Your dream rental awaits come and explore it before it's gone. 1. LEASE TERM 1.1. Fixed Term: The lease shall commence on [START DATE TO BE DETERMINED] and shall terminate at midnight on [END DATE TO BE DETERMINED], constituting a total of 12 months. 1.2. Holding Over: If Tenant remains in possession of the Premises after the expiration of this fixed term without written renewal, such holding over shall be deemed a month-to-month tenancy under the same terms and conditions, unless otherwise agreed in writing. 2. RENT 2.1. Monthly Rent: Tenant agrees to pay a monthly rent of Four Thousand Eight Hundred Dollars ($4,800.00). 2.2. Due Date: Rent is due and payable on the 1st day of each month without demand or notice. 2.3. Accepted Payment Methods: Rent shall be paid via online transfers or Zelle to the account(s) designated by Landlord. Landlord may, at Landlord's discretion, accept other forms of payment but is not obligated to do so. 2.4. Late Fee: If rent is not received by the 5th day of the month, a late fee of $240.00 will be charged. This fee does not waive Landlord's right to take legal action for nonpayment. 2.5. Returned Payment Fee: If any payment is returned or declined for insufficient funds, Tenant shall pay all related bank charges or fees in addition to any late fees. 3. SECURITY DEPOSIT 3.1. Amount: Tenant shall deposit a total of Nine Thousand Six Hundred Dollars ($9,600.00), which equals first month's rent plus last month's rent, as the Security Deposit. 3.2. Interest-Bearing Account: In compliance with Florida Statutes, this deposit shall be held in an interest-bearing account in a Florida banking institution. Any interest accrued on the Security Deposit shall be handled in accordance with Florida law. 3.3. Use of Deposit: Landlord may use the Security Deposit to cover unpaid rent, damage to the Premises beyond normal wear and tear, or other charges allowed by law or the terms of this Agreement. 3.4. Return of Deposit: If no claim is made against the Security Deposit, Landlord shall return the deposit within 15 days after Tenant vacates the Premises. If Landlord intends to make a claim, Landlord shall provide written notice of the claim within 30 days of Tenant's move-out, returning any remaining balance thereafter, all in compliance with Section 83.49 of the Florida Statutes. 4. MAINTENANCE & REPAIRS 4.1. Landlord's Responsibilities: Landlord is responsible for maintaining the structural integrity of the Premises and for the repair or replacement of major systems and appliances, including plumbing, electrical, HVAC, and any major appliances provided by Landlord. 4.2. Tenant's Responsibilities: Tenant shall: Keep the Premises clean and in good order, including routine cleaning. Perform minor maintenance such as replacing light bulbs and air filters. Promptly report, in writing, any issues or needed repairs. Ensure the Premises are safe and sanitary. 4.3. Maintenance Requests: Non-Emergency: All non-emergency repair requests must be submitted in writing (e.g., email or text message) to Landlord. Emergency: For emergencies (e.g., major leaks, fire, or dangerous conditions), Tenant shall immediately attempt to contact Landlord by phone and follow up in writing as soon as practicable. 5. UTILITIES & SERVICES 5.1. Tenant's Responsibility: Tenant shall be responsible for placing and paying for the following utilities and services in Tenant's name (where applicable): Electricity Water Gas Internet Trash collection Pool service Landscaping/Lawn Care 5.2. Account Setup: Tenant shall activate or transfer all required utilities into Tenant's name on or before the move-in date to avoid disruptions. 6. USE AND OCCUPANCY 6.1. Residential Use Only: The Premises shall be used only as a private residence by the Tenant and authorized occupants listed in this Agreement. 6.2. No Illegal Activities: Tenant and any guests shall not engage in or permit any illegal or disruptive activities on or near the Premises. 6.3. Subletting/Short-Term Rentals: Subletting, Airbnb-style rentals, or any other short-term rental arrangements are strictly prohibited without the prior written consent of the Landlord. 6.4. Authorized Occupants: Only the individuals named in this Agreement may reside in the Premises. No additional persons may occupy the Premises for more than 14 consecutive days without Landlord's written consent. 7. PET POLICY 7.1. Pets Allowed: Pets are permitted on the Premises, subject to compliance with all applicable local laws and any breed or size restrictions (if stated by Landlord or local ordinances). 7.2. Tenant's Obligations: Tenant shall be liable for any damage caused by pets. Tenant must ensure pets do not become a nuisance or danger to neighbors or the Premises. Tenant shall promptly remove and properly dispose of any pet waste. 7.3. Service/Emotional Support Animals: Nothing in this Section is intended to conflict with applicable fair housing laws regarding service animals or emotional support animals. 8. INSURANCE 8.1. Renter's Insurance: Tenant is required to obtain and maintain a renter's insurance policy covering personal property and liability. 8.2. Liability Disclaimer: Landlord shall not be liable for any loss or damage to Tenant's personal property or for any personal injuries due to Tenant's negligence. 9. DEFAULT & EVICTION 9.1. Nonpayment of Rent: Failure to pay rent on time constitutes a default. In such cases, Landlord may deliver a 3-day notice as required under Florida law. If Tenant fails to cure the default within the statutory time frame, Landlord may commence eviction proceedings. 9.2. Material Violations: Serious violations of this Agreement that may lead to eviction (if not cured within any lawful notice period) include, but are not limited to: Unauthorized occupants or pets. Significant property damage beyond normal wear and tear. Illegal activities on the Premises. Subletting or short-term rental in violation of this Agreement. 9.3. Legal Remedies: In the event of default, Landlord may pursue any rights and remedies available under Florida law, including eviction and recovery of damages, court costs, and attorney's fees (if awarded by the court). 10. ADDITIONAL TERMS 10.1. Access for Repairs/Inspections: Landlord or Landlord's agents may enter the Premises for repairs, inspections, or to show the property to prospective tenants/buyers with reasonable notice as required by Florida law (generally 12 hours' notice for non-emergency situations, unless Tenant otherwise agrees). 10.2. Governing Law: This Agreement shall be governed by the laws of the State of Florida, particularly Chapter 83 of the Florida Statutes (Florida Residential Landlord and Tenant Act). 10.3. Severability: If any provision of this Agreement is deemed unenforceable, the remaining terms shall remain in full force and effect. 10.4. Entire Agreement: This Agreement constitutes the entire understanding between the parties. Any amendments or modifications shall be made in writing and signed by both Landlord and Tenant. 10.5. Disclosures: Landlord shall provide all disclosures required by Florida law (e.g., lead-based paint disclosure if the property was built before 1978, radon gas disclosure, etc.). 10.6. Move-Out Procedures: Tenant shall leave the Premises in a clean condition, return all keys, and coordinate a walk-through if requested by Landlord. 10.7. Notice: Except where oral notice is permitted by law for emergencies, any notice required under this Agreement shall be in writing and delivered by personal delivery, certified mail, or email/text (if both parties agree to electronic communication).
