Tenant's failure to replace the air filters as defined in the Energy and Preventative Maintenance Program is a material breach of this agreement and the Landlord shall be entitled to exercise all rights and remedies it has against the Tenant and the Tenant shall be liable to Landlord for all damages to the property and HVAC system caused by the Tenant's neglect or abuse.
