Maintenance and Repair: The Tenant will keep and maintain the Premises, appliances, and equipment in good and sanitary conditions during the term of this Residential Lease Agreement. The Tenant will observe high standards of cleanliness and sanitation and will not perform any acts or incur in any practice whatsoever that will cause damages to the Premises. The Tenant shall keep the Premises, appliances and equipment in good order and repair; and keep the walls free from dirt and debris. The Tenant must return all walls in the same condition as they were upon delivery date. The Tenant is in charge of keeping the kitchen and bathroom drains free of things that may tend to cause clogging of the drains. Plumbing services related to clogged drains will be the full responsibility of the Tenant. The Tenant is accountable for the cleaning out of any plumbing fixture that may need to be unclogged and for the expenses and damages caused by stopping waste pipes or overflow from bathtubs, wash basins, or sinks. The Tenant agrees to promptly notify the Landlord in the event of any damage, defect or destruction of the Premises, or the failure of any of the Landlord's appliances or mechanical systems. Any necessary maintenance or repairs to the Property which cost two hundred fifty ($250) dollars or less shall be performed by the Tenant at their expense, as these are considered typical maintenance and wear-and-tear responsibilities of the Tenant. For repairs exceeding $250, responsibility will be determined based on the nature and cause of the issue. If the repair is due to the Tenant's negligence, misuse, or the actions of their agents, contractors, or guests, the Tenant shall bear the full cost of the repair. If the repair is structural or due to the Landlord negligence the Landlord shall assume full responsibility for the repair. The Landlord, at his/her/its sole discretion, will choose the contractors and services to be used for the repair, and will also, at his/her sole discretion, choose the equipment or appliances that will replace damaged equipment or appliances. The repairs shall commence within the next ten (10) business days, when possible. The Tenant shall not replace appliances with his/her/its own appliances nor with new appliances chosen by him/her/it. If the Tenant fails to comply with the aforementioned condition, the Landlord will not compensate the Tenant for any of the costs. In the case of emergency repairs, which are necessary to prevent significant damage or safety risks, the Landlord must begin repairs within twenty-four (24) hours of notification. If the Landlord fails to do so, the Tenant may hire a contractor to address the issue, and the Landlord will be responsible for the costs, unless the emergency was caused by the Tenant's negligence, in which case the Tenant shall bear the full cost of the repair. The Landlord shall not be liable for damages, of any nature, suffered by the Tenant, as a result of conditions existing or arising in the Premises (unless such damages have been caused by intentional acts of the Landlord). General Maintenance and Repair Rules. Without limiting the Tenants obligations to the following, the Tenant shall: a. Not obstruct the driveways, sidewalks, courts, entryways, which will be used for the purposes of ingress and egress only. b. Keep all windows, glass, doors, locks, and hardware in good, clean order. c. Not obstruct or cover the windows or doors. d. Not hang any laundry, clothing, sheets, etc., from any window, rail, porch, or balcony nor air or dry any of the same within any yard area or space. e. Not cause or permit any locks, hooks or to be placed upon any door or window without the prior written consent of the Landlord. f. Keep all lavatories, sinks, toilets, and all other water and plumbing apparatus clean and in good order. The Tenant will not allow any sweepings, rubbish, sand, rags, ashes, or other substances to be thrown or deposited therein. Any damage to any such apparatus and the cost of clearing stopped plumbing resulting from misuse will be borne by the Tenant. g. Require that the Tenant 's family, occupants and other guests always maintain order in the Premises and at all places on the Premises and will not make or permit any loud or improper noises, or otherwise disturb other residents. h. Keep all radios, television sets, stereos, etc., turned down to a level of sound that does not annoy or interfere with other residents. i. Deposit all trash, garbage, rubbish or refuse in the locations provided therefore and not allow any trash, garbage, rubbish or refuse to be deposited or permitted to stand on the exterior of any community or within the common elements. j. The Tenant shall cooperate in keeping the garbage area neat and clean. k. The Tenant shall be responsible for disposing of items of such size and nature as are not normally acceptable by the garbage hauler. l. Abide by and be bound by all rules and regulations affecting the Premises or the common areas which may be adopted or promulgated by the Homeowners Association. m. Perform quarterly pest control service. n. The Tenant is responsible for regularly cleaning or replacing the air conditioning filters to maintain their proper functionality. o. The Tenant is required to have all HVAC units in the Premises professionally serviced at the 6-month mark of the lease term and again prior to delivering the apartment at the end of the lease. The Tenant must provide the Landlord with proof of completion for both maintenance services. If the Tenant fails to provide proof of A/C maintenance before delivering the apartment, the Landlord will arrange for the service and deduct the cost from the security deposit. p. The Tenant shall notify the Landlord when he/she is going to be absent from the Premises for more than thirty (30) days. When the Tenant is going to be absent from the Premises for more than seven (7) days, the water shut off valve shall be closed, and non-essential electrical appliances should remain off. The tenant will be responsible for any damages resulting from failure to close the water shut off valve and any damages resulting from failure to turn off non-essential electrical appliances.
