Application (background/credit/income check required). FIXED-TERM RESIDENTIAL RENTAL AGREEMENT 1. IDENTIFICATION OF OWNER AND TENANT: This Agreement is made and entered into on 11/01/2025, between ___________________________ hereinafter "Tenant(s)," and ____________ hereinafter, "Owner." 2. IDENTIFICATION OF THE PREMISES: Subject to the terms and conditions below, Owner rents to Tenant(s), and Tenant(s) rent from Owner, for residential purposes only, the premises at 34295 US Highway 6 Unit 213, Edwards, CO 81632 ("Premises"). 3. DEFINING THE TERM OF THE TENANCY: The rental shall begin on 11/01/2025, and shall continue for a period of SIX (6) MONTHS, expiring on 05/01/2026. After the lease expires, tenancy shall continue on a MONTH-TO-MONTH basis unless otherwise agreed in writing by both parties. 4. AMOUNT AND SCHEDULE FOR THE PAYMENT OF RENT: Tenant(s) shall pay to Owner the monthly rent of $3,800.00, payable in advance on the first day of each month. Rent shall be paid to Owner using Zelle, Venmo or Bank Deposit 5. LATE FEES: If Tenant(s) fail to pay the rent in full within five (5) days after it is due, Tenant(s) shall pay Owner a late charge of $300.00. By this provision, Owner does not waive the right to insist on payment of the rent in full on the day it is due. 6. RETURNED PAYMENT CHARGES: In the event any payment offered by Tenant(s) to Owner in payment of rent or any amount due under this Agreement is returned for lack of sufficient funds, Tenant(s) shall pay to Owner a returned check charge in the amount of $35.00. After two (2) returned payments, Owner will only accept money orders, cashier's checks, or other certified forms of payment. 7. SECURITY DEPOSIT: On signing this Agreement, Tenant(s) shall pay to Owner the sum of $3,800.00 as a security deposit. Owner may withhold only that portion of Tenant(s)' security deposit necessary to remedy unpaid rent, repair damages beyond normal wear and tear, or cleaning of the premises if necessary. The balance of the deposit, if any, shall be returned within twenty-one (21) days after Tenant(s) vacate. 8. UTILITIES: All essential utilities and services, including water, trash, snow removal, and HOA fees, are included in rent. 9. LIMITS ON USE AND OCCUPANCY: The premises are to be used only as a private residence for Tenant(3) listed in Clause 1 of this Agreement, and for no other purpose without the Owner's prior written consent. Guests may stay up to ten (10) consecutive days in any six-month period. Longer stays require Owner's written approval. 10. PROHIBITION OF ASSIGNMENT AND SUBLETTING: Tenant(s) shall not sublet any part of the premises or assign this Agreement without prior written consent of the Owner. 11. CONDITION OF THE PREMISES: Tenant(s) acknowledge that they have examined the premises, including appliance fixtures and paint, and found them to be in good, safe, and clean condition and repair, except as otherwise noted. Tenant(s) agree to maintain the premises in good order and return it in the same condition, except for normal wear and tear. 12. POSSESSION OF PREMISES: Failure of Tenant(s) to take possession shall not relieve them of their obligation to pay rent. If Owner cannot deliver possession for reasons beyond Owner's control, Owner shall not be liable except to return any prepaid sums. 13. PETS: Pets are permitted only with Owner's written consent and a $200.00 refundable pet deposit. Tenant(s) must ensure pets do not cause damage, odors, or disturbances. 14. OWNER'S ACCESS FOR INSPECTION AND EMERGENCIES: Owner or Owner's Agents may enter the premises in case of emergency, to make repairs, improvements, or show the unit to prospective tenants or buyers. Except in emergencies, Owner shall give reasonable notice and enter only during normal business hours. 15. VIOLATION OF LAWS AND DISTURBANCES: Tenant(s) shall not use the premises to violate any law or ordinance, nor create disturbances, excessive noise, or interfere with other residents' quiet enjoyment. 16. REPAIRS AND ALTERATIONS: Tenant(s) shall not make alterations or repairs without prior written consent of the Owner. 17. DAMAGE TO PREMISES AND RENTER'S INSURANCE: If the premises are damaged by fire or other casualty covered by insurance, Owner may repair or terminate this Agreement. Tenant(s) agree to carry renter's insurance or assume financial responsibility for personal belongings and damages caused by their negligence. 18. WATERBEDS AND WATER FURNITURE: No waterbeds or water-filled furniture shall be kept on the premises without Owner's written consent. 19. RULES AND REGULATIONS: Tenant(s) agree to comply with all HOA rules and any reasonable regulations established by the Owner to ensure the safety and comfort of all residents. 20. ATTORNEY FEES: In any legal proceeding to enforce this Agreement, the prevailing party shall recover reasonable attorney fees and court costs. 21. ENTIRE AGREEMENT: This document constitutes the entire Agreement between the parties and may not be modified except in writing signed by both parties.
