All parties agree the Move In Move Out Inspection shall be completed within 7 days of the lease start date. 4. All parties acknowledge the Landlord or Owner are not responsible for injury or medical expenses or any other medical condition or associated expenses affecting the tenant, tenant's friends, family, invitees, or any other party on this property. 5. All parties acknowledge that the tenant may not alter the home without the written permission of the landlord. If any alterations are agreed upon by both tenant and landlord the tenant must take the property back to the original condition when tenants took possession, unless agreed upon by all parties. If painting is allowed the color shall be returned to the original color and painted to match corner to corner and exactly match in each agreed-upon area. 6. All parties agree there is a no smoking clause to this lease. This includes anywhere on the property. Any smoking is to take place off the property. There is a fine of $2,000 for smoking in the home. The owner will determine if smoking of any kind has taken place in the home. 7. Tenant shall purchase "renter's insurance" effective at the date of the move-in and shall keep the insurance active at all times during the term of this lease or extended terms of this lease. A copy of such insurance shall be provided to Landlord within five (5) days of move in date." Rental insurance shall remain in effect during the entire term of the lease. If insurance is found not to be in place the landlord has the right to fine the tenant $200 per occurrence. 8. All parties acknowledge that the tenant is responsible for all pest control within the walls of the unit. Landlord will provide termite protection. 9. Tenants shall be responsible for maintenance of minor "wear and tear" issues that occur as a result of living in the premises including, but not limited to, light bulbs, filters, batteries, stopped-up plumbing drains where such stoppage is caused by the introduction of foreign objects not intended for sewer disposal. Tenant shall pay on demand all charges for repair of such stoppage. Additionally, any required repairs caused by the Tenant's misuse or neglect will be at the expense of the Tenant. Nail holes are to be spackled and painted to match at move-out. Any and all repairs shall be reported to the landlord within a 24 hours said repairs. If tenant delays notice the tenant can be held liable for repairs. 10. By signature on this document, Landlord affirms all mortgage payments are current; furthermore, Landlord agrees to keep all payments on the mortgage current and to pay annual Homeowners' Association membership dues, if applicable. Landlord will notify Management immediately upon receipt of any foreclosure notices on the property. Resident understands that the property may have a mortgage on it and this lease is subject to and inferior to that mortgage. If a foreclosure takes place and the resident is required to move out, the resident agrees to hold Management harmless and agrees not to claim wrongful dispossessory or constructing eviction. 11. Tenants agree to have all utilities transferred into their name before move-in. Should Tenants fail to transfer utilities and Management or Landlord is billed for utility use, Tenants agree to reimburse all utility costs incurred, plus an administrative fee to Management for $50.00 a month per utility. 12. All parties acknowledge and agree that Tenant is to have premises, professionally cleaned upon vacating the property. Tenant must provide Management with receipts for completed work at the time of move-out inspection for a security deposit to be released. Walls with holes must be patched and painted to match. Lawns are to be cut and edged at move-out. The property must be cleaned by a professional cleaning company before the move-out inspection and/or the last day of the lease. Receipts for the carpet cleaning and house cleaning must be provided at the move-out inspection. Both carpet cleaning and house cleaning must be performed after all furniture and boxes have been removed from the premises. Preferred providers may be used. If either cleaning is not considered at the move-out inspection additional cleaning fees may be charged against the security deposit. 13. Tenant acknowledges that it is necessary to maintain appropriate climate control, keep the dwelling unit clean and take necessary measures to prevent mold from accumulating in the dwelling unit. 14. The reservation deposit is to be paid as follows, $2,800 at lease signing. All parties acknowledge this deposit will act as a hold fee until the date of move in and at that time will be deemed the security deposit. Should the tenant choose at any time prior to the move in date not to fulfill the terms of this lease all monies paid to that point will be forfeited and retained by the landlord. 15. Landlord will replace the air filters quarterly. 16. If the tenant does not wish to maintain the yard, the landlord will provide yard care for an additional $100 per month. 17. Pets will be allowed only with written approval by the landlord. A non-refundable $350 fee is required. A monthly fee of $50-$75 will be charged based on the size and type of pet. 18. Tenants must comply with neighborhood covenants.
