NOTE: No Commissions will be paid by the seller for this transaction.
The Association previously foreclosed on Unit 914 at Golden Surf Towers Condominium (the “Unit”) and acquired title to the Unit via Certificate of Title in the Association’s foreclosure action for unpaid assessments. The Association’s Board of Directors (“Board”) desires to now sell the Unit and give the opportunity to submit an offer to purchase the Unit. In order to submit a valid offer to be considered by the Association’s Board for the purchase of the Unit, the Association must receive the written offer by 5:00 p.m. on Friday, June 9, 2022. Offers may be submitted in person to the Management Office or via email to the Association’s Manager at pm@goldensurftower.com.
The Association’s Board will subsequently hold a Board meeting to consider the offers and vote on which offer will be accepted. Please note the following in connection with the sale of the Unit:
1) The title will be transferred via a quitclaim deed at the time of closing based on terms and conditions and an agreement to be prepared by the Association's counsel and executed by the purchaser.
2) No representations will be made as to the condition of the Unit and the Unit will be delivered to and accepted by the purchaser in its current "as-is" condition at the time of closing. The purchaser shall be responsible, at the purchaser's own expense, for obtaining its own evidence of title and curing any title defects or accepting title without cure of same. No warranties, express or implied, shall be made by or be enforceable against the Association with regard to the title or for the fitness or suitability of the Unit for any particular purposes or uses or for the physical or environmental condition of the Unit. Moreover, the title for the Unit will be granted without representation or warranty and without recourse against the Association.
3) A title search for the Unit reflected two mortgages, referenced below, that are or may be outstanding. However, the Association makes no representations regarding these mortgages or the existence of other mortgages or any other liens or encumbrances in connection with the Unit. Each owner must conduct his or her own due diligence as to the Unit, title and encumbrances.
1. Mortgage to Washington Mutual Bank, FA, a federal association, mortgagee(s), recorded in O.R. Book 33908, Page 1057 and assigned to JPMorgan Chase Bank, National Association, successor in interest by purchase from Federal Deposit Insurance Corporation as receiver of Washington Mutual Bank fka Washington Mutual Bank, F.A., assignee, by Assignment of Mortgage recorded in Instrument Number 117199212, Public Records of Broward County, Florida.
2. Mortgage to JPMorgan Chase Bank, N.A., mortgagee(s), recorded in O.R. Book 40100, Page 642, Public Records of Broward County, Florida.
4) The Board reserves the right to reject any and all offers and even to cancel the proposed sale of the Unit if necessary without any recourse by those interested in making any offers or any liability.
