If a Rent Payment is not paid by 5:00 p.m. on the 5th day of the month, Tenant will pay an additional $25.00 rent on the 6th day of the month, plus an additional $2.00 rent for every day thereafter, until all unpaid rent is paid. In this context, Rent Payment is not considered "paid" until it has been received by Landlord. Smoking. No smoking is permitted anywhere IN said leased dwelling or near the Leased Premises. Accordingly, Tenant and Tenant's guests may not smoke anywhere near the dwelling, the building in which the dwelling is a part, or in any of the common areas or adjoining grounds of such building. If evidence of smoking is found in said lease dwelling that security deposit of $800 will be subject to a cleaning up to eviction. Occupancy. Only those individuals named as "Tenant" of this Lease, and their children, may occupy the Leased Premises as their private residence. Tenant may permit guests to stay with Tenant in the Leased Premises for no more than ten (10) consecutive days in any given month without prior written permission from the Landlord. Any guests of Tenant must abide by the applicable terms and provisions of this Lease, and Tenant shall be liable for any acts or omissions of Tenant's guests. If, during the Rental Term, Tenant desires to change the number or identity of the listed "Tenant", Tenant must request such from Landlord. Landlord, at its sole discretion, may approve such request but may make additional requirements prior to approval, including, but not limited to, a new application and new lease addendum. Parking. Tenant must not park, or allow parking, on the grass at any time. Vehicles that are not in operating condition are not allowed on the Leased Premises. Tenant is allowed one vehicle on the Leased Premises per adult occupant of the Leased Premises. If street parking is permitted by applicable laws and available, Tenant may park vehicles on the street in front of the Leased Premises in accordance with all such laws. Notwithstanding the foregoing, Landlord assumes no responsibility and is not liable for any damage or loss to Tenant's vehicles, Tenant's guest's vehicles, or any personal property contained in such vehicles. Sublease; Landlord's Signs. Tenant does not have the right or power to assign this Lease or to sublet all or any part of the Leased Premises. Likewise, Tenant may not list the Leased Premises for short-term rental, including through services such as Airbnb, VRBO, or any similar service. Landlord may place "for rent" or similar signs or notices on the Leased Premises If Tenant is locked out of the Premises, and Landlord must unlock the door for Tenant, then Tenant will be charged a $20.00 service charge OR service charge to fix negligence toilet plumbing charge of $50.00 up to $1000. (b) Landlord will make repairs that are necessary due to "old age" malfunction of the plumbing, central heating and air conditioning system, hot water heater, or garbage disposal where not caused by Tenant negligence or default. However, the cumulative total of such expenditures must not exceed $1,000.00 per annum. If any such expenditure exceeds or would exceed the aggregate amount of $1,000.00 in one (1) year, Landlord reserves the right not to make any repairs that would bring the aggregate amount of per annum repairs beyond $1,000.00. Tenant has the right to have any such repairs made, provided that Tenant first obtains Landlord's approval in writing of the repairs to be made and the name and address of the business who is to make the repairs and the repairs are made in a satisfactory manner. Notwithstanding the foregoing, Tenant shall be responsible for all costs related to any repair or maintenance of any plumbing stoppage or slow-down caused by Tenant, whether accidental or purposeful. Tenant agrees not to place into any drain lines of the Premises any nonapproved substances, including, but not limited to, cooking grease, sanitary napkins, diapers, children's toys, or other similar objects that may cause a stoppage or clog. Tenant must notify Landlord of any plumbing leak or slow drainage within twenty-four (24) hours after becoming aware of the problem. Tenant may only use a plunger to attempt to fix a slow or stopped drain, and Tenant may not pour chemical or other drain cleaners into any stopped or slow drains. (d) Tenant must leave the water dripping during freezing weather to prevent the water pipes from freezing. Tenant will be responsible for any plumbing system freeze-ups occasioned by Tenant's negligence. Landlord shall provide air conditioning and heating system filters at least every 90 days and reserves the right to install in order to inspect the dwelling. Pets and Animals. (a) No animals, dogs, cats, or