Tenant Access
You can enjoy the entire upstairs space, the deck, and the backyard. Anything not marked private is yours to explore (the areas that are private are a couple of closets upstairs, the garage, and the private living quarters downstairs for your hosts John and Maria).
Getting in and out is easy using the smart lock on the front door--you'll get your own private code along with a traditional key.
Lease Agreement for Long-Term Rental
This Lease Agreement is made by and between the Homeowner ('Owner') of the rental property known as Vila Azul ('Vila Azul') and the tenant leasing the property ('Tenant') as of the date set forth upon signing this agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1. Property
Vila Azul is located at the address that will be provided to the Tenant upon finalizing the lease agreement.
As described in the listing, the property is equipped with various amenities, furnishings, and equipment for the convenience and comfort of the Tenant, all members of the rental party ('Tenants'), and anyone else the Tenant permits on the property ('Visitors') (Tenant, Tenants, and Visitors collectively referred to as 'All Occupants'). All Occupants are required to use these amenities and equipment responsibly and to follow any provided instructions. The Owner shall not be liable for any injuries or damages resulting from the misuse or improper use of these items. All Occupants are responsible for ensuring that everything provided by the Owner is used safely and appropriately and returned in the same condition it was provided. Any damage to or loss of property, amenities, and equipment may result in additional charges to the Tenant.
2. Maximum Occupancy
The number of regular occupants is limited to 3 persons, with a maximum of 6 persons to allow for spouses, partners, etc. The number of occupants may affect utility rates. Exceeding this limit will result in immediate termination of the lease without refund, and the Tenant may be subject to additional penalties or fines as determined by the Owner.
3. Utilities and Additional Payments
The Tenant is responsible for a portion of the utility costs based on the number of occupants:
- For 3 persons or fewer: The Tenant shall be responsible for 50% of the total utility costs, including electricity, water, gas, internet, and any other utilities as agreed upon.
- For 4 or more persons: The Tenant shall be responsible for 75% of the total utility costs.
The Owner will provide an estimate of utility costs, but the Tenant will be billed based on actual usage. Any additional fees, such as for extended-stay Visitors or additional services, will be outlined in a separate addendum to this lease and are payable as specified. Failure to pay utility costs or additional fees within the specified timeframe may result in late fees and could lead to termination of the lease.
4. Monthly Rent
- The monthly rent is $4,700 for lease terms of less than 9 months.
- For lease terms of 9 months or longer, the monthly rent is $4,500.
Rent is due on the first day of each month. If rent is not received by the fifth day of the month, a late fee of $100 will be applied. Continued failure to pay rent on time may result in eviction as permitted by state law.
5. Security Deposit
The Tenant agrees to pay a security deposit of $4,500 upon signing this lease. This deposit will be held by the Owner as security for the performance of the Tenant's obligations under this lease, including but not limited to the payment of rent, the cost of repairs for any damages beyond normal wear and tear, and any cleaning fees if the property is not left in the condition it was found.
The security deposit will be returned to the Tenant within 21 days after the end of the lease term, provided that all terms of the lease have been met. If any deductions are made from the security deposit, the Owner will provide an itemized statement of such deductions.
6. Term of the Lease
The lease begins at noon US Central Time on the start date specified in this agreement and ends at noon US Central Time on the end date specified. All Occupants must adhere to the lease terms.
7. Minimum Stay
Vila Azul requires a minimum stay of 3 months. Leases not meeting this requirement will not be accepted.
8. Payment and Cancellation
Payment schedule, cancellation policy, and refunds are subject to the terms and conditions specified in this agreement and any additional policies provided by the Owner.
9. Renter's Insurance
The Tenant is required to obtain renter's insurance and provide proof of insurance to the Owner no later than one week before the lease term begins. The insurance must cover personal property, liability, and any other risks typically covered by such policies. Failure to provide proof of insurance will be considered a breach of this lease agreement and may result in the termination of the lease.
10. House Rules
The Tenant agrees to abide by the House Rules at all times while at the property and shall cause all Occupants to abide by the following rules at all times while at the property. Failure to follow the House Rules will be considered a breach of this lease agreement and multiple violations may result in the termination of the lease.
The Owner may choose to relax or cancel one or more of the House Rules at their discretion and reserves the right to reinstate the rule(s) at any time as originally written.
10.1. Compliance
All Occupants must comply with all local laws and regulations.
10.2. No Smoking/Vaping
Smoking, vaping, or use of e-cigarettes on the property is strictly prohibited. Each violation will incur a minimum $300 extra cleaning fee and may result in immediate termination of the lease.
10.3. No Illegal Substances
The possession or use of illegal substances on the premises is strictly prohibited. Violation will result in immediate termination of the lease.
