A. The Law.
Several state and federal laws have been enacted to ensure the equal opportunity for all people in the buying, selling, leasing and renting of a home or rental property. The Civil Rights Act of 1866 prohibits all racial discrimination in the sale or rental of real property. The Fair Housing Act declares a national policy of fair housing throughout the United States, making illegal any discrimination in connection with the purchase, sale, lease or rental of housing, or making housing otherwise unavailable, because of race, color, religion, sex, handicap or disability, familial status, national origin, sexual orientation or gender identity.
In addition, other state and local laws often provide broader coverage and prohibit discrimination based on additional classes not covered by federal law. For example, Utah law requires that all persons will be treated fairly and equally in connection with the lease or rental of a dwelling without regard to race, color, religion, sex, familial status, disability, national origin, source of income, sexual orientation, or gender identity." See Utah Code 57-21-5 to -7 (2019).
B. The Subject Property.
The real estate located at 224 and 226 W. 400 N., Salt Lake City, Utah 84103 (the "Subject Property") is subject to the federal Fair Housing Act ("FHA") and the Utah Fair Housing Act ("UFHA"). It is the policy of the owner of the Subject Property ("Owner") and the property manager hired by the Owner to manage the Subject Property ("Property Manager") to comply with the FHA and the UFHA by ensuring that all dwellings in the Subject Property are available to all persons without regard to race, color, religion, sex, handicap or disability, familial status, national origin source of income, sexual orientation, gender identity, or any additional protected class under applicable law. Pursuant to this Policy and applicable law, the Owner and Property Manager, and their respective employees and agents that have responsibility for renting, managing, or administering the dwellings in the Subject Property will not discriminate in any aspect of the lease or rental of the dwellings against qualified applicants or tenants because of race, color, religion, sex, handicap or disability, familial status, national origin, source of income, sexual orientation, gender identity, or any additional protected class.
More specifically, the Owner and Property Manager, and their respective employees and agents, may not:
Refuse to rent, or negotiate for the rental of, or otherwise make unavailable or deny, a dwelling to any person because of any protected class;
Discriminate against any person in the terms, conditions, or privileges of rental of a dwelling, or in the provision of services or facilities in connection therewith, because of any protected class;
Make, print, or publish, or cause to be made, printed, or published any notice, statement, or advertisement, with respect to the rental of a dwelling that indicates any preference, limitation, or discrimination based on any protected class, or an intention to make any such preference, limitation or discrimination; or
Represent to persons because of any protected class that any dwelling is not available for inspection or rental when such dwelling is in fact so available.
This Policy prohibits any form of harassment or discrimination based on any of the protected classes identified above. Words or conduct that are related to any protected category, and are offensive to a reasonable person, are prohibited and a violation of this Policy.
In accordance with Utah law, this Policy requires that all persons will be treated fairly and equally in connection with the lease or rental of a dwelling in the Subject Property without regard to race, color, religion, sex, familial status, handicap or disability, national origin, source of income, sexual orientation, or gender identity. See Utah Code 57-21-5 to -7 (2019). All housing-related contracts, applications, leases and tenant or resident rules pertaining to the Subject Property shall contain the following language: "All persons will be treated fairly and equally in connection with the lease or rental of a dwelling in the Subject Property without regard to race, color, religion, sex, familial status, disability, national origin, source of income, sexual orientation, or gender identity."
Applicants, residents, and employees are encouraged to report any violation of this Policy to the Owner, the Property Manager, or any of their employees or agents, for investigation and appropriate action. No retaliatory action will be taken against any person who in good faith reports words or conduct which the person reasonably believes may violate this Policy. No retaliatory action will be taken against any individual who in good faith assists or participates in any investigation, proceeding, or hearing relating to a complaint of harassment or discrimination.
Any employee or agent of the Owner or Property Manager who fails to comply with this Policy will be subject to appropriate disciplinary action.
