TERM: The term of this lease shall commence on September 1, 2025, and continue for a period of one (1) year, ending on August 31, 2026 ("Initial Term"). Unless either party provides written notice of non-renewal at least sixty (60) days prior to the expiration of the Initial Term, this lease shall automatically renew for successive one (1) year terms under the same conditions and terms herein. Any notice of non-renewal must be delivered in writing to the other party before the 60-day deadline to avoid automatic renewal. PAYMENT: The monthly rent for the property shall be $3,000, payable on the first day of each month, beginning September 1, 2025. Rent payments are due on the 1st of every month throughout the term of the lease and shall be considered late if not received by the 5th of the month. If rent is not paid by the 5th of the month, a late fee of 5% may be assessed for each day overdue. All payments shall be made via check, bank transfer, or another agreed-upon method. In the event of an increase in property taxes or HOA/POA dues during the term of this lease, the Landlord and Tenant agree to annually discuss the potential adjustment of the rent payment. If either the property taxes or HOA/POA dues are increased, the Landlord may request a reasonable adjustment to the rent to account for the additional costs. Any such adjustment will be made in good faith and will require mutual written agreement between both parties. The Tenant will be provided with notice of any proposed rent adjustment, and any changes to the rent will be reflected in an addendum to the lease agreement. SECURITY DEPOSIT: A security deposit of $3,000 will be due on September 1, 2025, prior to the Tenant moving into the property. This deposit will be held by the Landlord to cover any potential damages, unpaid rent, or other breaches of the Agreement. After the final inspection of the property upon expiration of the lease, the security deposit will be refunded to the Tenant within 60 days, less any deductions for damages or outstanding charges, if applicable. The Landlord will provide an itemized list of any deductions made from the security deposit. AMENITIES: The monthly payment is inclusive of the dwelling, curbside trash collection, pets, landscaping and maintenance for non-fenced exterior areas, and access to various community amenities. These amenities include the clubhouse, exercise room, business center, pool, playground, and dog park, all of which are available for Tenant use during the term of the lease. UTILITIES: The Tenant will be responsible for the payment of all utilities and services for the property, including electric, water, internet, and cable. These expenses are not included in the monthly rent and must be arranged and paid for directly by the Tenant. The Tenant agrees to maintain all necessary accounts for these services and ensure that payments are made promptly to avoid any interruption in service. The Landlord will provide air filters and refrigerator water filters for the property, which are to be replaced by the Tenant every three (3) months during the term of the lease. The Tenant is responsible for ensuring that the filters are changed at the specified intervals and maintaining the property in good condition. The Landlord will supply the necessary filters, and the Tenant must notify the Landlord if any replacement filters are needed. Failure to replace the filters as required may result in the Tenant being responsible for any related maintenance costs. The Tenant is responsible for maintaining the lawn and landscaping within the fenced area of the property, ensuring it is kept tidy and in good condition throughout the term of the lease. This includes mowing, watering, and addressing any overgrowth or debris within the fenced area. Any lawn areas outside the fenced area, including those maintained by the HOA/POA, will be the responsibility of the HOA/POA and not the Tenant. The Tenant must comply with any HOA/POA rules and regulations regarding exterior maintenance and upkeep. SMOKING: Smoking will not be permitted on any part of the property, including the interior of the townhome and the surrounding exterior areas. If the Tenant is found or suspected to have smoked on the property, the Tenant will be responsible for all cleaning fees associated with removing smoke odors or residue. This may include professional cleaning, carpet replacement and any necessary restoration to return the property to its original condition. PETS: Up to two pets (dogs or cats only) are allowed to reside on the property, and the monthly rent includes the allowance for pets. However, the Tenant will be responsible for any and all damages caused by the pets, including but not limited to damage to the property, landscaping, or furnishings. The Tenant agrees to keep the pets under control at all times and ensure that they do not disturb neighbors. Any costs for repairs or cleaning resulting from damages caused by the dogs will be charged to the Tenant. GUESTS AND VISITORS: Guests and visitors are welcome to visit the property, subject to the following conditions and in accordance with HOA/POA guidelines and Chesterfield County law. The Tenant is responsible for ensuring that their guests and visitors comply with all terms of the lease, including but not limited to noise ordinances, parking restrictions, and community rules. The Tenant is responsible for any actions, damages, or disturbances caused by their guests or visitors. Any violation of these terms may result in a breach of the lease agreement and potential penalties. All guests and visitors must adhere to HOA, POA, and Chesterfield County regulations regarding noise, parking, and other local laws while on the property. SUBLEASE: The Tenant is not permitted to assign this lease or sublease the property, in whole or in part, to any other individual or entity without the prior written consent of the Landlord. Any unauthorized assignment or sublease will be considered a breach of the lease agreement and may result in immediate termination of the lease. The Tenant agrees not to allow any other person to occupy the property, except for those individuals listed in the lease, without the Landlord's approval. VIOLATION: In the event of a failure to pay rent or a violation of the lease terms, the Landlord reserves the right to terminate the lease. If the Tenant fails to pay rent within 20 days of the due date, the Landlord will provide the Tenant with a written notice of non-payment, giving the Tenant 10 days to pay the outstanding rent or remedy the breach before termination proceedings begin. If the Tenant violates any other terms of the lease agreement, the Landlord will provide written notice of the violation and allow the Tenant 14 days to cure the breach. If the breach is not remedied within the specified time, the Landlord may terminate the lease and take necessary legal actions to regain possession of the property. In both cases, if the Tenant fails to resolve the issue within the given notice period, the Landlord may proceed with lease termination and seek eviction, in accordance with applicable laws. EARLY TERMINATION: The Tenant may terminate this Agreement prior to the written notice of non-renewal by providing written notice to the Landlord at least 60 days in advance of the intended termination date. In the event the Tenant terminates the Agreement early, the Tenant agrees to pay an early termination fee of one month's rent in addition to any rent, utilities, or other amounts owed up to the date of termination. Upon early termination, the Tenant's security deposit shall be handled according to the terms set forth in the Agreement, subject to any deductions for damages or unpaid rent. INSPECTION CHECKLIST: An inspection checklist will be reviewed and completed at both the commencement and expiration of this lease agreement. The checklist will document the condition of the property, including any existing damages or issues, to ensure mutual understanding between the Landlord and Tenant. At the start of the lease, both parties will inspect the property together and note any pre-existing damages or conditions. Upon expiration of the lease, a final inspection will be conducted to assess any changes or damages that may have occurred during the term. Any damages beyond normal wear and tear may result in deductions from the security deposit, as outlined in the lease agreement.
