and sidewalks, to be performed in a non-negligent manner according to all legal requirements. Failure to remove snow can generate fines by municipalities & HOA's. In the case a fine is incurred by a negligent Tenant, that fine will be passed on to the tenant and due immediately upon receipt.
Tenant shall maintain the property in a manner which conforms to all health and safety requirements. Tenant shall keep the property free from all rodents, insects, roaches, ants, and vermin attracted to the property by unsanitary conditions caused by Tenant, and shall be responsible for all damage caused by such conditions.
Tenant will NOT remove batteries or disconnect any smoke detector on the premises at any time. Tenant agrees to periodically test all smoke detectors on the premises to ensure they are in proper working order. Installing new batteries is the tenant's responsibility.
Tenant will immediately report any defects to the Landlord.
Installation of any playground equipment, swimming pools, and/or trampolines by the tenant(s) is strictly prohibited due to homeowner liability and insurance limitations.
9. Risk of Loss/Insurance
Landlord and Tenant shall each be responsible for loss, damage, or injury caused by its own negligence or willful conduct. Tenant should carry insurance covering Tenant's personal property and Tenant's liability insurance. Proof of a Renter's Insurance policy is required.
10. Lessee Covenants
Tenant(s) agrees to indemnify Landlord and save them harmless from and against any and all claims, actions, damages, liability and expenses in connection with loss of life, personal injury or damage to property arising from or out of Tenant's use of the premises or from the conduct of its business or from any activity, work or things which may be permitted or suffered by Tenant(s) in or about the premises and shall further indemnify, defend and hold Landlords harmless from and against any and all claims arising from any breach or default in the performance of any obligation on Tenant's part to be performed under the provisions of this Lease or arising from a negligence of Tenant or any of its agents, contractors, employees and from any and all costs, attorney's fees, expenses and liabilities incurred in the defense of any such claim or any action or proceedings brought hereon.
Tenant hereby assumes all risk of damage to property or injury to person in or about the premises from any cause, and Tenant hereby waives all claims in respect thereof against Landlords, exception where said damage arises out of negligence of the Landlords.
12. Tenant Responsibilities
Tenant will:
a) Keep the premises clean, sanitary and in good condition.
b) Upon leaving your rental home the tenant must have all carpets cleaned by a professional carpet cleaning company and provide to the landlord, a copy of the receipt for the carpet cleaning. If such a receipt is not produced, the Landlord will hire a carpet cleaning company on the Tenant's behalf upon their departure. The cost of this carpet cleaning will be deducted from the Tenant's security deposit.
c) Immediately notify Landlord of any defects or dangerous conditions in and about the premises of which Tenant becomes aware.
d) Reimburse Landlord, on demand by Landlord, for the cost of any repairs to the premises damaged by Tenant or Tenant's guests or invitees through misuse or neglect.
e) Agree to obtain and maintain Lessee/Renters insurance for their personal property on the premises. Landlord will not be responsible for loss or damage to any person or property during the rental period.
f) Return possession of the unit to the Landlord in the same condition as received upon signing this Agreement.
This includes:
Premises will be professionally cleaned or cleaned to the standards of the final inspection by the Landlord, OR tenant agrees to reimburse the Landlord for fees charged to professionally clean the unit.
Inspect the premises including appliances, fixtures, carpets, drapes and paint, and has found them to be in good, safe, clean condition and repair except if noted in the Landlord/Tenant Move In/Move Out Checklist.
g) Tenant is responsible for the behavior and results of the actions of all assigned tenants, visitors and invitees. Tenant understands that all people present on the property are the personal responsibility of the Tenant, and the Tenant will incur any penalties and ramifications of their individual and cumulative actions.
13. Assignment and Subletting
Tenant cannot sub-lease the premises or assign this Agreement without the prior written consent of Landlord. Any other tenants added or exchanged within this Agreement must make formal application and be approved by the Landlord.
14. Violating Laws and Causing Disturbances
Tenant is entitled to quiet enjoyment of the premises. Tenant and guests or invitees will not use the premises or adjacent areas in such a way as to (1) violate any law or ordinance, including laws prohibiting the use, possession or sale of illegal drugs, (2) commit waste (severe property damage) or (3) create a nuisance by annoying, disturbing, inconvenience or interfering with the quiet enjoyment of any other tenant or nearby resident.
15. Landlord's Right to Access
Landlord or Landlord's agents may enter the premises in the event of an emergency, to make repairs or improvements or to show the premises to prospective buyers or tenants if the Tenant chooses to vacate the property.
