BELOW IS AN EXACT COPY OF THE RENTAL AGREEMENT:
THIS CONTRACT ENTERED INTO BETWEEN STEVEN BELUS, HEREINAFTER CALLED LESSOR, AND___________________, HEREINAFTER CALLED LESSEE(S), AND AS SET FORTH BELOW, HEREBY LEASES THE APARTMENT, NON-SMOKING RESIDENCE, WITH PREMISES LOCATED AT 231 S. WATER ST. , FOR A MINIMUM OF ONE (1) YEAR, COMMENCING ON THE 15TH DAY OF NOVEMBER, 2024. UPON COMPLETION OF ONE (1) YEAR, AN ADDENDUM TO THIS LEASE, FOR A NEW AGGREED UPON TERM, MAY BE INITAITED AND AGREED UPON AND ENTERED INTO BETWEEN THE PARTIES.
IN CONSIDERATION OF THE USE AND OCCUPANCY OF THIS NON-SMOKING PREMISES AS HEREIN SPECIFIED:
The Lessee(s) agrees to rent said premises for the sum of $1700.00 per month, payable in advance on the first day of each and every month. Address for mailing rent: 198 Murphy Gulch Road, Banner, WY 82832. A $25.00 charge will be added if rent is late (late = received after the 1stst). You must pay a minimum of $250.00 on the due date. If partial payment, then an additional $25.00 fee will accrue every 7th day, until rent is paid in full. If the lessee's check is dishonored, deemed NSF, and returned for any reason to the landlord, lessee agrees to pay an additional fee of $30.00 for each occurrence. Non-payment of rent and/or continual late rents is automatic grounds for termination of this agreement and removal/eviction of Lessee. Deposit is non-refundable upon eviction. ________intls.
2.) $1700.00 is required as security deposit for breakage, damage, or misuse of the premises, Deposit may be used to satisfy past due rents. This deposit will be returned upon Lessee(s) vacating if all provisions of this agreement are complied with, and more specifically, but not limited to compliance with the following provisions:
Lease term has been fulfilled, twelve months
Rents are current, up-to-date, and paid
The residence is left undamaged, clean and in rentable condition, as to be determined by the lessor (Property condition statement & pictures (optional by lessee))
If it is determined that smoking has occurred within the residence, additional fees/costs/charges for cleaning will be the responsibility of the lessee including, but not limited to interior, vents, curtains, walls, ceilings; fixtures, appliances, cabinets, and any other interior item affected or soiled by smoking.
This deposit will be non-refundable should the Lessee not fulfill the entire term of this lease, (12) twelve months from inception of this contract.
3.) Use said premises as a residence only. This property is a non-smoking property. No smoking or vaping is allowed in any interior portions of this premise/building encompassed within lease agreement. Additionally, no incense burning is allowed. Candles are only allowed under the stove/range vent as candles tend to blacken walls. Candles are not to be left unattended. ______intls. Damage or loss caused by unattended candle is the responsibility of the Lessee. _______intls. Lessee agrees to assume ALL responsibility for actions taken by any person(s) entering the property for visitation/interaction with the Lessee.
4.) NO PETS ALLOWED, exceptions may be granted by the Lessor, in consideration of an additional monthly rent of $25.00 per 10 lbs verified by a veterinarian. Lessor reserves the right to revoke pet privilege, with reasonable cause, at any time. An additional pet security deposit of $800 will be required upon allowance of granted pet(s). Only pets granted by lessor allowed on property unless granted permission by lessor. Additional pets on premises will result in a forfeit of pet security deposit. ________intls.