10.4. Firearms Policy
a. Prohibition of Firearms:
- The possession, use, or storage of firearms and ammunition is strictly prohibited on the rental property, including all interior and exterior areas. This applies to the All Occupants.
b. Exceptions and Compliance:
- This prohibition does not apply to law enforcement officers or individuals legally required to carry a firearm as part of their professional duties, provided they notify the Owner in advance.
- The Tenant must comply with all applicable federal, state, and local laws regarding weapons. Any violation of this policy will result in immediate termination of the lease and eviction.
c. Signage and Enforcement:
- Appropriate signage may be posted at the property entrances to reinforce this policy. The Owner will enforce this rule consistently to ensure the safety and security of all Occupants.
10.5. No Pets
No pets are allowed. This rule will be strictly enforced. Violations may result in immediate termination of the lease and cleaning fees for any damage or extra cleaning required.
10.6. Guest and Visitor Policy
a. Short-Term Visits:
- Visitors are allowed for up to 7 consecutive days. Visitors staying more than 14 days in a year must obtain prior approval from the Owner.
b. Extended Stay Visitors:
- For Visitors staying longer than 7 consecutive days or more than 14 days in a year, the Tenant must request approval from the Owner at least 10 days in advance.
- The Owner may charge an additional fee for approved extended-stay Visitors.
c. Tenant Responsibility:
- The Tenant is responsible for the behavior of their Visitors and any property damage. Visitor violations will be treated as Tenant violations and may result in penalties, fines, or eviction.
d. Enforcement:
- Violating this policy may lead to eviction or other legal action.
e. Privacy and Fairness:
- The Owner respects the Tenant's privacy and will enforce these rules consistently across all Tenants.
10.7. Cleanliness and Maintenance Rules
a. Eating and Drinking:
- Designated Areas: Eating and drinking are allowed only in designated areas (e.g., kitchen, dining room). Bedrooms must be kept free of food and beverages to maintain cleanliness and prevent pests.
- Furniture and Surfaces: After eating or drinking, All Occupants must ensure that all furniture, counters, tables, and floors are wiped clean to prevent stains and pests.
b. General Cleanliness:
- Common Areas: The Tenant is required to keep shared spaces such as the kitchen, living room, and bathrooms clean. This includes wiping down surfaces, washing dishes promptly, and sweeping or vacuuming floors regularly.
- Personal Spaces: While bedrooms and private areas are the Tenant's responsibility, they must be kept tidy to avoid attracting pests or causing damage to the property.
c. Garbage and Recycling:
- Daily Garbage Disposal and Recycling: Garbage and recycling must be placed in the designated bins in the kitchen island. Recyclables must be sorted according to local guidelines and must be clean and free of food residue.
- Garbage Disposal: Garbage and recycling bags that are full or emitting odors must be immediately removed and placed in the designated bins outdoors.
d. Additional Cleanliness Guidelines:
- Spills: All spills must be cleaned up immediately to prevent staining or damage to floors and surfaces.
- Odor Control: Trash must be disposed of regularly, and food must not be left out to prevent unpleasant odors in the property.
- Shared Responsibility: If multiple Tenants share common areas, it is expected that each Tenant will contribute to maintaining a clean and orderly environment.
e. Use of Provided Cleaning Supplies
The Owner will provide appropriate cleaning supplies for the Tenant and all Occupants to use in order to maintain the property. These supplies include, but are not limited to, cleaning utensils and solutions specifically suited for various surfaces such as stainless steel, wood flooring, granite, quartz, tile, and leather. The Tenant is required to use these supplies as directed to ensure the proper care and maintenance of the property. Failure to use the provided supplies correctly may result in additional cleaning or repair costs.
10.8. Towel Usage
Wet or dirty towels must not be left on beds, furniture, or hardwood floors. Towels must be hung on hooks or towel racks in the bathroom. Used towels must be placed in hampers and arranged for collection with the Owner if left for more than 24 hours. Repeated violations of this rule may result in extra cleaning fees or deductions from the security deposit.
10.9. Bathroom Usage
a. Ventilation: The bathroom fan must be turned on to help reduce moisture and prevent mold and mildew growth. The fan should run for at least 15 minutes after showering or bathing but should not be left running for more than 45 minutes to conserve energy. The bathroom door must be kept closed to prevent steam from damaging bedroom and hallway walls.
b. Water Spills: The shower curtain must be kept closed while showering or bathing to prevent water from splashing outside the shower area. All water spills on the floor or counters must be immediately wiped up to prevent water damage and maintain a safe, dry environment.
c. Toiletries and Products: Personal toiletries must be stored in a way that keeps counters and sinks free of clutter. Soap, shampoo, or other product residue must be cleaned up to keep the bathroom clean and avoid slipping hazards.
