1. TERMS: RESIDENT agrees to pay in full the amount of $2,800 per month on or before the 1st day of each month to OWNER. This agreement shall commence on May 1st, 2025 and continue through April 30th, 2026, unless otherwise determined via written agreement between OWNER and RESIDENT.
2. PAYMENTS: Rent and/or other charges are to be paid at such place or method designated by OWNER as follows: Electronic transfer of funds through the smartphone application "Venmo" . OWNER acknowledges receipt of a security deposit of $2,800 upon signing of this lease. The first month's rent payment of $2,800 is due before May 1st, 2025.
3. SECURITY DEPOSITS: The security deposit of $2,800 shall secure compliance with the terms and conditions of this agreement and shall be refunded to RESIDENT within thirty (30) days after the premises have been completely vacated, less any amount necessary to pay OWNER a) any unpaid rent or utilities, b) cleaning costs, c) key replacement costs, d) costs for repair of damages to premises above ordinary wear and tear, e) costs for replacement or repair of lost or damaged furniture or appliances of OWNER, and f) any other amount legally allowable under the terms of this agreement. OWNER reserves the right to charge RESIDENT additional fees to cover the above expenses, beyond the amount of the security deposit, if necessary. Professional cleaners including steam cleaning will be hired before moving in. These cleaners will be hired again after moving out unless specified that this will be taken care of by tennant. A written accounting of all said charges shall be presented to RESIDENT within 30 days of the premises being completely vacated by RESIDENT. Damages to the home or property should be reported to the owner immediately to avoid controllable continued damage and limit additional charges that may apply.
4. LATE CHARGE: An initial late fee of $50 shall be added to any payment of rent made beyond the 5th day(s) after the due date. RESIDENT shall incur and be charged additional late fees of $50 per 5 days thereafter. Late fees may be waived only if agreed by OWNER in writing.
5. UTILITIES: RESIDENT agrees to pay OWNER for all utility costs incurred during the lease term. OWNER will send a utility bill and statement, along with usage and cost breakdowns, to RESIDENT when available each month. Or RESIDENT can switch utilities in the first month over to their own name and fiscal responsibility. RESIDENT agrees to submit utility payments to OWNER within 30 days of receiving each utility bill from OWNER. Utility costs include internet (through NextLight which is incredibly fast), trash, recycling, compost, water, and electricity (through the City of Longmont), and gas (through Xcel Energy).
6. PETS: A maximum of 2 pets are allowable at the premises and only upon the written consent of the owner. Consent by OWNER shall be for a specific dog(s) or cat(s) as identified in this agreement and is not transferable to other dogs or cats. Dogs or Cats that are aggressive, hostile or threatening to the owner, or neighbors or other animals are not permissible. Dogs or cats that damage the premises or furnishings are not permissible. For damages please reference Section 3- Sentence D. A dog or cat that is initially approved
by OWNER and identified on this Agreement, but that is, or becomes a nuisance to the neighbors or a danger
to people or other animals is not permissible and shall be a breach of this Agreement. RESIDENT agrees to
follow all City of Longmont Laws related to pets within the Neighborhood.
7. PARKING: RESIDENT may park in the driveway on the premises, anywhere allowable on Calkins Ave or surrounding streets, or inside the garage if space is available. No documentation shall be required for parking on the premises or on the neighborhood streets, unless otherwise noted.
8. SMOKING & FIRE: Smoking of cigarettes or tobacco products inside of the house is prohibited. Smoking of marijuana inside of the residence is permitted, but outdoors or in the garage is preferred. RESIDENT is also required, in relation to smoking as well as using the fireplace, chiminea, or other items such as candles or incense, to be aware of fire dangers in the area during the lease term, and to cooperate with safe practices of using fire and disposal of ash. RESIDENT, guests of RESIDENT, and any persons visiting the premises are required to follow these guidelines. Damages caused by fires inside or out will be addressed on a case by case basis and should be alerted to OWNER immediately, as with all damages.
9. TERMINATION: This agreement shall be automatically terminated on April 30th, 2026, unless otherwise determined via written agreement between OWNER and RESIDENT. The premises shall be considered vacated only after all areas, including storage areas, are clear of all of RESIDENT'S belongings, and keys and other property furnished for RESIDENT'S use are returned to OWNER. Should the RESIDENT hold over beyond the termination date or fail to vacate all possessions on or before the termination date, RESIDENT shall be liable for additional rent and damage charges, which may include damages due to OWNER'S loss of prospective new tenants, legal costs, city charges. Extension of this rental agreement or an alternative rental agreement is possible following the termination date, if agreed upon and documented via writing by both OWNER and RESIDENT, but is not guaranteed.
10. INSURANCE: RESIDENT acknowledges that OWNER's insurance does not cover personal property damage caused by theft, fire, rain, wind, temperature, other acts of nature or God, acts of others, and/or any other causes, nor shall OWNER be held liable for such losses. RESIDENT is hereby advised to obtain an insurance policy to cover any personal losses.
11. RIGHT OF ENTRY AND INSPECTION: OWNER may enter, inspect and/or repair the premises at any time in case of emergency or suspected abandonment. For the purposes of showing the premises during normal business hours to prospective renters, buyers, or lenders, for smoke alarm inspections, and/or for normal inspections and repairs, or other reasons, OWNER shall give a minimum of 24 hours notice before entering the premises. OWNER is permitted to perform or hire others to perform all alterations, repairs and maintenance that are deemed necessary based on OWNER'S judgment.
12. ASSIGNMENT: RESIDENT agrees not to transfer, assign or sublet the house or any part of the premises without the explicit permission of OWNER. This includes, but is not limited to, renting, subletting or selling accommodations through AirBnB and VRBO.
13. RENTAL INCLUSIONS: RESIDENT acknowledges receipt and acceptance of the "Rental Inclusions" agreement, which documents the property that OWNER is leaving on the premises for use by RESIDENT during the lease term. Such property includes specified furniture, the hot tub, designated appliances, and other specified items as laid out in the "Rental Inclusions" document.
14. ENTIRE AGREEMENT: This Agreement constitutes the entire arrangement between OWNER and RESIDENT. No oral agreements have been entered into, and all modifications or notices shall be in writing to be considered valid.
15. RECEIPT OF AGREEMENT: The undersigned RESIDENT has read and understands this Agreement and hereby acknowledges receipt of a copy of this Rental Agreement.