5.) The rental of this residence is for a period not less than one (1) year. This minimum rental period begins NOVEMBER, 2024 by Lessee(s). The total deposit will be forfeited if Lessee does not occupy the residence for the minimum lease period. Lease will continue on an annual basis after the one (1) year minimum lease period, until lease is terminated under the provisions of this lease agreement, or until default by the Lessee(s) under any provision of this lease agreement. If the lessee wishes to terminate this lease prior to the one (1) year minimum lease period, the Lessee acknowledges that they will be fully liable for any back rent owed and/or the full amount of rents defined within the term of this lease (months remaining multiplied by monthly rent). Lessee also acknowledges that defaulting this lease could result in a judgment against them and/or a lien filed against their current and future assets and/or earnings.
6.) Lessee(s) agrees that he/she has received the premise in good order, see property condition statement, and shall return the said premise to the Lessor upon the termination of this agreement in as good order and condition as when entered. Premise will be returned free from all of Lessee(s)'s personal property, trash and/or debris. Lessee(s) shall keep said premises in good repair during the term of this lease, including but not limited to, interior and exterior walls, ceilings, floorings, fixtures, furnishings and woodwork. Lessee(s) shall be liable for the expense and repair caused by Lessee(s)'s or their company. At the Lessor's election, any such expense shall be deemed additional rent for the rental month in which the damage is found or reported. If Lessee(s) fails to pay for damages upon receipt of invoice/billing by Lessor, this lease may be terminated by Lessor.
7.) Lessee(s) are required to give 30 days written notice upon vacating premises, or they are subject to paying one (1) month's rent upon vacating. Lessee agrees to cooperate with lessor/agent in showing property to prospective tenants, prior to termination of occupancy. Lessor must notify lessee prior to showing and will work around lessees schedule, within reasonable terms. __________intls.
8.) Lessee(s) agree to vacate premises within three (3) days after being notified in writing due to non-payment of rent or breach of this agreement._______intls.
9.) NO ALTERATIONS OF ANY KIND to this residence shall be made without prior written consent of the Lessor. The Lessee(s) agrees not to allow the premises, (including, but not limited to, woodwork, floorings, walls, furnishings, fixtures contained therein) to be damaged, rendered un-usable, or modified in any manner, and assumes responsibility for all loss, breakage, or damage thereto.
10.) It is expressly understood and agreed that the Owner of said premises, or Lessor(s) will not be liable for any damages or any injury to Lessee(s) or his/her family or family's property from whatever cause arising from the occupancy of said premises by Lessee(s) and his/her family. Additionally, No right of storage is given by this rental agreement, and the Owner and Lessor shall not be liable for non-delivery of messages, or for any loss of property due to fire, theft, burglary, flooding, war, insurrection, riot, act of God, or otherwise from said premises or building, nor for any accidental damage to person or property in or about the leased premises or buildings resulting from electrical wiring, water, rain, or snow, which may come into or issue or flow from any part of said building or property, or from any pipes, plumbing, gas, sprinklers, or electrical connections thereof, or that may be caused by Lessor employees or any other cause whatever, and the Lessee(s) hereby covenant and agree to make no claim for any such loss or damage. It is understood, if the Lessee is out of town and the apartment is unoccupied, the Lessor must enter the apartment and open the cupboard under the sink to keep pipes warm during sub-zero weather. Lessor will contact Lessee via text prior to entrance. ______intls.
11.) The Lessee(s) hereby gives the Owner, in addition to the lien given by law, a lien upon all property situated upon the said premises, including all furniture and household furnishings, whether said property is exempt from execution or not, for the rent agreed to be paid hereunder, for any damage caused by the Lessee(s), by any guest or visitor of the Lessee(s), or by any pet(s) of the Lessee(s), and for Court costs and attorney's fees incurred under the terms hereof. Said lien may be enforced whenever rent is due and unpaid, regardless of whether or not a three-day notice to pay or quit shall have been served. Enforcement of the lien shall not operate to waive any other rights of the Lessor in unlawful detainer, or otherwise. If rent is still due and unpaid thirty (30) days after the enforcement of said lien, the Lessor may sell any or all personal property taken possession of as herein provided, and may apply any monies received against the unpaid rent, and against any storage charges, and any other cost of fees incurred by the Owner or Lessor.