other pets, are allowed to be kept at the Leased Premises, except with express prior written consent of the Landlord in Landlord's sole discretion and subject to Landlord's right to require a pet security deposit as provided in paragraph 10(b). (b) If allowed by Landlord, no more than one (1) dog or one (1) cat may be kept at the Leased Premises, provided Landlord is given advanced notice of the intent to have a pet on the Leased Premises, Tenant identifies to Landlord's satisfaction, Landlord approves at its sole discretion, the type of and/or actual dog or cat to be maintained at the Leased Premises, and Tenant will pay a fee of in the amount of $15.00 a month for the pet. Notwithstanding anything herein to the contrary, under no circumstances will a pit bull or American Pit Bull Terrier, whether full blood or mixed, be kept or allowed on the Leased Premises. Tenant is responsible for the pet and must repair or replace any articles damaged by the pet and clean the yard at least once a week Lawn Care, Trash and Garbage. Tenant must maintain the Leased Premises, including all grounds and surrounding areas, clear of rubbish, waste, trash, and garbage, and must keep same in a neat and orderly condition. Landlord is responsible for lawn care. Storage. All personal property placed in the Leased Premises or in any other portion of said building or any place appurtenant thereto, must be at the risk of Tenant, or the parties owning same, and Landlord must in no event be liable for the loss of or damage to such property. Utilities. Tenant shall contract for and pay the services for all utilities through connections as now made on the Leased Premises, including, but not limited to, water, sewer, electricity, gas, heat, air conditioning, and garbage (the "Utilities"). Tenant shall maintain service of Utilities during the Rental Term. 17. Abandonment. If the Leased Premises are abandoned or become vacant during any term of this Lease, without Tenant having paid in full the rent for the Rental Term (or the Renewal Term if applicable), then Landlord will exercise the following rights at its option: (a) to take possession of the Leased Premises and let the same as agent of Tenant and apply the proceeds received from such letting toward the payment of the rent of Tenant under this Lease, and such re-entry and re-letting must not discharge Tenant from liability for rent, nor from any other obligations of Tenant under the terms hereof; or (b) the rent for the entire term must at once become due and payable, and Landlord may proceed to collect the rent for the initial term as if by the terms of this Lease the entire rent for the initial term should be made payable in advance; or (c) Landlord may re-enter the Leased Premises and annul and terminate this Lease. Tenant hereby expressly waives its right to receive notice to vacate otherwise required by the provisions of Article 4701 of the Louisiana Code of Civil Procedure, and further waives any other notice Landlord might be required to furnish prior to any action to evict Tenant or otherwise enforce this Lease. Early Termination Prior to Expiration of the Rental Term. Tenant may terminate this Lease by providing at least thirty (30) days prior written notice to Landlord of intent to terminate the Lease. If Tenant chooses to terminate the Lease without giving a (30) day prior written notice Tenant must pay to Landlord early termination fee of $800.00. Tenant agrees that it is reasonable to compensate Landlord for the time and effort needed to find a new tenant to rent the Leased Premises. Notwithstanding the foregoing, Landlord and Tenant may agree, at Landlord's discretion, to enter into a new Lease with a new Rental Term at any time during the Rental Term. Early Termination Prior to Expiration of the Rental Term. Tenant may terminate this Lease by providing at least thirty (30) days prior written notice to Landlord of intent to terminate the Lease. If Tenant chooses to terminate the Lease without giving a (30) day prior written notice Tenant must pay to Landlord early termination fee of $800.00. Cleaning Fee, Removal Fee, Repair Charges: Tenant must return said leased property in the same condition in which was leased ei trash, debris but not limited to if not cleaned will result in a cleaning fee. Items abandoned by the Tenant in or on said leased premises will be subject to a removal fee, ei furniture, clothing, appliances, but not limited to will be subject to a removal fee. Repair charges, if damages found by the Tenant negligence in or on the leased premises are subject to charges, not from normal wear and tear/old aged. Cleaning fees, removal frees, and repair charges will be deducted from the Tenant's security deposit.
