Fixed-Term Residential Lease
Clause 1. Identification of Landlord and Tenants
This Agreement is entered into between _________ ("Tenants") and ________ ("Landlord"). Tenants are liable for the payment of rent and performance of all other terms of this agreement.
Clause 2. Identification of Premises
Subject to the terms and conditions in this Agreement, Landlord rents to Tenants, and Tenants rent from Landlord, for residential purposes only, the premises located at 240 M Street SW Washington DC 20024("the premises").
Clause 3. Limits on Use and Occupancy
The premises are to be used only as a private residence for Tenant(s) listed in Clause 1 of this Agreement. Occupancy by guests for more than 30 days per year is prohibited without Landlord's written consent and will be considered a breach of this Agreement.
Clause 4. Term of Tenancy
The term of the rental will begin on ____________________ If Tenants vacate before the term ends, Tenants will be liable for the balance of the rent for the remainder of the term unless mutually agreed 60 days prior to ending occupancy, in writing.
The Lease is formally extended by the Landlord and the Tenant in a writing signed by both parties (60 days prior to the end date of existing Lease); or
The Landlord willingly accepts Rent from the tenant for a period beyond the original Term. Where the Landlord accepts Rent for a period beyond the original Term, without a formal extension agreed to in writing by both parties, a month-to-month tenancy will be created. At this time, the monthly Rent payment would increase to $3,300.00.
Clause 5. Payment of Rent
Regular monthly rent.
Tenants will pay to Landlord a monthly rent of $3,100.00, payable in advance on the 1st day of each month, except when that day falls on a weekend or legal holiday, in which case rent is due on the NEXT business day. Rent will be paid to ________ via Venmo (______), via Paypal (QR code can be sent upon request) or at check drop off at Centier Bank (Account #: ________).
Clause 6. Late Charges
If Tenants fail to pay the rent in full before the end of the 3rd day after it's due, Tenants will pay Landlord a late charge of $100.00, plus $10.00 for each additional day that the rent remains unpaid. The total late charge for any one month will not exceed $250.00. Landlord does not waive the right to insist on payment of the rent in full on the date it is due.
Clause 7. Returned Check and Other Bank Charges
If any check offered by Tenants to Landlord in payment of rent or any other amount due under this Agreement is returned for lack of sufficient funds, a "stop payment," or any other reason, Tenants will pay Landlord a returned check charge of $50.00.
Clause 8. Security Deposit
Tenants pay Landlord a deposit in the sum of $3,100.00 as a security deposit (refundable). Within 30 days after Tenants have vacated the premises, returned keys, and provided Landlord with a forwarding address, Landlord will give Tenants an itemized written statement of the reasons for, and the dollar amount of, any of the security deposit retained by the Landlord, along with a check for any deposit balance.
Clause 9. Utilities
Landlord will pay all utility charges (electric, water, gas, internet, trash, etc.)
Clause 10. Assignment and Subletting
Tenants will NOT sublet any part of the premises or assign this Agreement without the prior written consent of the Landlord.
Clause 11. Tenant's Maintenance Responsibilities
Tenants will: (1) keep the premises clean, sanitary, and in good condition and, upon termination of the tenancy, return the premises to Landlord in a condition identical to that which existed when Tenants took occupancy, except for ordinary wear and tear; (2) immediately notify Landlord of any defects or dangerous conditions in and about the premises of which Tenants become aware; and (3) reimburse Landlord, on demand by Landlord, for the cost of any repairs to the premises damaged by Tenants or Tenants' guests or business invitees through misuse or neglect. Tenants have examined the premises, including appliances, fixtures, carpets, window treatments, and paint (collectively, the "Premises"), and have found them to be in good, safe and clean condition. (4) Initial repairs for up to $150 will be the responsibility of tenant for proper up keep.
Clause 12. Repairs and Alterations by Tenant
a. Except as provided by law, or as authorized by the prior written consent of the Landlord, Tenants will not make any repairs or alterations to the premises.
b. Tenants will not, without Landlord's prior written consent, alter, rekey, or install any locks to the premises or install or alter any burglar alarm system. Tenants will provide Landlord with a key or keys capable of unlocking all rekeyed or new locks as well as instructions on how to disarm any altered or new burglar alarm system.
