1. USE OF PROPERTY.
Guest shall obey, and require anyone on the Property to obey, all laws and any restrictions that apply to the Property. Use of Property is residential only. Host reserves the right to terminate the Reservation, effective immediately and without refund, if Guest uses the Property for commercial purposes, including but not limited to: parties, dinners, film or photoshoots, or gatherings of any kind. Host also reserves the right to terminate the Agreement, effective immediately and without refund, if the Property exceeds the maximum occupancy as advertised online.
2. SAFETY FEATURES.
Guest acknowledges and agrees that the Property may contain certain safety features such as smoke detectors, smoking detectors, carbon monoxide detectors, fire alarms, or sound level monitoring units as may be required by law, Guest consents to Host's use of these safety features, and Guest agrees not to interfere or tamper with these features. The Guest agrees to immediately report any problems or need for maintenance or repairs to Host. Host has a right to enter the Property to check and maintain these safety features as provided by law. It is expressly understood that Guest must not, at any time, disable or remove any installed safety feature, and to do so shall be considered a material breach of this Agreement and will be just cause for termination of this Agreement and Guest removal from the Property.
3. MAINTENANCE.
Host and Guest hereby stipulate that the day-to-day maintenance responsibilities for the Property shall be assumed by the Guest. Throughout the entire Agreement, the Guest shall: Adhere to all obligations imposed on occupants by relevant provisions of building, housing, and health codes; Maintain the Property in a clean and sanitary condition; Effectively dispose of all garbage from the dwelling unit in a hygienic manner; Ensure the cleanliness, sanitation, and proper functioning of all plumbing fixtures within the dwelling unit; and Utilize and operate, in a reasonable manner, all electrical, plumbing, sanitary, heating, ventilating, air conditioning, and other facilities and appliances.
The Guest acknowledges the commitment to verify the functionality of all appliances, AC units, toilets, plumbing, and other functional fixtures within 12 hours of arrival. In the event a functional issue arises, the Guest undertakes the duty to promptly report such matters to the Host. Failure to report any adverse conditions concerning the property may render the Guest liable for any escalated damage resulting from the failure to notify the Host of the issue.
4. HOST'S ACCESS TO PROPERTY.
Host or Host's Agent retains the right to access the Property under the following circumstances: At any time for the protection or preservation of the Property; after providing notice to the Guest at reasonable times for repairing or cleaning the Property; to inspect the Property; carry out necessary or agreed-upon repairs; provide agreed-upon services; or if the Guest unreasonably withholds consent.
The Guest acknowledges the Host's right to employ surveillance with audio at the entrance or exterior premises for the protection of the Property. If the Guest alters or disables the surveillance system, the Host reserves the right to terminate the Agreement without refund.
5. PERSONAL ITEMS.
The Host expressly disclaims any responsibility for the Guest's personal property or items (hereinafter collectively referred to as "Personal Items") both during the term of this Agreement and subsequent to the expiration or premature termination thereof, whether such items are left within any of the Properties. Prior to the end of the Reservation, it is imperative that the Guest retrieves all Personal Items from the booked Property and any other associated belongings. Failure to do so will result in the Host, after exercising commercially reasonable efforts to provide the Guest with adequate notice, being vested with the right to remove, store, and/or dispose of any remaining Personal Items in conformity with applicable legal provisions. The Guest explicitly waives any claims or demands pertaining to such Personal Items or the Host's procedures in handling them. Incurred fees relating to the removal, storage, and/or disposal shall be the responsibility of the Guest. The Host strongly advises the Guest to consider purchasing renter's insurance or personal property insurance to mitigate potential risks of damage or loss to their Personal Items.
6. LOCKOUT.
In the event of a lockout, the Guest will call a locksmith immediately at his or her own expense. The Guest will not be reimbursed unless the lockout is caused by a malfunctioning smart lock.
7. PACKAGE DELIVERY.
The Guest is not permitted to ship any packages, suitcases, or belongings to the Property or Host's office. The Guest may ship packages to a nearby courier location (i.e. USPS, UPS, FedEx) and retrieve them.
8. MODIFICATION OF HOUSE RULES.
The Host reserves the unequivocal right to amend this Agreement (including any Additional Terms pursuant to said agreements and applicable law) prospectively and at its discretion, at any time. It is imperative that the Guest periodically reviews this Agreement for alterations.
9. MISCELLANEOUS.
Time is of the essence of the performance of each party's obligations. The Agreement sets forth the complete understanding of the parties and may not be changed or terminated orally. Host and Guest will use good faith in performing their obligations.
10. HOUSE RULES
The Guest agrees to follow all House Rules, including but not limited to the stipulations below. The following are incorporated into this Agreement:
Loud music or noise is strictly prohibited after 9 PM. The initial noise complaint from any resident will result in termination of remaining Guest stay.
Gatherings are not permitted on the Property. No guests are allowed onto the Property other than those in the Rental Party. The use of the Property is strictly residential, and subletting is prohibited.
If police are called to the Property, the Agreement will be terminated immediately without any refund.
The Guest must act, and ensure that all other persons on the Property act, in a manner that does not disturb neighbors or constitute a breach of the peace.
Only toilet paper may be flushed; no feminine products are to be flushed at any time. Damages resulting from the flushing of restricted items will incur charges.
Pets are not permitted. The Guest shall not feed or bring in wildlife. In the event of pet allergen sensitivity, the Guest is advised that a pet may have been a guest at this property prior to their stay.
The agreement is not deemed valid until signed by all parties, and payment is received in full and on time.
Illegally parked cars are subject to towing, with any resulting fines being the responsibility of the Guest. No commercial vehicles, RVs, or trailers are allowed.
The Guest may not make any alterations, including hanging pictures, posters, banners, or other decorations, to the Property.
Smoking is strictly prohibited. Smoking is not permitted in the unit, including on balconies and in common areas. The guest is subject to a $1,500 fine plus the cost to clean, deodorize, and repair damages if there is any evidence of smoking inside the unit.
The Property and furnishings must be kept in order, and furniture should not be rearranged.
The Guest shall not keep any dangerous or flammable items on the Property that might increase the risk of fire or damage.
Gas stove must be turned off after cooking.
The Guest shall not create any environmental hazards, including fireworks, on or about the Property.
The Guest shall not destroy, deface, or remove any part of the Property, nor permit any person to do so.
Appliances must be used for their intended purposes only.
The AC thermostat will not be set below 68 degrees. If the AC is in use, all windows must be closed.
The Guest may not send or receive mail at the Property.
RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
IN CONSIDERATION for being permitted to enter premises and property for vacation rental or any other purpose, the Guest, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgment that he/she has inspected house, deck and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons.
THE GUEST hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Host as a company or corporate representatives, their members, managers, hosts, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as "releases", from all liability to the Guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the Guests, whether caused by the negligence of the releases or otherwise while in or upon the area.
THE GUEST hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releases or otherwise.
WARNING: Use of grill carries risk that may result in serious injury or death, and unsupervised use by children is prohibited.
Never use a grill while under the influence of drugs or alcohol. Supervise children at all times to decrease the risk of injury.
THE GUEST hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of the releases or otherwise while in or upon area.
THE GUEST hereby certifies that he/she and guests (they) have adequate insurance to cover any injury, illness, or damage that may be caused or suffered while in or upon the area, or else agrees to bear the costs of such damage or injury. The guest further that he/she/they have no medical conditions which would interfere with the use of the grill or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage. The Guest further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance with the rules of Zillow, The State of Louisiana and the City of New Orleans.
