Premises located at 1032 Hyco Rd 2. Subletting. Lessee agrees not to sublet the premises or any part thereof, and the premises shall be occupied by those parties specified herein. 3. Terms of this lease shall be for 12 (twelve) months. Either the Landlord or the Tenant may terminate the tenancy at the expiration of the initial term by giving written notice to the other at least 60 days prior to the expiration date; however, the remainder of the initial monthly lease payments will be due and payable in full. In the event such written notice is not given, and the Tenant holds over beyond the initial terms, the tenancy may become a month to month tenancy at the discretion of the Landlord. The terms and conditions contained herein will be revised as needed. 4. Rent. Tenants shall pay, without notice to the Landlord, by the fifth of each month, the amount due of $3000 per month. If rental payment is received on or before the first of each month, the amount will be .00 per month in advance, which reflects a $100.00 discount for having rental payment paid by the first of the month. Rental payment will be set up on EFT to Bank of America and will need to be set to draft by the 25th prior to the month due. 5. Security Deposit. The Tenant shall deposit with the Landlord in the amount of $3000 as non interest bearing security deposit. Under no circumstances will the security deposit apply to the last month's rent, and the last month's rent will not be prorated. It is explicitly understood that if this contract is terminated by the Lessee prior to the "minimum paid rental of 12 months," any and all deposit money advanced by the Lessee will be automatically forfeited. When property is vacated, the landlord will perform a walk-through inspection. If the property has had a final cleaning, grass has been cut, and weed eating performed, no additional yard debris and no damage or unauthorized installations or modifications are noted, the deposit will be refunded. 6. Insurance. Tenants must carry renters insurance to include general liability of one million dollars, and provide a copy of policy prior to occupying the dwelling and Provide renewal as needed. 7. Late Payment or Returned Check Fees. If the rental payment is not paid by the Fifth day after it is due, the Tenant shall pay a late fee of $100.00. Late payment will be due immediately without demand and therefore shall be added to and paid with the rental payment. The Tenant agrees to pay a $50.00 processing fee for each check of the Tenant that is returned by the financial institution because of insufficient funds or because Tenant did not have an account at the institution. 8. Tenant's Duties on Termination. The Tenant shall pay utility bills due and have each utility service disconnected, vacate the premises removing all Tenants personal property, sweep and clean the premises, including plumbing, fixtures, refrigerator, stove, and sink, removing rubbish, trash, garbage, and refuse, make sure grass is mowed and all yard clean up and weed eating has been performed, make repairs and perform such other acts as are necessary to return the premises and appliances and fixtures furnished in the same condition as when the Tenant took possession, provided however, the Tenant shall not be responsible for ordinary wear and tear. The Tenant shall fasten and lock all doors, return all keys, and notify the Landlord of the address to which the balance of the Security Deposit may be returned. If the Tenant fails to sweep out and clean the premises, appliances, yard, and fixtures as provided herein, the Tenant shall become liable, without notice or demand of the Landlord, for a cleaning fee. Such shall reflect the actual cost of cleaning and be deducted from the security deposit. Any and all legal fees to collect rents due and/or damage/alteration expenses will be the sole responsibility of the tenant. 9. Inspection of Premises. Tenant also agrees that, upon notice of moving, property will be made available to show and allow signs to be placed in the front yard.