Landlord may also enter premises to conduct an inspection as often as every three (3) months to check for safety or maintenance situations. Except in cases of emergency, Tenant's abandonment of the premises, court order, or where it is impracticable to do so, Landlord shall give Tenant 48-hour notice before entering the premises. Upon mutual termination of lease agreement, Landlord and approved Licensed Realtors will be allowed with a maximum of 24 hours' notice to access the home to show potential new tenants the residence unless otherwise agreed by the Tenants.
Tenant is to ensure the home is in show condition and will provide for removal of pets during all showings. A lockbox with a secured key will be installed on the home and a sign on the front lawn to advertise the available rental. If the Tenant chooses to inhibit the effective showing of the property, they will be billed one month's rent that would otherwise be the Landlord's loss rental revenue that was caused by the Tenant's lack of cooperation.
16. Extended Absences by Tenant
Tenant will notify Landlord in advance if Tenant will be away from the premises for seven (7) or more consecutive days. During such absence, Landlord may enter the premises at times reasonably necessary to maintain the property and inspect for needed repairs.
17. Abandonment
Should the Tenant wrongful quit or vacate the rental unit without proper notice, the entire rent for the remainder of the term of the agreement and reasonable renovation expenses other than normal wear and tear will be due to the Landlord from the Tenant.
18. Liens and Encumbrances
Tenant shall not have the right or authority to encumber the premises or to permit any person to claim or assert any lien for the improvement or repair of the premises made by the Tenant. Tenant shall notify all parties performing work on the premises at Tenant's request that lease does not allow any liens to attach to Landlord's interest. Tenant must get all such improvements pre-approved in writing by the Landlord.
19. Payment of Court Costs and Attorney Fees in a Lawsuit
In any action or legal proceeding to enforce any part of this Agreement, the prevailing party shall recover reasonable post judgment interest, collection costs and court fees. Judgment interest will be 8% for the first 10 years at which time the case will be transferred to Superior Court to receive the applicable judgment extension.
20. Mold Addendum and Tenant Information
Mold growth is common in the State of Delaware due to frequent high humidity. As mold is also a by-product of how you choose to condition and maintain your rental property, it is the Tenant's responsibility to adhere to appropriate living standards to protect their family and inhibit the growth of mold.
21. Pets and Pet Addendum
Any damage including odors caused by the animals will be removed by the Tenant prior to departure. Appropriate deductions from the security deposit will be made if there are lingering effects from the pets.
Tenant will not be permitted to have any pets on the premises without prior written consent from the Landlord. Fish tanks and aquariums less than 25 gallons are permitted with a pet deposit. The tank placement is limited to the main floor of the home, and must be located at a load bearing wall. Tenant is responsible for any water damage that occurs to the premises due to the tank.
Large snakes, rats, Pit Bulls, Doberman Pincher, Rottweiler and other Molosser dog breeds are not permitted on the property at any time. Any additional animals throughout tenancy must be pre-approved by Landlord. This includes small pets such as hamsters, gerbils, turtles, lizards, etc. Pet deposit will be $500 unless additional monies are required due to quantity or size of pets.
If the tenant(s) desire to add a pet to the household during their tenancy, they must inquire if the homeowner allows pets and what type before proceeding with any additional pet. Then a written letter of authorization will be provided, if appropriate, by the Property Manager and a Pet Addendum will be executed and necessary deposits collected at that time. At no time can a tenant arbitrarily add a pet without consulting the landlord. Each rental property may only have a maximum of two pets unless stipulated otherwise by the Landlord.
22. Disclosure of Lead-Based Paint and Radon Information
Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. A separate Lead Based Paint Disclosure Statement and information pamphlet is included for properties constructed prior to 1978. Radon Disclosure: The Landlord makes the following disclosure. Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Additional information regarding radon and radon testing may be obtained from the county health department. To the best of the Landlord's knowledge, radon does not exist at this time.
23. Delaware Landlord Tenant Code
Signing of this Agreement is proof that the Tenant as received a copy of the Delaware Landlord-Tenant Act Summary. This summary should be utilized by the Tenant to ensure successful execution of all further legal actions with the Landlord.
24. Validity of Each Part
If any portion of this Agreement is held to be invalid, its invalidity will not affect the validity or enforceability of any other provision of this agreement.
