Premises The Landlord agrees to lease the following property to Tenant: 1620 Cliffdale Road, El Cajon, CA 92020. The rental includes three stories of the four-story home, which contains four bedrooms and two full bathrooms. 2. Term of Lease The term of this Agreement is for 12 months. After the lease term, the Agreement will convert to a month-to-month tenancy unless otherwise agreed in writing. 3. Rent and Payment Rent is $3,500.00 per month, payable on or before the first day of each month. Rent payments shall be made via Venmo or CashApp A late fee of 5% of the monthly rent shall be charged if rent is not received within 5 days of the due date. Failure to pay rent, including late fees, within 10 days of the due date shall constitute a breach of this Agreement and may result in termination and eviction proceedings. 4. Security Deposit Tenant shall deposit with Landlord the sum of $5,000.00 as a Security Deposit. The Security Deposit is to cover any damage or excessive wear and tear to the property. It will be returned within 21 days after the end of tenancy if there is no damage beyond ordinary wear and tear, unpaid rent, or other unpaid fees. 5. Utilities Tenant is responsible for the payment of all utilities, including but not limited to electricity, water, gas, sewage, trash removal, cable, internet, and other applicable services. The cost of utilities will be calculated based on individual meters or prorated appropriately, and the Landlord will provide a monthly statement to the Tenant with the breakdown. 6. Occupancy Limits The premises may only be occupied by a maximum of [number of adults and children] people. Overnight guests are limited to 14 nights per year, unless prior written approval from the Landlord is obtained. 7. Pet Policy Pets are allowed under this Agreement.Tenant must ensure pets are licensed, vaccinated, and do not cause damage to the property. Tenant is responsible for cleaning up after pets and will be liable for any damage caused by pets. 8. Subletting and Assignment Tenant is prohibited from subletting or assigning the lease to another party without the prior written consent of the Landlord. Violation of this clause will result in immediate termination of the lease and forfeiture of the Security Deposit. 9. Maintenance and Repairs Tenant is responsible for keeping the premises clean, safe, and in good condition. Tenant shall promptly notify the Landlord of any damage or necessary repairs. Any repairs or maintenance under $500 shall be the responsibility of the Tenant unless required by California law to be borne by the Landlord. The Landlord is responsible for major repairs, such as structural issues or plumbing failures, but not for damages caused by the Tenant's negligence. 10. Entry by Landlord The Landlord may enter the premises to inspect, repair, or show the property to potential tenants or buyers, upon providing 24 hours' notice as required by California law. In cases of emergency, the Landlord may enter without prior notice. 11. Insurance Tenant is required to obtain Renter's Insurance and provide proof of such insurance to the Landlord prior to the start of the lease term. The insurance must cover damage caused by the Tenant, pets, and liability for injury to others. 12. Prohibited Conduct No illegal activity, including drug use or sales, is permitted on the property. Smoking is prohibited inside the premises. No parties, loud music, or disturbances that affect neighbors are allowed. Violation of this clause will result in immediate termination of the lease. 13. Mediation and Legal Disputes In case of any disputes, both parties agree to first attempt resolution through mediation. If mediation fails, both parties reserve the right to seek legal remedies. The Tenant agrees to indemnify and hold harmless the Landlord from any claims arising from the Tenant's occupancy, including personal injury or property damage, unless caused by the gross negligence of the Landlord. 14. Termination and Renewal Either party may terminate this lease upon providing 30 days' written notice before the end of the lease term. If the Tenant breaches any part of this Agreement, the Landlord may terminate the lease and seek eviction, retaining any rent or deposit amounts for damages. 15. Damage to Premises Tenant shall not remove any fixtures or make alterations to the property without prior written consent from the Landlord. Tenant is responsible for any damage beyond normal wear and tear. In the event of damage caused by the Tenant, the Landlord will provide an estimate, and the cost will be deducted from the Security Deposit. 16. Severability If any part of this Agreement is found to be illegal or unenforceable, the remainder of the Agreement shall remain in full force and effect.