Clause 13. Violating Laws and Causing Disturbances
Tenants are entitled to quiet enjoyment of the premises. Tenants and guests or invitees will not use the premises or adjacent areas in such a way as to: (1) violate any law or ordinance, including laws prohibiting the use, possession, or sale of illegal drugs; (2) commit waste (severe property damage); or (3) create a nuisance by annoying, disturbing, inconveniencing, or interfering with the quiet enjoyment and quiet of any other tenant or nearby resident.
Clause 14. Pets
Tenants are NOT permitted to have any pets in the house.
Clause 15. Smoking
Tenants are prohibited from smoking on the property.
Clause 16. Landlord's Right to Access
Landlord or Landlord's agents (House manager) may enter the premises in the event of an emergency, to make repairs or improvements, or to show the premises to prospective buyers or tenants. Landlord or Landlord's agents may also enter the premises to conduct quarterly inspections to check for safety or maintenance problems. Except in cases of emergency, Tenants' abandonment of the premises, court order, or where it is impracticable to do so, Landlord shall give Tenants 24-hour notice before entering.
Clause 17. Extended Absences by Tenant
Tenants will notify the Landlord in advance if Tenants will be away from the premises for a month or more. During such absence, Landlord or Landlord's agents may enter the premises at times reasonably necessary to maintain the property and inspect for needed repairs.
Clause 18. Possession of the Premises
a. Tenants' failure to take possession.
If, after signing this Agreement, Tenants fail to take possession of the premises, Tenants will still be responsible for paying rent and complying with all other terms of this Agreement.
b. Landlord's failure to deliver possession.
If Landlord is unable to deliver possession of the premises to Tenants for any reason not within Landlord's control, including, but not limited to, partial or complete destruction of the premises, Tenants will have the right to terminate this Agreement upon proper notice as required by law. In such an event, Landlord's liability to Tenants will be limited to the return of all sums previously paid by Tenants to Landlord.
Clause 19. Payment of Court Costs and Attorney Fees in a Lawsuit
In any action or legal proceeding to enforce any part of this Agreement, the prevailing party shall recover reasonable attorney fees and court costs in accord with Indiana Law.
Clause 20. Appliance Maintenance
If, in the course of normal wear and tear, repair of major household appliances (dishwasher, washer/dryer, water heater, central heat/air system) becomes necessary, Landlord is responsible for these repairs. Landlord will also be responsible for repair/maintenance for the home so that it remains in inhabitable conditions for the duration of the lease. Tenants shall notify Landlord or Landlord's agents within 48 hours if appliances or the home is in need of repair, and Landlord or Landlord's agents will arrange for repairs and/or verbally empower Tenants to find local help to repair any nonfunctional or malfunctioning equipment. Notwithstanding anything to the contrary in this agreement, if Landlord fails to repair or replace any such appliance within a reasonable time, Tenants will be permitted to do so and deduct the cost of any such repairs from the next month's rent upon submission to Landlord of a receipt for the amount paid. Landlord will also supply a phone number for local contact in case emergency repairs are needed: _______ (____________).
Clause 21. Additional Provisions
Additional provisions are as follows:
Tenants replace the furnace filter at least once a quarter. Filters will be provided by the Landlord.
Tenants replace lightbulbs as needed.
Tenants are required to purchase a renter's insurance policy with an 'adequate' amount of coverage.
If professional diagnosis (i.e. from plumbers, electrician, handyman, HVAC companies, etc.) is needed, Tenants agree to cover the cost of the diagnosis (typically includes one-time travel fee) all repairs and replacements will be covered by the Landlord.
Tenants agree to Semi-annual Inspections performed by the house manager following a minimum 24-hour notice to Tenants.
Clause 22. Validity of Each Part
If any portion of this Agreement is held to be invalid, its invalidity will not affect the validity or enforceability of any other provision of this Agreement.
Clause 23. Grounds for Termination of Tenancy
The failure of Tenants or Tenants' guests or invitees to comply with any term of this Agreement, or the misrepresentation of any material fact on Tenants' Rental Applications, is grounds for termination of the tenancy, with appropriate notice to tenants and procedures as required by law.
Clause 24. Entire Agreement
This document constitutes the entire Agreement between the parties, and no promises or representations, other than those contained here and those implied by law, have been made by the Landlord or Tenants. Any modifications to this Agreement must be in writing signed by the Landlord and Tenants.