12.) Violations of any provision of this lease by any Lessee(s), or any person on the premises with Lessee(s) consent, or any failure to pay rent upon the date due, shall result, at the option of the Lessor, in the immediate termination of this lease without notice of any kind, or at the option of the Lessor, giving written notice of such intentions, which notice shall set forth the default/violation of Lessee(s) relied upon by Lessor, and Lessor shall thereupon be entitled to enter and take and retain possession of the premises thereof and exclude Lessee(s), either with or without process of law, and may remove Lessee(s) and his/her possessions, using such force as may be necessary to do so, without being liable to prosecution or in damages therefore, and Lessee(s) shall peaceably surrender the premises to the Lessor.
13.) The acceptance by Lessor of partial payments of rent due shall not, under any circumstances, constitute a waiver of any rights of Lessor at law or under this lease. Nor shall it affect any notice of legal proceedings in unlawful detainer theretofore given or commenced.
14.) It is understood and agreed that the Lessor, or their authorized agent, with a 24-hour notice, (via email, call, or text) shall have the right to enter and inspect the premises at all reasonable times to ensure maintenance, upkeep, and safety of premises. It is also understood and agreed to that the Lessor, or their authorized agent shall have the right to enter and inspect the premises at all reasonable times, and after notice has been given by Lessor by telephone, facsimile, or hand delivery to show the property to any prospective buyer, to show the property to any loan or insurance agent, and to show the residence to new prospective Lessee(s) after notice to vacate has been issued, or received. It is understood that the Lessor shall enter the premise without notice, only in the case of an emergency, i.e. smoke coming from apartment, water coming from apartment.
15.) The Lessee(s) shall not transfer his/her interest in and to this rental agreement, nor shall Lessee(s) assign or sublet the said premises or any part thereof or, in his/her absence or otherwise, permits others to occupy the residence, or any part thereof, without first having obtained written consent of the Lessor. If the Lessee(s) or sub-Lessee(s) violates the provisions of this paragraph, or any part of this lease, the Lessor may take immediate possession of said premises and in event of litigation, may sue and evict any person or persons occupying said premises without making Lessee(s) a party to said proceedings.
16.) The Lessee(s) shall not keep any animal or pet, nor use premise for unlawful or immoral purpose, nor play any musical instrument or radio or television set or run any machinery before 7AM or after 9PM loud enough to be heard by neighbors. The Lessee(s) shall not operate/provide any babysitting or day care services, nor violate any City, State, or Federal rules, regulations, or ordinances of whatever nature. Lessee(s) shall do nothing that would violate any law or increase insurance rates on the residence or the premises of which it is a part, and shall use the premises only as a single-family residence. Lessee(s) agrees that the covenants contained in this paragraph, and in this lease agreement, once breached, cannot afterward be performed, and that in case of breach, unlawful detainer proceedings may be commenced at once without any notice whatsoever.
17.) It is understood that the violation of any of the conditions of this agreement shall be sufficient cause of eviction from said premises. Lessee(s) agrees to pay all costs of such action, including reasonable attorney's fees, any fines and/or damages as may be fixed by court, and any court costs/fees.
18.) If the Lessor shall be unable to personally deliver to Lessee(s) THREE (3) day notice to terminate this Tenancy Agreement as provided above, the Lessor shall have the right to post said notice on the front door of the premises. If, after THREE (3) days of posting said notice, the Lessee(s) has not vacated the premises, and if the Lessor is still unable to locate the Lessee(s) the Lessor shall have the immediate right to remove any and all remaining personal property on the premises, placing same in storage. Lessee(s) shall be responsible for payment of the amount owed for the loading, moving, and storage of the property, and the Lessor is entitled to hold said property as security for the payment of any and all amounts due the Lessor under the terms of this Rental Agreement and if the amounts due are not paid within 30 days, Lessor shall cause the property to be liquidated in accordance with the Wyoming Uniform Commercial code guidelines and any overage paid to Lessee(s), and any deficit shall remain owing and may be collected using normal legal procedures.