25. Authority to Receive Legal Papers
The Landlord, any person managing the premises, and anyone designated by the Landlord are authorized to accept service of, process and receive other notices and demands, which may be delivered to the Landlord at:
26. Grounds for Termination of Tenancy
Landlord's Right to Terminate
a. The failure of Tenant or Tenant's guests or invitees to comply with any term of this Agreement, or the misrepresentation of any material fact on Tenant's Rental Application, are grounds for termination of the tenancy, with appropriate notice to tenants and procedures as required by law.
b. Violation of Lease
A lease termination warning letter will be issued if the Tenant violates rental agreement parameters as it relates to illegal or inappropriate pets, changes in authorized number of occupants, inordinate number or abandoned cars on the premises, or violation of the development covenants. If Tenant fails to comply, a termination notice will follow.
c. Irreparable Harm Clause and Immediate Termination of Rental Agreement There is no requirement for seven (7) day notice and the Tenant can be immediately evacuated if a lease receives Driving Under the Influence (DUI), drug or criminal arrest, or illicit acts with a gun or dangerous weapon.
Tenant's Right to Terminate
a. Refer to the Delaware Landlord Tenant Code, "Terminating a Rental Agreement" section.
b. The tenant may terminate this agreement by presenting evidence to the Landlord that they are being transferred to a distance of more than 30 miles by the present employer and by giving the Landlord thirty (30) days written notice.
United States Military Service Clause: Upon presentation of authentic transfer orders, tenant will be allowed to break lease without forfeiting deposit and without liability for rent past the termination date, if all other provisions of this lease are in compliance with a minimum of 30 days' notice.
27. Notice of Non-Renewal of Annual Lease
The Tenant must give sixty (60) days' notice of lease termination. The end date of this agreement as signed does not constitute notice of lease termination. Tenant must notify Landlord of intent to vacate 60 days prior to the end date of this agreement and then the final date of this agreement will also be the date the Tenant can vacate.
28. Notice of Non-Renewal of Annual Lease Due to Property Sale
The Landlord must give sixty (60) days' notice of lease termination due to sale of the property. Within the sixty (60) day period, the Landlord shall be granted access permission to show premises to all potential buyers. Access shall be limited to 24-hour notice. Tenant shall insure the property is in top condition (cleaned, organized and sanitary) for all showings.
29. Renewal of Fixed Term Residential Lease Agreement
Sixty (60) days prior to the lease expiration, Tenant will need to notify Landlord of intent to extend the lease. The term of this rental Agreement will not renew unless agreed to in writing by the Tenant and the Landlord. In the event that the rental Agreement is not renewed by Landlord or Tenant, and neither party has given notice the required sixty (60) days' notice of termination of the rental Agreement, the term shall be on a month-to-month basis and all other stipulations of the rental agreement shall continue in full force and effect.
30. Final Rental Agreement Termination and Property Return
Following the required tenant 60 days' notice, the following will take place for the Tenant to appropriate relinquish their residency of the property:
a. Notice must be provided in writing to the Property Manager. Prior to vacating the property, the Tenant must provide the Landlord in writing with a forwarding address.
b. All appliances will be cleaned to original quality levels. Lack of cleaning will cause a $150 appliance cleaning charge that will be levied against the tenant and detailed in the Security Deposit Refund Letter.
c. Carpets will be shampooed and all stains removed. Any remaining stains or unclean carpets will cause the Landlord to hire a professional carpet service. The invoice for said cleaning will be the responsibility of the Tenant and included in the Security Deposit Refund Letter.
d. Garage door opener/remote will be returned to Y. Harris prior to departure.
e. Tenants must take their final garbage, including the garbage in cans, with them upon leaving. If there is garbage left behind in the home, there will be an $85 garbage disposal fee deducted from the Security Deposit.
f. General home cleanliness will be move-in condition. All cupboards will be wiped out, all floors cleaned, and the lawn will be cut if season requires. If these maintenance items are not appropriately handled by the Tenant, any required vendor to handle these responsibilities will invoice the tenant and receipts will be included in the Security Deposit Refund Letter.
g. Within 20 days of vacating the property, returning all keys and remotes, and providing a forwarding address, the Landlord will provide a Security Deposit Refund Letter detailing the condition of the home and required improvements. When possible, this letter will be generated as soon as a final walk through has occurred and security deposit funds will be distributed to the tenant appropriately.
31. Additional Landlord/Tenant Agreements
Landlord will maintain storage space in the basement and garage of the property. As outlined in clause 16 above (Landlord's Right to Access), except in cases of emergency, Tenant's abandonment of the premises, court order, or where it is impracticable to do so, Landlord shall give Tenant prior notice before entering the premises to access the storage area(s).
32. Entire Agreement
This document constitutes the entire Agreement between the parties, and no promises or representations, other than those contained here and those implied by law, have been made by Landlord or Tenant. Any modifications to this Agreement must be made in writing and signed by Landlord and Tenant.