10.10. Safety Devices
Smoke alarms and carbon monoxide detectors must not be tampered with. The Tenant must notify the Owner immediately if any alarms go off for any reason. Smoke alarms and CO detectors will produce a short electronic beep at random times once a month as part of automated testing as required by law. Violations of this rule may result in penalties, fines, or deductions from the security deposit.
10.11. Kitchen Care
a. Cooking: The oven hood must be used when cooking to exhaust cooking fumes and prevent setting off smoke detectors.
b. Hot Pads/Trivets: Trivets and silicone hot pads must be used for hot pots, pans, or dishes to avoid damage to countertops and tables.
c. Gas Burners: Gas burners must be fully turned off after use. Occupants must not lean against gas burner dials.
d. Dishwashing: All used dishes must be cleaned in the dishwasher during the Tenant's stay. Only the dishwasher detergent (found under the kitchen sink) must be used in the dishwasher.
e. Stainless Steel Cleaning: Stainless steel surfaces must only be wiped with water and the designated sponge found under the kitchen sink. The Tenant must contact the Owner if more thorough cleaning of stainless surfaces is required.
10.12. Furniture Care
Furniture must not be damaged, including using bleach/alcohol wipes for cleaning, placing wet towels on it, or otherwise using it in an improper manner. Coasters must be used for drinks. The Tenant will be charged for damages exceeding the security deposit.
10.13. Furniture Movement
Furniture must not be moved or dragged across wood floors. The Tenant must contact the Owner if furniture needs to be moved. Unauthorized movement of furniture that results in damage will incur repair costs and may lead to deductions from the security deposit.
10.14. Parking
The driveway is to be used only for quick loading and unloading. All vehicles must be parked using the free street parking without blocking the mailbox. Violations of the parking policy may result in penalties or towing at the Tenant's expense.
10.15. Private Spaces
Doors marked as "Private," including closets in the hallway, must not be opened. Unauthorized entry into private spaces may result in a penalty fee and could be grounds for lease termination. The Tenant must contact the Owner if extra supplies are needed.
10.16. Quiet Hours
Quiet hours are from 11:00 PM to 7:00 AM. During this time, All Occupants are required to keep noise levels to a minimum to avoid disturbing neighbors. Noise levels must not exceed what is typical for a residential setting at any time. Repeated violations of this policy may result in warnings, fines, or other actions as permitted under this lease agreement.
10.17. Outdoor Maintenance
a. The Owner will be responsible for regular yard maintenance, including lawn care and general upkeep of outdoor areas.
b. The Tenant is required to clear snow from the front porch, the sidewalk up to the front door, and to ensure a clear and safe path to the public sidewalk or the road. The Owner will provide a shovel for this purpose.
c. The Tenant is responsible for their own safety during inclement weather, including taking precautions when walking on or removing snow and ice, as well as during severe weather events such as tornado-warned storms. Under Wisconsin law, tenants are required to take reasonable steps to prevent injuries related to snow and ice on walkways they are responsible for clearing (Wis. Stat. 704.07). The Tenant agrees to hold the Owner harmless for any injuries resulting from the failure to properly clear and maintain these areas.
10.18. Extra Cleaning and Damage Fees
a. During the Lease Term:
- If excessive messes or damage occur during the lease term such as vomit, spills, stained linens, excessive dirt or mud, or other conditions requiring cleaning or repair beyond standard procedures the Tenant must notify the Owner immediately.
- Upon notification, the Tenant and Owner may agree to a just-in-time cleaning or repair service. If the Tenant pays these costs as they arise, it will not impact the security deposit.
b. End-of-Lease:
- At the end of the lease term, the property will be inspected for damages or excessive cleaning needs beyond normal wear and tear. Any such issues identified during this inspection will result in additional charges.
- These charges may be deducted from the security deposit unless the Tenant opts to pay separately within a specified period after the final inspection.
c. Fees and Rates:
- Cleaning will be charged at $40 per hour, with a minimum charge of one hour.
- Repairs due to tenant-caused damage will be charged at a minimum of $40 per hour plus materials, or at the professional craftsman's rate plus materials.
10.19. Complimentary Laundry Service
The Owner offers a complimentary laundry service to the Tenant, with the frequency and arrangements to be mutually agreed upon. This service is optional, and the Tenant must notify the Owner if they wish to use it. The laundry service is intended for regular household laundry only. Special care items or excessive laundry may not be covered under this service and could incur additional fees.
Acknowledgment
By signing this agreement, the Tenant acknowledges they have reviewed, understood, and agreed to comply with all terms and conditions of this Lease Agreement.