19.) Gas, Electricity, Internet, Cable TV, Water, Sewer, Trash, are the responsibility of the Lessee(s). 231 South Water Street's subscribed speed is 100 mbps, however, is capable to run speeds of 200 mbps, due to location, as per Spectrum. Gas and Electricity are provided to the area by MDU. Water, Sewer, and Trash are available through the City of Sheridan. All can be setup on their website to autopay your account.
20.) Lessee(s) are responsible for snow removal during winter months. Shovels and brooms will be made available to building and tenants. The Sheridan County Bike Pathways are managed by the City of Sheridan and the Lessee(s) are not responsible for snow accumulation on the path by the river.
21.) Owner and Lessor recommend that the Lessee(s) obtain personal/rental insurance in addition to personal liability insurance. The Owner and Lessor has no insurable interest in the Lessee(s) or the Lessee(s)'s personal property or potential liability. The Owner and Lessor will not be liable for any acts of the Lessee(s), or any person on the premises with Lessee(s) consent, or any animal (if any allowed by Owner or Lessor) on the premises belonging to the Lessee(s).
22.) Owner and Lessor reserves the right at any time to change or rescind any or all portions of this Rental Agreement, or to make and enforce such other reasonable rules and regulations as in Owner and Lessor's judgement may be deemed advisable to promote the safety, care, and cleanliness of the premises and for the preservation of good order.
23.) This agreement shall be binding upon and extend to the heirs, representatives, successors, and assigns of the Lessee(s) hereto.
24.) All light bulbs shall be in working order at the time of return of residence/property to Owner and/or Lessor's possession. Any light bulbs not in working order will be replaced by Owner and/or Lessor, and replacement will be charged on a time and materials basis ($30.00/hour plus costs for new bulbs).
25.) Cleaning fees will be charged at a rate of $35.00/hour for all items included, but not
limited to, the enclosed checklist, and which are not satisfactory to the Owner and/or Lessor, as determined by Owner and/or Lessor, at time of completion of checklist prior to Lessee(s) vacating property, and prior to Owner and/or Lessor taking back possession of property.
26.) Lessee(s) specifically agree that no tacks, nails, screws, or other fasteners will be driven into any woodwork, trim, and/or window or door casings. Lessee(s) also specifically agrees that no tacks, nails, screws, or other fasteners be driven or utilized in the walls or ceilings without permission of the Lessor. Lessee(s) are also responsible for and agree to pay for any damage done by wind or rain caused by Lessee(s) leaving windows or doors open, by overflow of water, or by stoppage of waste pipes.
27.) Owner and Lessor recommend that the Lessee(s) obtain personal/rental insurance in addition to personal liability insurance. The Owner and Lessor has no insurable interest in the Lessee(s) or the Lessee(s)'s personal property or potential liability. The Owner and Lessor will not be liable for any acts of the Lessee(s), or any person on the premises with Lessee(s) consent, or any animal (if any allowed by Owner or Lessor) on the premises belonging to the Lessee(s). ____intls.
28.) Lessee(s) is solely responsible for the care taking of the lawn, trees, and other landscaping vegetations. Failure to properly care for, at the Lessor's discretion, the lawn, trees, and other landscaping vegetations can result in a termination of this lease agreement, after two (2) written notices of improper care from the Lessor. Lessee(s) is also solely responsible for snow removal and keeping clear the porch, sidewalk, driveway, and other traveled areas of snow, ice, and all other items or elements which would create a safety hazard for the Lessee(s) and their family, or for any other person who may visit or cross the premises.
29.) It is expressly understood and agreed that the Owner of said premises, or said Lessor(s) will not be liable for any damages or any injury to Lessee(s) or their family or family's property from whatever cause arising from the occupancy of said premises by Lessee(s) and their family.
