Rent-to-Own Lease Agreement

1. Lease Term and Ownership Option
This Rent-to-Own Agreement is for a total term of three (3) years, beginning on [Start Date] and ending on [End Date].
The Tenant shall lease the property with the exclusive option to purchase it at any time during or at the end of the 3-year term, provided all terms of this agreement are met. Upon completion of the purchase, ownership of the property at 2050 Meador Ave, Atlanta, GA 30315 will transfer to the Tenant.
2. Monthly Rent
Tenant agrees to pay monthly rent in the amount of $3500, due on the 28 of each month. Rent payments must be made on time to remain eligible for the purchase option.
3. Option to Purchase
The Tenant shall pay a non-refundable option fee of 5% of the total home value. If the tenant does not purchase the house within 3 years then the nonrefundable option fee will be kept by the owner of the property.
The option fee will be credited toward the purchase price at closing, if the Tenant exercises the option to buy the property.
The Tenant may exercise the option to purchase at any time during the lease term, but no later than the end of the three-year period.
4. Security Deposit
Tenant shall pay a security deposit of $7,000, which shall be held by the Landlord. The deposit is refundable at the end of the lease term, less any lawful deductions for damage beyond normal wear and tear then the security deposit will not be given back if the property is damaged.
5. Utilities and Services
Tenant is responsible for all utilities and services, including but not limited to:
Electricity
Water
Internet
Security camera system and monitoring
Phone services
Lawn Maintenance - grass cut front and back
Failure to maintain utilities in active service may be considered a breach of this agreement.
6. Maintenance and Repairs
Tenant shall maintain the property in good, clean condition throughout the lease term. The Tenant shall be responsible for routine maintenance and minor repairs. Major structural repairs remain the Landlord's responsibility unless damage results from the Tenant's negligence or misuse.
7. Smoking Policy
Smoking is strictly prohibited anywhere inside the property until the Tenant becomes the legal owner of the property.
8. Pet Policy
One (1) pet is permitted on the premises. Tenant agrees to maintain the pet responsibly and will be liable for any damage caused by the pet. Pet-related damages may be deducted from the security deposit as applicable.
Pet fee $100 a month
Pet Deposit $200 one time.
9. Default
Failure to pay rent, option fees, or comply with the terms of this agreement may result in termination of the lease, loss of possession of the property, and forfeiture of the non-refundable option fee.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia.
11. Entire Agreement
This document constitutes the entire understanding between the Landlord/Seller and Tenant/Buyer. Any modifications must be made in writing and signed by both parties.
